"S-1" SPECIAL CEMETERY ZONE AND "S-2" SPECIAL CEMETERY RESTRICTED ZONE

§ 12-36 S-1 and S-2 Special Zones. Regulations.

The following regulations shall apply in the S-1 Special Cemetery Zone and the S-2 Special Cemetery Restricted Zone.

§ 12-36.1 Burial Outside Zone Unlawful.

It is unlawful to cause to be buried or interred the body or remains of a human being, any place within the City of Inglewood not classified in the S-1 Special Cemetery Zone or S-2 Special Cemetery Restricted Zone.

§ 12-36.2 S-1 Special Cemetery Zone. Permitted Uses.

The following uses only are permitted in the S-1 Special Cemetery Zone:
(1) 
Burial of bodies, ashes or remains of dead human beings below the ground, including placement or erection of markers, headstones or monuments over such places of burial.
(2) 
Entrance features including gates, fountains, statuary, identification signs and the like; upon the following conditions:
(a) 
There shall be not more than two identification signs at each entrance and each shall not exceed one hundred square feet in area.
(b) 
The main portion of entrance features shall be located at least ten feet from any public street.
(3) 
Business or administration offices, flower shops, mortuaries and chapels upon the following conditions:
(a) 
Any such building or structure shall be at least twenty feet from any public street and five feet from any property in any R Zone.
(b) 
No such building or structure shall exceed two stories or thirty-five feet in height.
(c) 
All required areas between such buildings or structures and a public street and property in any R Zone, except for walkways, parking areas or driveways, shall be landscaped and permanently maintained.
(4) 
The necessary maintenance facilities including lath-houses, greenhouses, warehouses, repair shops and the like upon the following conditions:
(a) 
Any such building or structure shall be at least twenty feet from any public street and five feet from any property in any R Zone.
(b) 
No such building or structure shall exceed one story or twenty feet in height.
(c) 
All required areas between such buildings or structures and a public street and property in any R Zone, except for walkways, parking spaces or driveways, shall be landscaped and permanently maintained.
(5) 
Crematory, upon the following conditions:
(a) 
Such building or structure shall be at least one hundred fifty feet from any public street and any property in any R Zone.
(b) 
Such building or structure shall not exceed one story or twenty feet in height.
(6) 
Mausoleums, columbariums or other like buildings or structures for interment of human remains, upon the following conditions:
(a) 
Any such building or structure less than twenty feet in height shall be at least ten feet from any public street and four feet from any property in any R Zone.
(b) 
Any such building or structure from twenty feet to forty feet in height, which height excludes architectural rooftop features as provided in subsection (6)(c) of this Section, shall be at least ten feet from any public street and twenty feet from any property in any R Zone.
(c) 
No such building or structure shall exceed forty feet in height; provided, that rooftop architectural features such as, but not limited to, cupola, vaulted roof, bell tower, or similar appurtenances, are exempt if such rooftop features do not exceed twenty feet above such building or structure, do not add usable floor area or interment space, and do not cover more than twenty-five percent of the roof area.
(d) 
All areas between such buildings or structures and a public street and property in any R Zone located off-site, except for walkways, parking spaces and driveways, shall be landscaped and permanently maintained including a continuous row of evergreen, vertical landscaping in sufficient quantities to provide a visual buffer screen between mausoleums and columbariums and adjacent off-site properties. The type, number, size, and location of coniferous and deciduous tree species for the visual buffer screen shall be approved by the Planning Director. Provided, however, if such areas are used for off-street parking of automobiles there shall be a strip of land not less than five feet in width surrounding such off-street parking areas, except for walkways and driveways, which shall be landscaped and permanently maintained.
(e) 
An on-site dust control mitigation plan and circulation/haul route must be approved by the Planning and Building Director as part of the application for such a building or structure.
(7) 
All property within a cemetery shall be enclosed with a fence or wall, provided:
(a) 
No solid portion of any wall or fence within three feet of any public street, shall exceed three and one-half feet in height except as may be part of an entrance feature and within fifty feet of such entrance.
(b) 
No solid portion of any wall or fence adjacent to property in any R Zone shall exceed eight feet in height.
(c) 
No open mesh type wire fence or iron work shall exceed ten feet in height except as may be part of an entrance feature and within fifty feet of such entrance.
(d) 
Any space greater than one foot between a public street and solid wall or fence shall be landscaped and permanently maintained.

§ 12-36.3 S-2 Special Cemetery Restricted Zone. Permitted Uses.

The following uses only are permitted in the S-2 Special Zone.
(1) 
Burial of bodies, ashes or remains of dead human beings below the ground, including placement or erection of markers, headstone or monuments over such places of burial.
(2) 
Entrance features including gates, fountains, statuary, identification signs and the like; upon the following conditions:
(a)

(4)

No such building or structure shall exceed forty feet in height; provided, that rooftop architectural features such as, but not limited to, cupola, vaulted roof, bell tower, or similar appurtenances, are exempt if such rooftop features do not exceed twenty feet above such building or structure, do not add usable floor area or interment space, and do not cover more than twenty-five percent of the roof area.
(d) 
All areas between such buildings or structures and a public street and property in any R Zone located off-site, except for walkways, parking spaces and driveways, shall be landscaped and permanently maintained including a continuous row of evergreen, vertical landscaping in sufficient quantities to provide a visual buffer screen between mausoleums and columbariums and adjacent off-site properties. § 12-36.4 General Provisions Governing Special S-1 and S-2 Zones.

The following requirements and limitations shall apply to special zones:
(1) 
The provisions of Article 25 of this Chapter shall not be applicable to S-1 and S-2 Zones, it being the intent to have the provisions of this Article strictly enforced.
(2) 
No property shall be rezoned to S-1 or S-2 unless the owner of any subject property has filed a written consent or request therefor with the Planning and Building Department; provided, however, that property may be reclassified as S-1 or S-2 if it had been dedicated for cemetery purposes on or before January 19, 1959.
(3) 
S-1 and S-2 Zones are established due to special circumstances and conditions and at any time the owner or owners of property in said zones file a request, the City Planning Commission shall immediately undertake investigation and study toward the rezoning of said property to an appropriate zone within the Comprehensive General Plan.
(4) 
All provisions of this Chapter that provide for a transition from one zone to another, or provide for special permission due to the proximity of property to property zoned for a heavier use, shall not apply to property in S-1 and S-2 Zones, nor to any other property by reason of its proximity to property so zoned; but said S-1 and S-2 Zones shall be considered Special Zones, restricted as to use and no use shall be permitted therein except those uses specifically enumerated in this Article.
