"Accessory structure"means a building, part of a building or structure which is subordinate to and the use of which is incidental to that of the main building, structure or use on the same lot. An accessory structure is visually subordinate to the main building, and smaller in area and height than the main building. Any addition that is a part of or joined to the main building shall be counted as part of the main building. (Exhibit 18.08.015A)
"Accessory living quarters"means living quarters within an accessory structure located on the same premises with the main building, such quarters having no kitchen facilities or otherwise used as a separate dwelling.
"Accessory use"means a use customarily associated with, incidental to, and on the same lot as a principal use.
Acre, Net Usable."Net usable area" means an acre which excludes the following:
1. The area dedicated or to be dedicated for public streets and easements; and
2. Areas containing development constraints including, but not limited to:
a. Significant ecological areas or geological hazards,
b. Significant stands of native trees,
d. Ridge lines and slopes visible from the valley floor,
f. Heritage trees and heritage groves,
g. Significant topographic, geographic, geologic or hydrologic features such as ridgelines, knolls, water courses, saddles of hills, and liquefaction zones,
h. Slopes of twenty-five percent or greater,
i. Historic/archeological resources of regional or national significance.
"Alley"means a public way permanently reserved as a secondary means of access to abutting property, typically located along rear or side property lines.
"Amusement arcade"means any business or other establishment with four or more amusement devices, or any business or other establishment with fewer than four amusement devices when such devices occupy more than five percent of the total floor area of the business.
"Amusement device"means any video, electronic, electric or mechanical game machine or game table which provides amusement, entertainment or recreation, which may be operated by depositing any coin, slug, token or other article, or by paying a fee either in advance of or after use. The term "amusement device" shall not be construed to mean any coin-operated machine which plays only recorded music, such as a jukebox.
"Antenna"means a device for transmitting or receiving radio, television, telephone or other electronic signals.
"Antenna support structure"means any structure, mast, pole, tripod or tower used for the purpose of supporting an antenna or antennas for the purpose of transmission or reception of electromagnetic waves.
"Apartment"means a portion of a building in a multiple dwelling occupied or suitable for occupancy as a single housekeeping unit.
"Applicant"means a person who requests in writing on an application form the approval of a permit, license, certificate or other entitlement for use from the city.
"Application"means the form and information submitted by an applicant for use by the city to determine whether to approve or deny a permit or other entitlement for use.
"Assembly building"means a building or portion of a building used for gathering together fifty or more persons for such purposes as deliberation, education, instruction, worship, entertainment, amusement, drinking or dining or awaiting transportation.
"Automobile service station"means an area or structure where motor fuel and oil is supplied to motor vehicles, and including grease racks, tire repairs, automobile washing (excluding assembly-type mechanical car washing), battery servicing, ignition servicing, accessory sales, and other customary services for automobiles, but excluding painting, body work and engine overhauling.
"Automobile wrecking"means the dismantling, wrecking or salvage of used motor vehicles or trailers, or the storage, sale or dumping of dismantled or wrecked vehicles or their parts.
"Balcony"means a recessed exterior space or a platform which projects from the exterior wall of a building and is enclosed by a railing or a parapet and is four feet or more above ground level.
"Basement"means a portion of a building below the first story which is partly below and partly above grade but so located that the vertical distance from grade to the floor below is less than the distance from grade to ceiling.
"Bed and breakfast"means an owner-occupied dwelling in which short-term lodging rooms and meals are provided for compensation.
"Berm"means a mound or narrow embankment of earth usually from two to six feet in height, used as a buffer or partial screen to separate parking areas from traffic lanes or to separate land uses.
"Bingo"means a game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conforms to the numbers selected at random.
"Boardinghouse"means a building where meals and lodging are provided for compensation for three and not more than ten persons, but not including rest homes.
"Buffer area"means a landscaped strip of land intended to separate and screen one type of land use from another, to shield or block noise, lights or other nuisances.
"Building"means a permanently located structure having a roof, built for the support, shelter or enclosure of persons, animals, or personal property of any kind.
"Building area"means the sum in square feet of the ground areas occupied or potentially occupied by all buildings and structures on a lot. (Exhibit 18.08.015 B)
"Building height"means the vertical distance measured from the lowest point of the structure exposed above the finished grade to the highest point of the structure. The highest point is the average parapet level, highest point of screening for mechanical equipment, or highest roof peak, excluding chimneys, vents, and utility service screening.
"Building line"means a building setback line generally drawn along the building line if the roof overhang is thirty inches or less, or along building overhangs greater than thirty inches parallel to the property line. (Exhibit 18.08.015 C)
"Building site"means the ground area of a building or group of buildings together with all associated spaces as required by this title.
Building Wall, Exterior."Exterior building wall" means any wall or element of a wall, or any member or group of members, which defines the exterior boundaries, or courts of a building.
"Bungalow court"means a group of three or more detached one or two-family dwellings located on a single lot, together with all open spaces as required by this title, but not including motels.
"Business" or "commerce"means any profession, trade, occupation, vocation, public utility and mutual or private association or venture and all and every kind of calling, whether or not carried on for profit.
Business, Late-Night."Late-night business" means a retail business that is open at any time between the hours of twelve midnight and six a.m.
Business, Major."Major business" means the anchor tenant or tenants of a multi-tenant commercial complex or center. Typically, a major business has at least twenty thousand square feet of gross floor area and is a nationally or regionally significant business with name recognition.
"Carport"means a permanently roofed accessory structure open on at least one side and designed or used for shelter or storage of vehicles.
"Car wash"means a building or area with manual or automated facilities for washing, cleaning, polishing and/or waxing motor vehicles.
"Cellar"means that portion of a building between floor and ceiling which is wholly or partly below grade and so located that the vertical distance from the grade to the floor below is equal to or greater than the vertical distance from grade to ceiling.
"Cemetery"means land used for the burial of the dead and for related uses such as mausoleums, mortuaries, and columbariums.
"Child care facility"means a building in which non-medical care, protection and supervision is provided to children. Child care facilities include day care centers, child day care homes, infant centers, child day care facilities, and small (six or fewer children) and large (seven to fourteen children) family day care homes.
"Church"means a place of worship; intended as a general term covering mosque, synagogue, temple, and other places in which a congregation holds religious services.
"Club"means an association of persons for some common nonprofit purpose, operating under bylaws providing regular dues and procedures for election to membership, but not including "nightclub" groups organized primarily to render a service which is customarily carried on as a business.
"Cluster development"means a design technique that concentrates buildings or lots on a development site to allow the remaining land to be used for recreation, common open space or preservation of environmentally sensitive areas.
"Community care facility"means housing and care facility licensed by the state for residents needing non-medical services, protection, supervision or assistance, which enable such residents to remain in the community.
"Community development director"means the director of the community development department of the city of La Verne. The term "community development director" includes "planning director."
"Condominium"means a structure of two or more units, the interior spaces of which are individually owned; the balance of the property—land and building—is owned in common by the owners of the individual units.
"Congestion management program"means a plan and a series of techniques to control and reduce the traffic impacts of development by means of trip reduction programs, increased use of transit, transportation demand management strategies and transportation systems management strategies.
"Congregate care facility"means a residential care facility, usually for seniors, in a group setting that includes independent living and sleeping accommodations in conjunction with shared dining, recreational, and social services.
"Convalescent home"means any building, buildings or portion thereof, which makes provisions for bed care for chronically ill or convalescent care for one or more persons, exclusive of relatives, who by reason of illness or physical infirmity are unable to properly care for themselves. Alcoholics, drug addicts, persons with mental diseases other than senium dementia, and persons with communicable diseases, including tuberculosis, shall not be admitted or cared for in any convalescent home.
Convenience Food Sales, Ancillary."Ancillary convenience food sales" means sale of prepacked food within an area of one thousand square feet or less at an establishment primarily devoted to another commercial use such as a gasoline service station.
"Convenience store"means a retail establishment offering for sale prepackaged food products prepared elsewhere and household items, with a gross floor area of less than five thousand square feet.
"Council"means the city council of the city of La Verne.
"County"means the county of Los Angeles.
"Country club"means an establishment for social and recreational purposes which is comprised of a range of outdoor facilities including golf courses and tennis courts and incidental facilities including a club house, dining rooms, assembly rooms and a shop selling goods related to the recreational uses.
"Curb return"means location where a curb radius either begins or ends, meeting a straight length of curb.
"Day care"means the care of persons during any period of a twenty-four-hour day where permanent sleeping accommodations are not provided. Also see "Child care facility."
"Day nursery"means any place where more than four children, other than members of the caretaker's family are kept during the day for an agreed price, and for which provision is made in this title.
"Decision-making body"means the person, committee, commission, council or other entity authorized by the city council to make decisions under this title, including the community development director, development review committee, planning commission, and city council as applicable.
"Deck"means an open platform which is either freestanding, or is attached to a building, or is on the roof of a building.
"Density"means the existing or projected number of dwelling units per unit of land, usually per acre.
"Development"means the division of a parcel of land into two or more parcels; the construction, reconstruction, conversion, structural alteration, relocation or enlargement of any structure; any excavation, land disturbance; and use or extension of the use of land.
"Development review committee"means a staff review board consisting of one representative each from community development, public works and city engineering. Members shall be appointed by the city manager. The community development director or designee shall chair the development review committee meetings.
"Dog kennel"means any lot, building, structure, enclosure or premises whereupon or wherein four or more dogs are kept or maintained regardless of whether for commercial, noncommercial or veterinary purposes, including places where dogs are boarded, kept for sale or kept for hire.
"Dormitory"means a building operated by an educational institution which provides group living accommodations for students.
"Drive-in, drive-through or walk-up restaurant"means any place of business for the sale of prepared foods where any one of the following conditions is found to exist:
1. No provision is made for permanent seating;
2. Permanent seating either inside or outside is clearly incidental to the principal activity of dispensing take-out orders;
3. The patrons thereof need not alight from a motor vehicle for service or the patrons alight temporarily for service at a window or counter either inside or outside the building.
"Driveway"means a permanently paved concrete, brick, or other similar approved material providing direct access for vehicles between a street or alley and an approved garage, carport, or off-street parking or loading area. In some instances, driveways are considered to be fire apparatus access roads. Where required, fire apparatus access roads shall be provided and maintained in accordance with current city standards.
"Dwelling"means a building or portion thereof designed and used exclusively for residential occupancy, including one-family, two-family and multiple dwellings, but not including hotels, boardinghouses or lodginghouses.
Dwelling, Accessory Unit."Accessory dwelling unit" or "accessory unit" means an attached or detached residential dwelling unit which provides complete independent living facilities for one or more persons. It shall include permanent provisions for living, sleeping, eating, cooking, and sanitation facilities on the same parcel of land as the single-family dwelling. Accessory dwelling units includes efficiency units as defined in Health and Safety Code Section
17958.1 and manufactured homes as defined in Health and Safety Code Section
18007. The accessory dwelling unit shall be subordinate to a primary single-family dwelling unit on the same lot.
Dwelling, Multiple."Multiple dwelling" means a building or portion thereof, designed for or occupied by three or more families living independently of each other.
Dwelling, Single-Family."Single-family dwelling" means a detached building designed for or occupied exclusively by one family, including guests and servants employed on the premises, and having but one kitchen.
Dwelling, Two-Family."Two-family dwelling" means a building under one roof designed for or occupied exclusively by two families living independently of each other.
"Dwelling unit"means one or more rooms in a habitable dwelling designed for occupancy by one family for living or sleeping purposes and having one kitchen.
"Easement"means the right to use property owned by another for specific purposes or to gain access to another property, or other nonpossessory right, interest, or privilege that one party has in another's land.
"Elevation drawing"means a scaled and dimensioned drawing illustrating the exterior physical character of each side of a structure, sign, design feature or landscape element. (Exhibit 18.08.015 D)
"Emergency shelter"means housing with minimal supportive services for homeless persons that is limited to occupancy of six months or less by a homeless person. No individual or household may be denied emergency shelter because of an inability to pay (per Health and Safety Code Section
50801).
"Employee housing, single-family"means housing for six or fewer employees in a single-family dwelling in accordance with Health and Safety Code Section
17021.5(b). Employee housing shall be deemed a single-family use and shall be treated the same as any single-family dwelling in districts where single-family dwellings are allowed. Employee housing meeting this definition is subject to all municipal codes, regulations and other standards generally applicable to other residential dwellings of the same type in the same zone.
"Enhance"means to improve existing conditions by increasing the quantity or quality of beneficial uses.
"Façade"means the exterior wall of a structure as seen from outside the structure.
"Family"means an individual or two or more persons living together in a dwelling unit where the residents may share living expenses, chores, eat meals together, have close social, economic, and psychological commitments to each other, and who have common access to and common use of living, eating, and kitchen areas; common access to private bedrooms is not required. "Family" does not include institutional group living situations such as a dormitory, sorority, fraternity, club or group of persons occupying a hotel, lodging house, institution, or other commercial group living arrangements.
"Family day care home"means a home which provides day care to children, including children under the age of ten who reside at the home, as defined in regulations issued by the state of California. A large family day care home provides care to seven to fourteen children; a small family day care home provides care to six or fewer children.
"Feline kennel"means a lot, building, structure, enclosure or premises whereupon or wherein four or more cats are kept for commercial, noncommercial or veterinarian purposes including places where cats are boarded, kept for sale or kept for hire.
"Fence"means a barrier of any material but usually made of wood, metal, or masonry, constructed to enclose, to provide a boundary, or to screen areas of land.
"Freeway"means a toll-free, controlled access, divided, multi-lane main highway in respect to which the owners of abutting lands have no right to easement or access to or from their abutting lands and which is declared to be such in compliance with the
Streets and Highways Code of the state.
"Frontage"means the front side of a lot where it abuts a street. The front side is the narrower side of a rectangular lot. (Exhibit 18.08.015 C)
"Fuel modification zone"means a geographic area around a development or structure in which highly flammable plant material is reduced and/or replaced for the purpose of lowering fuel load and consequently lowering fire potential.
Garage, Private."Private garage" means a completely enclosed accessory building or a completely enclosed accessory portion of a building designed or used for shelter or storage of vehicles.
Garage, Public."Public garage" means a building other than a private garage used for the storage, care, repair or equipping of automobiles, or where such vehicles are kept for remuneration, hire or sale.
"Gazebo"means a free standing, roofed garden structure open (sixty-five percent or more) on all sides and often designed to command a view.
"Grade"means the average level of the finished ground surface surrounding a building, measured at the center of all walls of the building.
Grade, Rough."Rough grade" means the elevation of the ground surface established by grading that approximates the final elevation shown on the approved design, excluding architectural and landscape mounding.
"Group home"means a state-authorized, certified or licensed family care home, foster home, or group home serving six or fewer mentally disordered or otherwise handicapped persons or dependent and neglected children, providing care on a twenty-four-hour-a-day basis. A group home does not include a dwelling where an individual who personally owns or rents the dwelling accepts not more than four foster children into his or her own home as part of his or her family.
"Guesthouse"means sleeping quarters within an accessory building located on the same premises with the main building, for use by non-paying guests of the occupants of the premises, having no kitchen or otherwise used as a separate dwelling.
"Hazardous substance"means any solid, liquid, or gaseous material that, by reason of its toxic, caustic, corrosive, abrasive or otherwise injurious properties, may be detrimental to the health of persons or animals coming into contact with it.
"Home for the aged"means a building where lodging and meals, and dietary or other personal services are rendered to one or more invalids or aged persons for compensation, but excluding surgery or primary treatments such as are customarily provided in sanitariums and hospitals.
"Historic, historical, cultural, or archeological resource"means a site, building, place, district, landscape, urban design feature, object or artifact that is or may be significant to the community because it meets one of several criteria established by the city council. These criteria include characteristics such as architectural interest and integrity, age, association with persons considered significant, cultural impact, contribution to a historic neighborhood, and similar attributes.
"Homeowners association"means a private, non-profit association or corporation of property owners and/or residents for the purpose of operating and maintaining various common properties and enforcing conditions, covenants, and restrictions.
"Hospital"means an institution providing in-patient and out-patient medical or surgical services for the diagnosis, care and treatment of human illness.
"Hotel"means a building designed for or occupied as the temporary abiding place of individuals who are lodged with or without meals, in which there are six or more guestrooms or suites of rooms. Jails, hospitals, asylums, sanitariums, or orphanages, prisons, detention homes, or similar buildings where human beings are housed and detained under legal restraint are specifically not included.
"Housing for older persons"means grouped dwelling units occupied by persons sixty-two years of age or older and having significant facilities and services specifically designed to meet the physical or social needs of older persons.
"Incidental"means associated with a use, activity or thing and of minor consequence or importance; a minor accompanying item.
"In-lieu fees"means cash payments that serve as a substitute for and that help mitigate lack of off-street required parking spaces or other requirements that an owner or developer cannot otherwise provide, calculated in dollars per space or similar appropriate measure.
"Kitchen"means any room used or intended or designed to be used for cooking or the preparation, refrigeration, and storage of food, and containing a kitchen sink and stove or microwave. (Exhibit 18.08.015 E)
"Loading space"means an off-street space or berth on the same lot with a building, or contiguous to a group of buildings, for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials, and which abuts upon a street, alley or other appropriate means of access.
"Lodginghouse" or "roominghouse"means a building with not more than five guestrooms where, for compensation, lodging is provided for three but not more than ten persons.
"Loft"means a space commonly found above the main floor in cabins and barns, but also found in conventional residences, usually open to the room below and used for sleeping or storage.
"Lot"means"
1. A parcel of land with a separate and distinct number or other designation shown on a plat or record of survey, recorded in the office of the county recorder of Los Angeles County; or
2. A parcel of real property delineated on an approved record of survey, lot split or subparceling map as filed in the office of the city clerk; or
3. A parcel of real property shown on the records of the county assessor as held under separate ownership from adjacent property prior to the effective date of the ordinance codified in this title.
"Lot area"means the total horizontal area within the lot lines of a lot.
"Lot coverage," "building coverage"means that portion of a lot that is covered by buildings and roofed structures, including building footprint, arcades, roof or balcony overhangs exceeding thirty inches, covered patios and porches, carports and accessory structures. (Exhibit 18.08.015 F)
Lot, corner."Corner lot" means a lot situated at the intersection of two or more streets. (Exhibit 18.08.015 G)
"Lot depth"means the horizontal distance between the front and rear lot lines, measured in the mean direction of the side lot lines. (Exhibit 18.08.015 C)
Lot, Flag."Flag lot" means a lot having access to a street by means of a narrow corridor. (Exhibit 18.08.015 G)
Lot, Interior."Interior lot" means a lot other than a corner lot. (Exhibit 18.08.015 G)
Lot, Key."Key lot" means the first lot to the rear of a reversed corner lot and not separated by an alley. (Exhibit 18.08.015 G)
Lot Line, Front."Front lot line" means, in the case of an interior lot, a line separating the lot from the street, and in the case of a corner lot, a line separating the narrowest street frontage of the lot from the street, except in those cases where the latest tract deed restrictions specify another line as the front lot line. (Exhibit 18.08.015 H)
Lot Line, Rear."Rear lot line" means a lot line which is opposite and most distant from the front lot line and, in the case of an irregular triangular or gore-shaped lot, a line within the lot, parallel to and at a maximum distance from the front lot line, having a length of not less than ten feet. (Exhibit 18.08.015 H)
Lot Line, Side."Side lot line" means any lot boundary line not a front lot line nor a rear lot line. (Exhibit 18.08.015 H)
Lot, Reversed Corner."Reversed corner lot" means a corner lot, the side street line of which is substantially a continuation of the front line of the lot upon which it rears. (Exhibit 18.08.015 G)
Lot, Through."Through lot" means a lot having frontage on two parallel or approximately parallel streets. (Exhibit 18.08.015 G)
"Lot width"means the horizontal distance between the side lot lines, measured at right angles to the lot depth at a point midway between the front and rear lot lines. (Exhibit 18.08.015 C)
"Low barrier navigation center"means a Housing First, low barrier, service-enriched shelter focused on moving people into permanent housing that provides temporary living facilities while case managers connect individuals experiencing homelessness to income, public benefits, health services, shelter, and housing. "Low barrier" means best practices to reduce barriers to entry, and may include, but is not limited to, the following:
1. The presence of partners if it is not a population-specific site, such as for survivors of domestic violence or sexual assault, women, or youth.
3. The storage of possessions.
4. Privacy, such as partitions around beds in a dormitory setting or in larger rooms containing more than two beds, or private room.
"Main building," "primary building"means a building within which is conducted the principal use permitted on the lot as provided by this title, and which is larger and taller than other buildings on a lot. (Exhibit 18.08.015 C)
"Manufactured house"means a single-family, detached, permanently sited, factory-built house that meets the standards of the federal Manufactured Home Construction and Safety Standards and lacks a permanent device allowing transport of the unit other than for initial delivery.
"Mezzanine"means a low-ceilinged story between two main stories of a building.
"Mixed use"means a development in which two or more different uses such as office, commercial, institutional, or residential are combined in a single building or on a single site in a compact, integrated project with significant functional interrelationships and a coherent physical design.
"Mobile home"means a transportable, prefabricated dwelling constructed with a permanent chassis and without a foundation, intended to be affixed to a foundation and connected to utilities, designed for year-round use and for subsequent relocation.
"Motel"means any building or buildings containing guestrooms or apartments, or combinations thereof, each of which has a separate, individual entrance leading directly from the outside of the building and is designed, used or intended wholly or in part for the accommodation of automobile transients.
"Nonconforming building"means a building, structure or portion thereof lawfully existing at the time the ordinance codified in this title or an amendment thereof became effective and which does not conform to current building and/or zoning standards of the zone in which it is located.
"Nonconforming use"means a lawful use of a building, structure or land that does not comply with the current use regulations for its zoning district but which complied with applicable regulations at the time the use was established.
"Office for sale of tract houses"means temporary sales office located within a numbered and recorded tract used for the purpose of selling houses built within the numbered and recorded tract.
"Office use"means a land use in which business is transacted or a service provided, with an emphasis on professional services, record keeping, clerical and administrative activities.
"Off-site sale," "off-sale"means the sale of packaged alcoholic beverages, including beer, wine and distilled spirits, for consumption off the premises where sold.
"On-site sale," "on-sale"means the sale of alcoholic beverages, including beer, wine and distilled spirits for consumption on the premises where sold.
"Open space"means open land, essentially without structural improvements, used for environmental protection, the preservation of natural resources, scenic amenity, or outdoor recreation, and not including paved areas, driveways, or rights-of-way.
Open Space, Common."Common open space" means an outdoor area within a residential development which is not in individually-owned lots or dedicated for public use, and which is designed and intended for recreational or leisure purposes and for enjoyment by the occupants of the development. It does not include private streets, driveways, private yards and patios, parkways, parking spaces, maintenance yards and similar functional areas.
Open Space, Usable."Usable open space" means an outdoor area designed and accessible for outdoor living, recreation, and landscaping, having an average overall finished grade not exceeding ten percent, a maximum grade of fifteen percent, and a minimum width of ten feet.
"Orientation"means the direction in which a dwelling unit opens to the outside for the purpose of providing views or access to outside areas, such as recreation areas, gardens and/or patios.
"Outdoor advertising display"means any display or device of any kind or character placed for outdoor advertising purposes, on the ground or on any tree, wall, rock, fence, building, window, structure or thing.
"Outdoor advertising structure"means a structure of any kind or character erected or maintained for outdoor advertising purposes upon which any outdoor advertising display may be placed.
"Outdoor living space"means the functional area outside the dwelling unit that provides for outdoor activities which may be either active or passive.
"Outdoor storage"means any goods, discarded items, miscellaneous material, merchandise or vehicles kept in an unroofed and/or unscreened place for more than twenty-four hours.
"Overlay district"means a zoning district which is applied in combination with an underlying base zoning district which modifies the underlying district.
"Overhang"means one of the following:
1. The part of a roof or wall which extends beyond the facade of a lower wall; or
2. The portion of a parked vehicle extending beyond the wheel stops or curb. (Exhibit 18.08.015 I)
"Parapet"means the extension of the main walls of a building above the roof level, often to screen roof-mounted equipment, or for fire protection. (Exhibit 18.08.015 J)
Parking Area, Public."Public parking area" means an area or place other than a street or alley containing parking spaces designed and used for the temporary parking of automobiles and available for public use whether free, for compensation or an accommodation for clients or customers.
Parking Space, Automobile."Automobile parking space" means a space within a building or public parking area designed for the temporary parking or storage of one automobile, exclusive of streets, alleys, driveways, aisles and the area of ingress or egress.
"Patio," "patio cover"means a permanently roofed structure with at least three open sides, as defined in Section 4901 of the Uniform Building Code, which is attached to the main residential structure. A patio is designed for use as a sheltered outdoor living space. A patio is within the scope of this definition though it may be enclosed by screens.
"Person"means one or more individuals, legal representatives, trustees, all domestic and foreign corporations, associations, syndicates, joint stock corporations, partnerships of every kind, clubs, business or common law trusts, and societies.
"Porch"means a covered entrance attached to or incorporated into the front facade of a building, usually a house.
"Planned residential development"means an arrangement of residential dwelling units and other elements based on a comprehensive design which treats the entire as a single project and which arrangement meets the lot area per dwelling unit requirement of the district in which proposed.
"Precise plan"means development plan required for preliminary approval prior to working or construction drawings and prior to issuance of building or applicable public works permits. Precise plans normally consist of site plan, elevations, floor plans, grading plans, conceptual landscaping, colors, materials and other specifications necessary for city consideration of the development proposal.
"Restaurant"means an establishment which is engaged primarily in the business of preparing and serving meals for consumption on the premises, including cafes, tea rooms, and outdoor cafes.
"Resthome"means a building where lodging and meals, nursing and dietary or other personal services are rendered to one or more convalescents, invalid, or aged persons for compensation, whether confined to the premises or not, but excluding surgery or primary treatments such as are customarily provided in sanitariums and hospitals.
"Sanitarium"means a health station or retreat or other place where patients, other than mental or alcoholic patients are kept and where medical or surgical treatment is given.
"Seating capacity"means the capacity of an area to contain seated persons based on the number of seats permitted by the most recently city-adopted Los Angeles County Building Code as interpreted by the city building inspector, or one seat per eighteen inches of bench or pew length.
School, Elementary."Elementary school" means institutions of learning which offer instruction to grades K—12 in the several branches of learning and study required to be taught in the public schools by the
Education Code of the state of California.
"Seating capacity"means the capacity of an area to contain seated persons based on the number of seats permitted by the most recently city-adopted Los Angeles County Building Code as interpreted by the city building inspector, or one seat per eighteen inches of bench or pew length.
"Second-story second unit"means a two-story second unit, a second unit built on a second floor, or a single-story second unit higher than fifteen feet from ground level.
"Setback"means the minimum horizontal distance required by code between the line of an improvement such as a building, sign, or parking lot, and the related front, side, or rear property line. (Exhibit 18.08.015 H)
"Sign"means any advertising display or advertising structure, or both, or any directional marker placed on, suspended from, or attached to any structure, vehicle, or feature of the natural or built environment.
"Single-room occupancy units (SRO)"means housing consisting of single-room dwelling units typically with no more than four hundred square feet of habitable space that is the primary residence of its occupant or occupants. The unit must contain either food preparation or sanitary facilities (and may contain both). An accessory structure (i.e. garage) does not qualify as an SRO. Also known as "efficiency units."
"Site plan"means a plan, prepared to scale and dimensioned, showing all of the uses proposed for a specific property. The site plan shows all buildings, structures, signs, off-street parking, loading spaces, points of ingress and egress, walls, fences, landscaping, and any additional information that may be necessary to clearly define the intended use of the property.
"Slope"means land gradient described as the vertical rise divided by the horizontal run, and expressed in percent or as a ratio. Slope can also be expressed as the number of degrees between the horizontal plane (x-axis) and the vertical plane (y-axis). (Exhibit 18.08.015 K)
"Solar collector"means a device whose energy comes from the sun, and whose primary purpose is to provide for the collection, storage, and distribution of solar energy for space heating or cooling, for water heating, or for electricity.
"Story"means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above, except that the topmost story shall be that portion of a building included between the upper surface of the topmost floor and the ceiling or roof above. "Story" includes a basement but not a cellar.
"Street"means a public or private thoroughfare other than an alley, intended for passage or travel, excluding bike paths and pedestrian walkways, which affords the principal means of access to abutting property.
Street, Private."Private street" means land not dedicated as a public street or alley over which a private easement for road purposes has been recorded, and which is used or intended to provide access to abutting property.
Street, Side."Side street" means that street bounding a corner lot and which extends in the same general direction as the line determining the depth of the lot.
"Structure"means that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner.
"Subdivision"means the division of a tract of land into defined lots, either improved or unimproved, which can be separately conveyed by sale or lease, and which can be altered or developed. It includes condominium projects and community apartment projects.
"Substandard housing"means residential dwellings that, because of their physical condition, do not provide safe and sanitary housing.
"Substantial"means considerable in importance, value, degree, or amount.
"Supportive housing"is considered a residential use only subject to those restrictions that apply to other residential uses of the same type in the same zone and means housing with no limits on length of stay, that is occupied by the target population, and that is linked to on-site or off-site services that assist the supportive housing resident in retaining the housing, improving his or her health status, and maximizing his or her ability to live and, and when possible, work in the community (per Health and Safety Code Section
50675.14(b)).
"Target population"means adults with low-income having one or more disabilities, including mental illness, HIV or AIDS, substance abuse, or other chronic health conditions, or individuals eligible for services provided under the Lanterman Developmental Disabilities Services Act (Division 4.5 (commencing with Section
4500) of the Welfare and Institutions Code) and may, among other populations, include families with children, elderly persons, young adults aging out of the foster care system, individuals exiting from institutional settings, veterans, or homeless people (per Health and Safety Code Section
50675.14(b)(3)).
"Temporary use"means a use established for a fixed, limited period of time with the intention to discontinue upon the expiration of the time period.
"Townhouse"means a dwelling unit with one or two walls in common with other units, and which has direct exterior access, a private yard, and no floors or ceilings in common with other units.
"Transitional housing" and "transitional housing development"is considered a residential use only subject to those restrictions that apply to other residential uses of the same type in the same zone and means temporary rental housing intended for occupancy by target populations transitioning to permanent housing that is operated under program requirements calling for the termination of assistance and recirculation of the assisted unit to anther eligible program recipient at some predetermined future point in time, which shall be no less than six months (per Health and Safety Code Section
50675.2(h)).
"Trip"means a one-way journey that proceeds from an origin to a destination via a single mode of transportation.
"Unlicensed group home"means housing shared by unrelated persons with disabilities who provide peer and other support for the residents' disability-related needs; supportive services that do not require state licensure may be provided. An unlicensed group home operating as a "family" in accordance with the definition set forth in this section is considered a residential use and shall not require any approvals other than what is required for other residential uses in the same zone.
"Use"means the purpose for which land or building is arranged, designed or intended, or for which land or building may be occupied or maintained.
"Variance"means a departure from requirements of the zoning ordinance (excluding use), but not a special privilege granted by the planning commission, intended to alleviate hardship caused by unusual or unique circumstances on individual parcels of property and to allow a property parity with like properties.
"Veranda"means an open gallery alongside a house, often with its own roof and sometimes screened.
Walkway, Pedestrian."Pedestrian walkway" means a space through which an element of a pedestrian circulation system passes, such as sidewalks or paths. The walkway includes the sidewalk, path, and the adjacent landscaped area. The space may be defined by the walls of buildings, fences, plant materials or any combination of these features.
"Wall"means a masonry fence; also, one of the sides of a structure connecting a floor or foundation to a ceiling or roof. A masonry fence is generally made of stone, brick, cement block or concrete, rock, and similar materials.
Wall, Retaining."Retaining wall" means a wall that is designed to resist the lateral displacement of soil or other materials.
"Yard"means an open space other than a court on a lot unoccupied and unobstructed from the ground upward, except as otherwise provided in this title.
Yard, Front."Front yard" means a yard extending across the full width of the lot situated between the front building line and the front lot line. The depth of a required front yard shall be a specified horizontal distance between the front lot line, and a line parallel thereto on the lot. Also, see "setback."
Yard, Rear."Rear yard" means a yard contiguous to the rear lot line of a lot, which, on an interior lot, extends from side lot line to side lot line. On a corner lot, the rear yard extends from the interior side lot line to the side yard on the street side. The depth of a required rear yard is a specified horizontal distance between the rear lot line and a line parallel thereto on the lot.
Yard, Side."Side yard" means a yard contiguous to a side lot line of a lot and when contiguous to an interior side lot line extends from the required front lot line where no front yard is required, to the required rear yard, or rear lot line where no rear yard is required. On a corner lot, the side yard on the street side extends from the front yard, or front lot line where no front yard is required, to the rear lot line. The width of a required side yard is a specified horizontal distance between the side lot line, or ultimate street line if contiguous to a street that is planned thereto on the lot. When two or more contiguous lots are used for the erection of a single building or combination of buildings to be used by one owner for A-1 or single-family residential uses as provided in this title, then the side yards shall not be measured from the interior boundary lines by which the several lots are contiguous.
"Zero lot line"means the location of a building on a lot such that one or more of the building's sides lies on the property line.
"Zoning"means the division of a city by legislative regulations into areas, or zones, that specify allowable uses for real property and size restrictions for buildings within these areas, and that implements policies of the general plan.
