20 - PERMITS AND CERTIFICATES
(a)
Building permit. No person, firm or legal entity shall construct any new building, structurally alter any existing building, erect any porch, deck, storage facility, fence or other auxiliary structure, whether or not requiring a permanent excavation or foundation, without first obtaining a building permit therefor. At the time of application for said permit, the applicant shall pay to the Village of Lyndon a nonrefundable fee of $25.00—$100.00. No construction or site preparation of any kind shall be commenced absent prior board approval of such permit.
(b)
License required.
(1)
No person, firm or corporation shall establish, maintain, conduct or operate a mobile home park without first obtaining a license therefor from the village. Such license shall expire on ___________ of each year, and the license shall be renewed from year to year upon payment of the annual license fee.
(2)
No person, firm or corporation shall construct a mobile home park without first obtaining a permit to do so.
(3)
Mobile home park means an area of land upon which two or more occupied mobile homes are harbored either free of charge of for revenue purposes, and includes any building, structure and vehicle, or enclosure used or intended for use as a part of the equipment of such mobile home park.

All applications for building permits shall be accompanied by a plat, in duplicate, showing the lot plan, the location of the building on the lot, the actual dimensions of both the lot and the building, and such other information as may be necessary to provide for the enforcement of these regulations. A careful record of the original copy of all such applications and plats shall be kept in the office of the village clerk.

A certificate of occupancy for a new building or the structural alteration of an existing building shall be applied for coincident with the application for a building permit, and such certificate shall be issued within five days after request for the same shall have been made in writing to the village board after the erection or alteration of such building or part thereof shall have been completed in conformity with the provisions of these regulations.

A certificate of occupancy for the change in character of the use of an existing building shall be applied for before any such building shall be occupied or the use thereof changed, and a certificate of occupancy shall be issued within five days after the application has been made, provided such use is in conformity with the provisions of this title.

A certificate of occupancy for a change in the character of the use of land shall be applied for before any such land shall be occupied or used, and the certificate of occupancy shall be issued within five days after the application has been made, provided such use is in conformity with the provisions of this title.

The application for a certificate of occupancy shall state facts showing that the building or proposed use of a building or land complies with all the building and health laws and ordinances and with the provisions of these regulations. The certificate of occupancy shall state these facts. A record of all applications and certificates shall be kept on file in the village clerk's office, and copies shall be furnished on request to any person having a proprietary or tenancy interest in the property. A fee of $1.00 shall be charged for each certificate or copy.

Any person, firm or legal entity who commences any construction or structural alteration set forth in section 17.20.010(a) above without first acquiring the proper building permit required by this section shall be subject to a fine of $100.00 for each day that a violation exists, and shall, upon written notice from the village, immediately cease all construction or alteration until the permit required by this section has been obtained.

At any time after issuance of a building permit, the village shall have the right to inspect the construction or alteration ("project") to verify that the project is as set forth in the building permit application. Any person, firm or legal entity shall, upon written notice from the village that a project is not in compliance with the terms and conditions of the permit, immediately cease all construction or alteration until compliance is achieved.

No building permit shall be issued nor construction started of any building designed, intended or to be modified for human occupancy without the owner first providing to the village board the following:
(1)
An external layout plan clearly locating the building on the building site.
(2)
An internal blueprint of the building or a comparable formal interior floor plan.
(3)
A sample or manufacturer's photograph and specifications of the siding and roofing materials to be applied on the building.
(4)
A staked layout of the building foundation.
(5)
Full village board approval of the permit, including approval of the siding and roofing material.
No building designed, intended or modified for human occupancy shall be constructed, nor shall a building permit be issued therefor, unless said building or new addition to an existing building is constructed upon a full permanent foundation, the footings of which shall be not less four feet below the lowest ground elevation of the building perimeter. Prior to and subsequent to pouring any such foundation, but before further construction, the foundation shall be inspected by a duly authorized village representative.
(a)
Except for those buildings permitted pursuant to subsections (b) and (c) of this section 17.20.110, no post-frame construction building shall be permitted in a residential zoning district of the Village of Lyndon.
(b)
A post-frame construction building shall be permitted in a residential zoning district of the Village of Lyndon where the original manufacturer's materials and specification confirm that the building is specifically designed for residential purposes and the site and building plans are otherwise in compliance with all village ordinances, including, without limitation, those requiring a minimum square footage and a permanent foundation.
(c)
A post-frame construction building not originally designed by the manufacturer for human occupancy may be permitted in a residential zoning district of the Village of Lyndon provided that the owner of the building first applies to the village zoning board of appeals for a variance and further provided that:
(1)
The owner files with his application for variance internal blueprints and construction plans confirming that the internal residential living space of the post-frame construction building exceeds the greater of 900 square feet or 75 percent of the entire internal square footage of the building.
(2)
The owner timely completes construction of the building, including the internal living space, within 12 months of the date of his/her application.
(3)
The building has not more than two overhead garage doors, each not more than eight feet in height.
(4)
The building itself does not exceed 16 feet in height.
(5)
The siding and roofing of the building are of a material designated in the manufacturer's original specifications or are otherwise approved by the village board prior to application.
(6)
The building does not exceed an entire external square footage of 1,600 square feet.
(7)
The building complies with all internal and external building and code requirements of the Village of Lyndon.
Any change from plans presented to or approved by the board of the Village of Lyndon shall be approved prior to starting construction of the project or, if the changes occur during construction, said changes shall be approved prior to any further work on the project.
The above additional sections of chapter 17.20 shall control and supersede any prior or conflicting sections of the Lyndon Village Code.
