CHAPTER 19
29 OS OPEN SPACE ZONE
§ 19.29.010 Purpose of zone.
The OS zone provides for land set aside for the protection of sensitive and fragile natural resources. This zone is intended to limit and control access and intensity of uses in these areas. This zone applies to the Tijuana River Valley.

§ 19.29.020 Establishment of OS zone.
Lands may be placed in the OS zone under the following conditions:
A.
Where land is in use as or intended for future use as:
1.
Marine and wildlife preserves, permanent open space or landscaped areas, natural resource or environmentally sensitive lands;
2.
Drainage or flood control channels, creeks, rivers, estuaries, watercourses, watersheds, reservoirs; and
3.
Other facilities or uses which, in the opinion of the Planning Commission would fulfill the intent of this chapter.
B.
Public or privately owned lands when the use of such lands would endanger the public health, safety or general welfare or lands which are considered to be environmentally sensitive or that contain valuable natural resources, including:
1.
Areas where natural topography may be too steep to build upon and/or where the grading or development of land would endanger public health or safety due to unstable geologic conditions, erosion or flooding;
2.
Natural resource areas which have limited carrying capacity or are environmentally sensitive such as the Tijuana River Estuary and the Oneonta Slough; and
3.
Other lands which, in the opinion of the Planning Commission, would fulfill the intent of this chapter.

§ 19.29.030 Permitted uses by Conditional Use Permit.
All permitted land uses in the OS zone shall be subject to the approval of a Conditional Use Permit as authorized in Chapter 19.85 of this title. Any such use that was in existence prior to the property being reclassified to OS may be continued or altered without securing a Conditional Use Permit, providing that there is no increase in the intensity of use.

§ 19.29.050 Building height.
No building or structure in the OS zone shall exceed twenty-six feet in height.
