ARTICLE 8

- C-2 SHOPPING AND SERVICE COMMERCIAL DISTRICT

Section 8.1.- Purpose statement.

The C-2 Shopping and Service Commercial District (hereinafter known in this article as the C-2 District) is designed to accommodate a variety of general commercial activities in order to provide a wide range of goods and services usually used, consumed or needed in the home or by individuals. It is the purpose of these regulations to facilitate the establishment of conditions suitable for the grouping and operating of small businesses catering to the general public.

Section 8.2. - Permitted uses.

The uses permitted by right and by conditional use permit are listed in the table of permitted uses found at the end of this article. If a "P" (permitted by right) or a "C" (permitted by conditional use permit) is not indicated for a use in this table, or a use is not included on the table, it is prohibited.

Section 8.3. - Maximum building height.

The maximum building height in the C-2 District is four (4) stories or forty-eight (48) feet, whichever is less.

Section 8.4. - Minimum lot width.

The minimum lot widths for the C-2 District shall be fifty (50) feet. Modifications may be allowed subject to section 8.6.

Section 8.5 - Minimum lot area.

A lot, tract or parcel of land shall have an area of at least twelve thousand (12,000) square feet, except gasoline stations which shall be situated on lots of at least fifteen (15,000) square feet and hospitals on forty-three thousand five hundred (43,500) square feet.

Section 8.6. - Exceptions to the minimum lot width and area.

The condition whereby a lot of record established prior to the passage of this zoning ordinance has less width, or less area, than herein required.

Section 8.7. - Setback requirements.

The following are setback requirements for a primary building in the C-2 District and modifications to those requirements when certain conditions exist.

8.7.1 Front yard setbacks. A minimum of twenty (20) feet from the building's front facade to the front property line. Modifications to the required front yard setback are permitted/required under the following conditions:

(a)

Restaurants may offer customer seating and food service for outdoor dining within the front yard setback only as authorized by the city plan commission.

(b)

Where lots have double frontages (usually on corner lots), the required front yard setback provision shall be provided on both streets.

(c)

Pumps and pump islands for retail gasoline service stations may project or be located in the required front yard, provided they are at least fifteen (15) feet from any street line and at least fifty (50) feet from the boundary of a residential district.

8.7.2 Rear yard. The required setback in a C-2 District is ten (10) percent of the depth of the lot, measured from the front to the rear property line. The setback must be a minimum of ten (10) feet from the rear property line to the closest rear wall of the primary building. When abutting a R-1, R-2, or R-3 District, there shall be a landscaped rear yard having a depth of not less than twenty-five (25) feet. Modifications to the required rear yard setback are permitted/required under the following conditions:

(a)

Open, uncovered porches, patios and aboveground decks may project not more than twelve (12) feet into a required rear yard, provided the floor level of any such structure is at or below the level of the first floor of the building. Balconies may project into the required rear yard a maximum distance of five (5) feet.

(b)

Lots which have grade slopes of more than five (5) feet measured across the lot width at the curb line or calculated from the finished grade between the side property lines shall maintain a rear yard setback of not less than thirty (30) percent of the lot depth with a thirty-foot minimum.

(c)

Where a corner lot exists and thereby two (2) front yards, the property line opposite to the front yard line with the greater street frontage shall be considered the side yard and the property line opposite to the front yard line with the lesser street frontage shall be considered the rear yard.

(d)

An accessory building not exceeding twenty (20) feet in height may occupy no more than thirty (30) percent of the area of a required rear yard but no accessory building shall be closer than ten (10) feet to the primary building nor closer than five (5) feet to any rear property line.

(e)

Outside stairways, tower balconies or fire escapes may project no more than four (4) feet beyond the face of the wall.

(f)

Roof eaves may project no more than three (3) feet beyond the face of the wall.

(g)

Windowsills, bay windows, belt courses and similar architectural features, as well as rain leaders and chimneys, may project no more than two (2) feet beyond the face of the wall.

8.7.3 Side yard setbacks. There are no minimum or maximum side yard setback provisions for the C-2 District, except where a lot in the C-2 District abuts a R-1, R-2, or R-3 District, a side yard of at least ten (10) feet shall be provided.

Section 8.8. - Legal nonconforming uses of the setback provisions.

Those buildings or parts of buildings that are a legal nonconforming use of the setback provisions may be repaired and remodeled, but not reconstructed or structurally altered, unless made to conform with the regulations of this zoning ordinance.

Section 8.9. - Site plan review.

Site plan review, pursuant to the procedures and standards outlined in Articles 15 or 16 of this appendix, is required for any new development in the City of Jennings.

In applying the requirements of a site plan review, the city plan commission shall have the discretion to consider alternatives and modifications if their strict application will result in unusual practical difficulties or particular hardship, or if the plan commission determines that such alternatives or modifications to these guidelines will serve the best interests of the city.

Section 8.10. - Off-street parking and loading requirements.

Every primary building must provide off-street parking in accordance with Article 20 of this appendix.

Section 8.11. - Resubdivision of lots.

No existing lot of record within the C-2 District shall be resubdivided unless the resubdivided lot conforms to the area and frontage requirements of this zoning district and, in addition, be consistent with the lots located in the immediate neighborhood with regard to size, frontage and arrangement so as to provide an orderly pattern of development. No flag lot shall be created as a result of a resubdivision.
