B.

The city's regulation of hours shall not conflict with regulation by the Alcoholic Beverage Control Board.

§ 18.100.060 Nonconforming uses.

A.
Any late-night business within three hundred feet of a residential zone, residential use, church or school in existence and lawfully operating before December 30, 1984, is a legal nonconforming use. The planning commission may at any time require that a particular legal nonconforming late-night business obtain a conditional use permit if it determines that such business is being operated in such a manner that it creates a nuisance to surrounding uses. The planning commission may also require a conditional use permit for any late-night business located further than three hundred feet from the business's exterior property line from the closest residential school or church property line, if it determines that such business is being operated in such a manner that it creates a nuisance to surrounding uses.
B.
