CHAPTER 15

38.- AGRICULTURAL TOURISM

Sec. 15.38.010.- Purpose.

To support and enhance Kamas City's family farm and historic ways of farming by maintaining viable small-scale/historical agricultural operations and their essential rural setting. The regulations accommodate a variety of uses that are complementary and accessory to the unique agricultural pursuits. They encourage residents and visitors to learn more about agriculture by allowing education and tourism uses on working farms. These regulations also include provisions to protect adjacent residential and agricultural use.

Sec. 15.38.020. - Use establishment and development review.

Each proposed agricultural tourism project may be established by following the standard development procedures of KMC 15.03 and 15.21 and shall be accompanied by a site plan prepared by the applicant, in consultation with city staff, which identifies, specifies, and details the proposed uses, buildings, floor plans, and other features of the proposed development. There shall also be a concise narrative describing the farm and the overall vision for the proposed agricultural tourism operation. The narrative shall include farm history, a description or plan for the general maintenance of its agricultural product(s), and proposals for the following:

a.

Offerings for agriculturally related, non-agriculturally related products and uses/activities.

b.

Agriculturally related and non-agricultural related types of facilities and equipment.

c.

Time(s) of "normal day-to-day" operation as referenced in 15.38.020 (4).

d.

Anticipated number of daily patrons and employees.

e.

Site plan and design book containing cross section and plan views.

f.

Parking areas, walkways, and driveways.

g.

Water usage for the proposed use.

h.

Wastewater disposal system.

i.

Storm detention and retention area.

j.

Landscaping and lighting plan.

k.

Architectural features and renderings, including material and colors of buildings, freestanding and wall mounted signs and outdoor light fixtures, trash enclosures, utility and loading area screen walls.

l.

Other improvements as required by city staff.

The agricultural tourism operation shall have a general design and layout that concentrates all "tourism" uses and activities into a developed activity center(s). The area within a developed activity center(s) may not exceed 50 percent, up to a maximum of ten acres of a farm's overall gross acreage. The remaining acreage shown outside of all activity center(s), shall be maintained in an agriculturally productive manner that is consistent with the farm's main agricultural uses. Acreage that is incapable of being agriculturally productive due to a topographic condition, physical constraint, and/or farm equipment storage structure(s) etc. that physically interferes with farm production may be kept in it's natural, historic, or constructed state.

An agricultural tourism operation shall, with exception of the winter season, actively and continuously produce an agricultural product for sale and purchase. If the operation's agricultural productivity ceases or becomes improperly maintained, as determined by the planning commission, the right to operate the business may be revoked under title 5.

All uses and activities, not including actual farming activities, shall be limited to operating during the daily hours of 7:00 a.m.—10:00 p.m. The planning commission may consider a variation to this standard upon finding that a proposed use/activity that can only occur during hours otherwise not permitted.

*Chimneys, flagpoles, church towers and other similar structures in excess of 35 feet, not used for human occupancy may be allowed on a case by case basis with a conditional use permit.

Structure to have access. All structures shall be on a lot adjacent to a public street or with access to an approved private street, and shall be so located on lots as to provide safe and convenient access for emergency vehicles.

Sec. 15.38.050. - Standards.

The operation of any use permitted in this district is subject to the following standards of performance:

1.

All uses must be operated so that all practical means are used to confine any noise, odor, dust, smoke, vibration, animal waste or other similar feature to the premises upon which they are located and properly disposed of in a timely fashion (three to six months).

Any light used to illuminate signs, parking areas, or for any other purpose shall be non-glaring, energy efficient and so arranged as to confine direct light beams to the lighted property by appropriate directional hooding. The lights shall be dimmed to half the lumen output by 11:00 p.m.

3.

Agriculture is the primary use in the zone. All agricultural tourism uses/activities shall be complimentary and clearly accessory to the primary agricultural use. To guarantee legitimacy and viability, an agricultural tourism operation shall demonstrate that the subject property has been qualified under the Utah Farmland Assessment Act (Greenbelt Act).

Sec. 15.38.060. - Parking.

Parking standards in KMC 15.25 also apply to the following on-site parking requirements:

Creamery 2 spaces per 1,000 sq ft
Church 1 space per 1,000 sq ft
Community Garden 2 spaces per 1,000 sq ft
Museum 1 space per 2,000 sq ft
Nursery 2 spaces per 1,000 sq ft
Petting Farm 2 spaces per 1,000 sq ft
Retail 4 spaces per 1,000 sq ft
Restaurant, café 1 space per 3 seats or 1 space
per 100 square feet when number of seats is unknown
Reception Center 4 spaces per 1,000 sq ft
Warehouse Storage: Commercial only 2 spaces per 1,000 sq ft
