CHAPTER 1171

U-4 Local Retail and Wholesale Districts

1171.01 PERMITTED USES.

   The following uses are permitted in a U-4 District:
   (a)   Banks, general offices, medical practitioners' offices, studios and telephone exchanges;
   (b)   Retail stores or shops for custom work or the making of articles to be sold only at retail on the premises;
   (c)   Restaurants, theaters and moving picture shows;
   (d)   Electrical substations;
   (e)   Job printing and newspaper printing;
   (f)   Wholesale sales offices or sample rooms;
   (g)   Central milk distribution stations, not including bottling or processing facilities;
   (h)   Service centers providing coin-operated machines for consumer use;
   (i)   Gasoline service stations, if they comply with the regulations set forth in Section 1171.08;
   (j)   Car washes, if they comply with the regulations set forth in Section 1171.09;
   (k)   Funeral homes if they comply with the regulations set forth in Section 1171.10;
   (l)   Motels and commercial hotels; and
   (m)   Automobile service facilities, if they comply with the regulations set forth in Section 1171.11.

1171.02 PROHIBITED AND ACCESSORY USES.

   (a)   In a U-4 District, no building or premises shall be used, and no building shall be erected which is arranged, intended or designed to be used, for other than a U-4 use.
   (b)   An accessory use customarily incidental to a Class U-4 use shall also be permitted in a U-4 District, provided that such accessory use is located upon the same lot with the building or use to which it is accessory.

1171.03 BUILDING LINES.

   In a U-4 District, where a building line is required along both the front and side lines of a corner lot, and the building thereon, as constructed, faces the front of the lot, the building line along such side line for the entire depth of the sublot shall be located ten feet back from the street line in all cases, except where a greater distance is prescribed on the Zone Map or as prescribed in Section 1195.04.

1171.04 BUILDINGS IN SIDE AND REAR YARDS; BUFFERS.

   In a U-4 District, where the side line of a lot adjoins a U-1, U-2, U-2-A, U-3, U-3-A, U-3-B or U-3-C District, no building, unless located fifty feet or more back from the street, shall be erected within twenty-five feet of such adjoining District.
   In a U-4 District, where the rear line of the lot adjoins a U-1, U-2, U-2-A, U-3, U-3-A, U-3-B or U-3-C District, every building erected shall have a rear yard. The least dimension of the yard shall be at least twenty percent of the depth of the lot or twenty-five feet, whichever is greater, but the least dimension need not be more than forty feet. However, the least dimension shall not be less than one-half of the height of the building. Forty percent of the area of the rear yard may be occupied by a one-story accessory building, but on a corner lot, no such accessory building, if detached from the main building, shall be erected within twenty-five feet of the street line and no such accessory building shall be erected within twenty-five feet of the rear lot line.
   In rear and side yards of a U-4 District adjoining any district other than a U-4 or U-4-A District the City Planning Commission shall require the installation of a six-foot high vision-impairing masonry wall of face brick or split face brick in order to create a buffer area where such other district adjoins or abuts a rear or side yard of this District.

1171.05 LOT WIDTH.

   No structure shall be erected upon a lot having an average width of less than 100 feet for a distance of 100 feet from the street line in a U-4 District.

1171.06 NONCOMBUSTIBLE EXTERIORS REQUIRED.

   In a U-4 District, all new buildings or additions, hereafter erected or permitted to be erected under this Zoning Code, shall have outer walls constructed of noncombustible material.
   The outer faces of outer walls of buildings in this District shall be constructed with a minimum four-inch face brick, stone, cast stone, precast concrete panel or architectural cast-in-place concrete of finish, glass, metal or other architectural panel approved by the Architectural Board of Review. Exposed masonry block and through-wall block construction is prohibited.
   The use of solid concrete veneer unit (split face brick) for alterations of existing buildings with suitable masonry walls may be permitted upon the approval of the Architectural Board of Review.
   No brick, cast stone or concrete veneer unit (split face brick) shall be larger than four inches in height.
   Exception. Temporary structures as permitted in Chapter 1370.

1171.07 LOTS OR STRUCTURES FOR DWELLING AND BUSINESS USES.

   The erection of any dwelling unit is prohibited on a lot in a U-4 District when such lot is presently occupied by any building or other structure intended or designed wholly or partly for a business use. The erection of any building or other structure intended for a business use is prohibited on a lot in any district in the City when such a lot has already erected upon it a building or structure containing a dwelling unit. The erection of a structure for both dwelling and business uses is expressly prohibited in a U-4 District. However, nothing in this section shall be construed to be in derogation of Section 1159.12.

1171.08 GASOLINE SERVICE STATIONS.

   All gasoline service stations shall comply with the following supplemental regulations, which shall be in addition to all other regulations of this Zoning Code. In the event there is a conflict between these supplemental regulations and other portions of this Zoning Code, the regulations in this section shall govern.
   (a)   Lot and Use Requirements.
      (1)   Each gasoline service station shall be located on a corner lot having not less than 200 feet of frontage on each of the two intersecting streets and a total site area of not less than 40,000 square feet.
      (2)   A gasoline service station may be combined with other permitted uses in the U-4 district, provided that gasoline service stations may not be combined with any drive-through or drive-up facility (except a drive-through accessory car wash) or a sit-down restaurant. For purposes of this section, a sit-down restaurant is any portion of a facility which provides tables and chairs or counter space for the customer to consume food on the premises, whether the food is purchased at a counter or ordered and served at a table.
         All uses on a single zoning lot shall satisfy the requirements applicable to all uses.
      (3)   A site plan shall be prepared for any combined use. In addition to all other applicable standards and criteria, the Planning Commission, in its review of the site plan, shall determine if the parking spaces are conveniently located in relation to the intended uses, and that the circulation on the site minimizes potential conflicts between pedestrians and vehicles.
    (b)   Building Regulations. All buildings shall be considered principal buildings and shall be located in compliance with the following setback regulations;
      (1)   Buildings shall be located the minimum distance from Mayfield Road, Lander Road, and S.O.M. Center Road, pursuant to Section 1195.04.
      (2)   Buildings shall be located not less than thirty-five feet from all other street rights-of-way.
      (3)   Buildings shall be located not less than twenty-five feet from property lines abutting a U-1, U-2, U-2-A, U-3, U-3-A, U-3-B, or U-3-C District.
      (4)   Buildings shall be located not less than ten feet from property lines abutting all other districts.
   (c)   Pump and Canopy Regulations.
      (1)   Pump islands shall be located not less than twenty-five feet from all street rights-of-way and all other property lines.
      (2)   Canopies shall be located not less than fifteen horizontal feet from the street right-of-way, measured from a vertical line extended from the edge of the canopy to the ground directly below.
      (3)   Gasoline service stations that are located at the intersection of either Mayfield Road and S.O.M. Center Road, Mayfield Road and Lander Road or Mayfield Road and Golden Gate Boulevard, and that do not abut a U-l, U-2, U-2-A, U-3, U-3-A, U-3-B or U-3-C district, shall be permitted to erect and maintain a maximum of twenty pump stations.
      (4)   Gasoline service stations that do not meet the criteria of paragraph (c)(3) hereof shall be permitted to erect and maintain a maximum of twelve pump stations.
      (5)   A pump station shall be defined as the area at a pump island necessary to accommodate one vehicle for the purpose of dispensing fuel into that vehicle. A pump island may have more than one pump station.
   (d)   Parking and Pavement Regulations.
      (1)   Parking areas and site pavement to provide access to gasoline pumps and waiting spaces shall be located not less than ten feet from any street right-of-way. The resulting open space between the pavement and the street right-of-way shall be landscaped and maintained in accordance with subsection (f) hereof and, except for entrance and exit access drives and permitted signs, shall not be used for any other purpose.
      (2)   Additional pavement having a width of not less than ten feet shall be provided adjacent to and around the perimeter of the pump stations or pump islands, whichever is greater, and shall be exclusive of access drives and parking aisles.
      (3)   Gasoline service stations shall comply with the parking requirements set forth in Section 1189.05 for retail and service uses.
   Gasoline service stations that are combined with another permitted use shall provide parking spaces equal to the sum of the number of spaces required separately for each use.
      (4)   Drive-through facilities shall provide a minimum of ten stacking spaces to accommodate vehicles waiting to be serviced at the drive-through facility. Each stacking space shall have an area of not less than 144 square feet, measuring eight feet by eighteen feet.
      (5)   No outside parking or storage of motor vehicles or trailers is permitted, except during the daily business hours of operation of the station.
   (e)   Access Drives. Access drives shall be located in compliance with the following:
      (1)   Access drives shall be a minimum of fifty feet from the right-of-way line of the nearest intersecting street on both street frontages, measured from the centerline of the access drive.
      (2)   Access drives shall be a minimum of fifty feet from a U-1, U-2, U-2-A, U-3, U-3-A, U-3-B, or U-3-C District, measured from the centerline of the access drive.
      (3)   Access drives along the lot frontage that is adjacent to Mayfield Road, S.O.M. Center Road, or Lander Road shall be spaced at not less than 120-foot intervals, measured from the centerline of the access drive.
       (4)   Not more than one access drive shall be permitted along the lot frontage that is adjacent to any street other than Mayfield Road, S.O.M. Center Road or Lander Road.
   (f)   Landscaping Along the Street Frontage. The area between the pavement and the street right-of-way required in paragraph (d)(1) hereof shall be landscaped. The following minimum plant materials shall be provided and maintained:
      (1)   One major shade tree for every fifty linear feet of lot frontage or fraction thereof, not including access drive openings. Each tree, at the time of installation, shall have a clear trunk height of at least six feet and a minimum caliper of two inches.
       (2)   One shrub for every ten linear feet of lot frontage or fraction thereof, not including access drive openings.
      (3)   Grass, ground cover or other live landscape materials, excluding paving or gravel.
    (g)   Screening Adjacent to Residential Districts. There shall be a six-foot burnt clay brick or a solid concrete veneer (split face brick) wall provided across the entire length of a property line that abuts a U-1, U-2, U-2-A, U-3, U-3-A, U-3-B, or U-3-C District.
   (h)   Outdoor Activities.
      (1)   All activities provided at gasoline service stations, except those required to be performed at a fuel pump, air dispenser, or self-serve vacuum, and incidental dispensing machines permitted by paragraph (h)(2) hereof, shall be carried on entirely inside a building.
      (2)   Incidental dispensing machines, limited to telephone booths and newspaper boxes, may be placed outdoors. All other types of dispensing (such as, but not limited to, ice, candy, drinks, tobacco, et al.) shall only be permitted when in a completely enclosed building.
       (3)   There shall be no outside display and/or sale of any product or merchandise, unless specifically permitted under applicable provisions of this Zoning Code.
   (i)   (1)   Signs. Signs on dispensing pumps or canopy supports shall be limited to identifying the type of gasoline or diesel fuel available and any other associated informational or instructional signs: and
      (2)   Any other signs as may be permitted as stated in Chapter 1191.

1171.09 CAR WASHES.

   All car washes shall comply with the following supplemental regulations, which shall be in addition to all other regulations of this Zoning Code. In the event there is a conflict between these supplemental regulations and other portions of this Zoning Code, the regulations in this section shall govern.
   (a)   The location of a car wash shall have a minimum lot frontage of 150 feet and a depth of not less than 300 feet.
   (b)   All operations of a car wash shall be confined entirely to the interior of the building.
   (c)   An attendant shall be on duty during all hours of operations.
   (d)   All car washes shall have a separate entrance and exit.
   (e)   Automated, tunnel car washes shall have a minimum of eight stacking spaces for each vehicle entrance to the washing facility. Self-serve car washes shall have a minimum of two waiting spaces for each washing stall.
   (f)   Car washes may be combined on the same parcel as gasoline service stations when complying with the requirements of Section 1171.08.

1171.10 FUNERAL HOMES.

   All funeral homes shall comply with the following supplemental regulations, which shall be in addition to all other regulations of this Zoning Code. In the event there is a conflict between these supplemental regulations and other portions of this Zoning Code, the regulations in this section shall govern.
   (a)   Off-street parking for funeral homes shall be provided in accordance with Chapter 1189.
   (b)   No cremation shall be permitted on the premises of a funeral home.

1171.11 AUTOMOBILE SERVICE FACILITIES.

   Automobile service facilities shall comply with the following supplemental regulations, which shall be in addition to all other regulations of this Zoning Code. In the event there is a conflict between these supplemental regulations and other portions of this Zoning Code, the regulations in this section shall govern.
    (a)   Such facilities shall be limited to routine maintenance and service activities, such as engine tune-ups, lubrication, carburetor cleaning and minor repairs. Minor repairs shall not include engine overhauls, automobile painting, automobile body work, or any other repair activity that involves the regular creation of noise, odors or fumes that are detectable beyond the limits of the lot on which the minor repair facility is located.
   (b)   The location shall be on a parcel of land having not less than 150 feet of frontage and a total site area of not less than 22,500 square feet.
   (c)   All work shall be performed within the building.
   (d)   No outside parking or storage of motor vehicles or trailers is permitted, except during daily business hours of operation.
   (e)   Merchandise shall not be displayed outside.

1171.12 DESIGN STANDARDS.

   No feature of any plan submitted pursuant to this chapter shall adversely affect the public health, safety, comfort, convenience or general welfare, and the plan shall, in all respects, conform to the applicable restrictions of this Planning and Zoning Code, including but not limited to Chapter 1197 .
