- L-1 LIGHT INDUSTRIAL DISTRICT
The L-1 Light Industrial District (hereinafter known in this article as the L-1 District) is designed to accommodate light industry and related activities so that the economic structure of the community may be strengthened and employment opportunities may be found while protecting the established residential areas and promoting the most desirable use of the land in accordance with the City of Jennings Comprehensive Plan.
The uses permitted by right and by conditional use permit are listed in the table of permitted uses found at the end of this article. If a "P" (permitted by right) or a "C" (permitted by conditional use permit) is not indicated for a use in this table, or a use is not included on the table, it is prohibited.
These standards are applicable to all "L-1" Districts. The following requirements shall apply:
11.3.1 Noise. The sound pressure level, based upon American Standard Association shall not exceed the following decibel levels, as described below, in the designated octave bands when adjacent to the designated types of use districts.
Sounds of an intermittent nature which are not easily measured shall be controlled so as not to become a nuisance to adjacent uses.
11.3.2 Method of measurement. Measurement is to be made at the nearest boundary of the nearest residential district, or planned unit development which contains a residential use, or at any other point along the boundary where the level is higher. The sound levels shall be measured with a sound level meter and associated octave band filter as prescribed by the American Standards Association.
11.3.3 Smoke and particulate matter. The emission of smoke or dusts by industrial plants in an amount sufficient to create a general nuisance to adjoining properties shall be prohibited. Total emission of smoke and particulate matter shall be limited to the following:
(a)
Ringelmann Requirements. All smoke and the emission of all other particulate matter in quantities sufficient to produce an opacity at a point greater than Ringelmann 3 is prohibited. The only exception shall be a plume consisting entirely of condensed steam. A Ringelmann 1 Unit is defined as twenty (20) percent density for one (1) minute. No more than fifteen (15) units of Ringelmann smoke shall be permitted per hour and no smoke more intense than Ringelmann 2 shall be permitted, except that during one (1) hour of a twenty-four (24) hour day, thirty (30) units of smoke may be emitted, but with no smoke more intense than Ringelmann 3.
(b)
The total quantity of emitted solids shall not exceed one pound per hour, per acre of lot area.
11.3.4 Odors. No objectionable or offensive odor shall be emitted by any permitted use in the L-1 District.
11.3.5 Toxic gases. Processes and operations of permitted uses, capable of dispersing toxic gases or toxic particles into the atmosphere shall be hooded or otherwise suitably enclosed. The emission of such toxic gases or particulate matter shall be prohibited.
11.3.6 Glare and heat. Operations producing intense light or heat shall only be performed within an enclosed building and such light or heat shall not be visible or detectable beyond any lot line bounding the property whereon such operation is conducted.
11.3.7 Vibrations. Every use shall be so operated that the maximum ground vibration generated is not perceptible without instruments at any point on the lot line of the lot on which the use is located.
11.3.7 Radiation. Every use shall be so operated that there is no dangerous amount of radioactive emissions in accordance with the standards of the Federal Radiation Council.
The maximum building height in the L-1 District is six (6) stories or seventy-five (75) feet, whichever is less. Provided, however, that no structure located on a lot abutting any residential district shall exceed three (3) stories or forty (40) feet, whichever is less, from grade.
No minimum lot size shall be required for uses in the L-1 District except for special conditions set forth by the city council upon approval of a conditional use permit within the L-1 District.
No minimum lot width shall be required for uses in the L-1 District.
The following are setback requirements for a primary building in the L-1 District.
11.7.1 Front yard setbacks. A minimum of thirty (30) feet from the building facade to the property line.
11.7.2 Rear yard setbacks. A minimum of twenty (20) feet from the building facade to the property line. When abutting a residential district or a planned unit development which contains residential uses, there shall be a landscaped rear yard having a depth of not less than twenty-five (25) feet.
11.7.3 Side yard setbacks. A minimum of twenty (20) feet from the building facade to the property line. When abutting a residential district or a planned unit development which contains residential uses, there shall be a landscaped side yard having a depth of not less than twenty-five (25) feet.
Those buildings or parts of buildings that are a legal nonconforming use of the setback provisions may be repaired and remodeled, but not reconstructed or structurally altered, unless made to conform with the regulations of this zoning ordinance.
Site plan review, pursuant to the procedures and standards outlined in Articles 15 or 16 of this appendix, is required for any development in the City of Jennings.
In applying the requirements for site plan review, the city plan commission shall have the discretion to consider alternatives and modifications if their strict application will result in unusual practical difficulties or particular hardship, or if the plan commission determines that such alternatives or modifications to these guidelines will serve the best interest of the city.
Every principal industrial structure must provide off-street parking in accordance with Article 20 of this appendix.
No existing lot of record within the L-1 District shall be resubdivided unless the resubdivided lot conforms to the area and frontage requirements of this zoning district and, in addition, be consistent with the lots located in the immediate neighborhood with regard to size, frontage and arrangement so as to provide an orderly pattern of development. No flag lot shall be created as a result of a resubdivision.
