CHAPTER 17

14 - FACTORY BUILT HOUSING

17.14.010 - Factory built structures defined.

(a)

Manufactured home. A mobile type of single family residence regulated by the United States Department of Housing and Urban Development in compliance with Federal Manufactured Home Construction and Safety Standards and defined as "a structure transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width or 40 body feet or more in length, and when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air condition, and electrical systems contained therein.

(b)

Modular home. A single family manufactured housing unit regulated by the Illinois Department of Public Health under the authority of the Illinois Manufactured Housing and Mobile Home Safety Act and defined as a building, assembly or system of building sub-assemblies, designed for habitation as a dwelling for one or more persons, including the necessary electrical, plumbing, heating, ventilating and other service systems, which is of closed or open construction and which is made or assembled by a manufacturer, on or off the building site, for installation, or assembly and installation on the building site with a permanent foundation.

(c)

Permanent foundation. A permanent foundation means a closed perimeter formation consisting of materials such as concrete or concrete block which extends into the ground below the frost line.

(d)

Trailer or trailer home. A trailer or trailer home is any structure transportable in one or more sections and which is built on a permanent chassis and designed to be used as a permanent or temporary dwelling which does not otherwise come within the definition of manufactured home in this section.

(e)

Terminology. The terms "mobile home" or "mobile home park" utilized within this Code are hereby amended to read "manufactured home" or "manufactured home park."

17.14.020 - Modular homes permitted.

Modular homes are permitted in the Village of Lyndon providing that any such home is in compliance with the Illinois Manufactured Housing and Mobile Home Safety Act and rules promulgated by the Illinois Department of Public Health and further provided that said modular home is placed on a permanent perimeter foundation extending below the frost line and is otherwise in compliance with all zoning ordinances of the Village of Lyndon.

17.14.030 - Manufactured homes prohibited—Exceptions.

Except under the following conditions, manufactured homes are prohibited within the Village of Lyndon. The exceptions to this prohibition are:

(1)

A manufactured (previously mobile) home legally located in the village prior to the effective date of this ordinance pursuant to a variance or nonconforming use.

(2)

A manufactured (previously mobile) home located wholly in a manufactured home park approved by the village board.

(3)

A manufactured home which meets all of the following requirements:

a.

Has been inspected in accordance with the requirements of the department of housing and urban development and is constructed in conformance with the Federal Manufactured Home Construction and Safety Standards in effect on the date of the home's manufacture.

b.

Is installed in compliance with the Illinois Manufactured Quality Assurance Act and the Manufactured Home Installation Code.

c.

Has a minimum living area of 1,000 square feet.

d.

Is in compliance with all village zoning and setback ordinances.

e.

Is affixed to a permanent foundation as herein defined at section 17.14.010(c) above, and has had its axles and wheel tongue removed.

f.

Was constructed after June 15, 1976 and is accordingly in compliance with the National Manufactured Home Construction and Safety Standards.

g.

When installed on its foundation is not less than 24 feet in length or 24 feet in width, subject however to the square footage requirement at subsection (3)c. above.

h.

Is covered by a full roof of 3/12 or greater pitch.

i.

Is taxed or is agreed by the owner to be taxed as real estate.

17.14.040 - Placement and installation.

No modular home nor manufactured home shall be placed upon its foundation until the foundation and proposed installation have been approved by the Lyndon Village Board or its authorized officer.

Note— Any existing provisions of the Lyndon Municipal Code inconsistent or conflicting herewith are repealed to the extent necessary to effect the provisions of this ordinance and this ordinance shall take precedence over any such inconsistent or conflicting provision.
