CHAPTER 15

33.- BUILDING AND OCCUPANCY PERMITS

Sec. 15.33.010.- Issuance of building permits.

1.

A building permit may be issued for a building on a lot that is part of a new subdivision, provided the lot meets the following criteria:

a.

The plat has been recorded. The developer in whose name the subdivision bond/performance agreement is issued may submit a building permit application prior to recording the plat, otherwise the plat needs to be recorded;

b.

The subdivision bond/performance agreement is put into place;

c.

Fire protection is installed within the subdivision.

d.

An all-weather road has been constructed and approved by the fire district.

2.

A building permit may be issued for a building on an existing lot of record that abuts an existing street provided that the lot meets the following criteria:

a.

The lot abuts an existing dedicated street that is paved with asphalt or concrete, which has been approved by the city;

b.

The lot is within 250 feet of a working fire hydrant.

Sec. 15.33.020. - Issuance of occupancy permits.

1.

No building allowed by KMC 15.33.010 shall be approved by the Kamas City Building Official for occupancy within any subdivision until the subdivision improvements have received final completion as determined by the city engineer.

Sec. 15.33.030. - Temporary moratorium on building permits.

The public health, safety, and welfare of Kamas City residents requires that a moratorium be, and is hereby placed, on all residential, subdivision, and commercial development approvals. This moratorium shall be in place for the entire area within the City of Kamas.

The moratorium shall apply to all development applications after this date except building permits on existing lots of record. The moratorium shall be in place for a period of not more than six months.

The six-month time period shall be used to develop proper planning in order to protect the public interest and to promote organized development by allowing time for City of Kamas to review its ordinances and to adequately manage the process.
