The Director of Buildings shall enforce this Zoning Code.
No permit shall be issued for the construction, alteration or moving of any building or part thereof unless the plans and intended use indicate that the building and premises are to conform in all respects with this Zoning Code.
Upon any well-founded information, in writing, from any person aggrieved, that a provision of this Zoning Code is being violated, or upon his or her own initiative, the Director of Buildings shall take immediate steps to enforce this Zoning Code pursuant to the provisions of such Code.
No person shall use or permit the use of any premises or building, or part thereof, hereafter erected or altered, wholly or partly, or the yards, courts or other open spaces thereof which are in any way reduced, until the Director of Buildings has certified on the building permit that such premises or building is in conformity with this Zoning Code, or, if no building permit is issued, has issued a use permit specifying the use to which the premises or the building may be put, when such premises or building has been sufficiently completed to comply with the provisions and regulations relating thereto.
The Board of Zoning Appeals may, in specific cases, after public notice and hearing and subject to such conditions and safeguards as the Board may establish, determine and interpret the application of the use district regulations established in this Zoning Code. The action of the Board shall be confirmed by resolution of Council before becoming effective. The Board may:
(a) Permit the extension of a building or use into a more restricted district immediately adjacent thereto, but not more than fifty feet beyond the boundary line of the district in which such building or use is authorized;
(b) Permit the extension of a nonconforming use or building upon the lot occupied by such use or building at the time of the passage of this Zoning Code, provided, however, that such extension is limited to fifty percent of the floor space occupied by such nonconforming use at the time of the passage of this Zoning Code;
(c) Permit in a use district any use that is believed by the Board to be in general keeping with the uses authorized in such district; and
(d) Grant, in undeveloped sections of the City, temporary and conditional permits, for not more than two-year periods, for structures and uses that do not conform to the regulations prescribed for the use district in which they are to be located. Such permits shall not be renewable.

1153.99 PENALTY.
The owner of any building or premises, or part thereof, where anything in violation of this Zoning Code is placed or exists, and any architect, builder or contractor who may be employed to assist in the commission of any such violation, and all other persons who violate or fail to comply with any of the provisions of this Zoning Code, or who build in violation of any detailed statement of plans submitted and approved hereunder or in violation of the terms of any permit granted under or in accordance herewith, shall be guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

Administration, Enforcement and Penalty
1153.01 ENFORCEMENT BY DIRECTOR OF BUILDINGS.
