17.22 Open

Space Zone OS

17.22.010 Purpose

The purpose and intent of the OS open space and parks zone is to establish areas anywhere in Hyrum City where only open space and generally undeveloped lands are to be encouraged. Development of a comprehensive network of permanent, multifunctional, and publicly owned open spaces shall be encouraged. All parks owned by the city may be given the OS zone designation. Land that has been legally deeded to the city or land that has had a conservation easement recorded on it may be rezoned to the OS zone.

17.22.020 Definitions

Open Space - “Open space” shall mean any area or parcel of property dedicated to the city, within a recorded conservation easement, either public or private, or United States Forest Service land, that would be kept in its natural state for perpetuity, due to its inability to be used for typical recreational or residential uses.
Parks - “Parks” shall mean any area or parcel of property dedicated to the city or within a conservation easement that is to be used for, or is currently developed for, recreational uses, such as, but not limited to, playgrounds, athletic fields, picnicking, or group gatherings. These areas would be landscaped and maintained in the same manner as other parks within the city. All park areas must be deeded to or dedicated to the city.

17.22.030 Use Regulations

In this zone, no land use shall be permitted except those designated below.

  1. Permitted uses:
    1. Agriculture production and accessory structures.
    2. City initiated parks, open spaces, trails, cemeteries or other city related activities.
    3. City owned accessory structures for storage of equipment.
    4. City owned buildings and structures for recreation.
    5. City owned or city initiated water detention and/or debris basins.
    6. City owned water well, water storage tank and all related equipment.
    7. Conservation areas including, but not limited to, wilderness areas, watershed areas, wildlife refuges and wetlands.
    8. Forests and urban forests.
  2. Conditional Uses:
    1. Public structures such as electrical, gas, telephone transmission and fire stations.
    2. Horse stable or horse arena and related structures and equipment.
    3. Private cemetery.
    4. Private golf courses (except clubhouse, concessions and other commercial uses that will require a commercial zone, and project plan approval).
    5. Private water detention and/or debris basin.
    6. Private water well or at grade storage tank and related equipment.

17.22.040 Area Regulations

Minimum area requirements are to be determined by the Planning Commission and City Council.

17.22.050 Maintenance Of Facilities

  1. Parcels of property dedicated to the city for the use of a park shall be maintained by city employees, individuals contracted by the city, or volunteers, such as, but not limited to, scout projects, recreational groups, etc., under the direction of city staff.
  2. Open space areas should not need maintenance other than for safety reasons, such as fire roads, trails, access to water wells and water tanks, debris basins, utilities, etc. The maintenance would be performed by city employees or forest service employees.

17.22.060 General Provisions

  1. No subdivision or development, except for recreational facilities, shall be allowed in any area designated as open space.
  2. All open space must be maintained by the property owner. The open space may be dedicated to the City for use as a public park if the City is willing to accept the dedication.
  3. Primary buildings may not be constructed in open space areas, but accessory buildings that are subordinate to and customarily incidental to the primary agricultural or recreational use of the open space shall be allowed.
  4. The area around structures shall be kept free from refuse and debris, and all waste containers shall be concealed from the view of adjacent property.
