CHAPTER 1179

U-8 Office, Engineering, Medical and Research Buildings Districts

1179.01 PERMITTED USES.

   Buildings and land in a U-8 District shall be used, and buildings be designed, created, altered or intended, only for uses specifically designated and regulated as follows:
   (a)   Main Uses.
      (1)   Hospitals, diagnostic treatment and surgical services, medical offices, inpatient and outpatient facilities, hospice care, skilled nursing, hospice, assisted living, post acute, long term and chronic rehabilitation facilities, child and adult daycare when only for the family members of hospital employees, medical education facilities;
      (2)   General offices/administrative facilities;
      (3)   Engineering facilities, auditorium and meeting facilities, research laboratories related to the medical center;
      (4)   Light and medium hazard storage on the north side of Mayfield Road, only. For the purpose of this section only, “light and medium hazard storage” shall include storage of a radiographic film, boxed medical supplies (syringes, bandages, sterile packs and items typically used to support nursing functions) and storage of other supplies appropriate for and in support of a medical center; but no gas components.
   (b)   Accessory Uses.
      (1)   A retail pharmacy limited to the dispensing of prescriptions, drugs and any other merchandise normally associated with a pharmacy;
      (2)   Dental, optical and medical uses;
      (3)   Food and beverage service excluding alcoholic beverages, gift shops; cafeterias, when located and arranged within the complex to primarily service the employees, patients and visitors to the medical center;
      (4)   Branch bank and/or savings and loan office, with no exterior walk-up or auto-teller window, provided that the bank meets all accessory use tests and that the bank is intended to serve only hospital employees, patients and not outside customers;
      (5)   Parking garage;
      (6)   Ambulance service, provided such services are limited to the south campus, meeting the medical needs of the hospital and its patients and that such service is located in buildings intended for medical use only and there will be no outsourcing or sub-contracting of any ambulance service to other medical facilities or hospitals;
      (7)   Barber-beauty shops with hairpiece, wig and other available cosmetic services; and
      (8)   Similar uses that are not listed in subsection (a) hereof and that the Planning Commission, with the confirmation of City Council, determines are uses that the community needs and complement or support the uses permitted in this district. A use permitted pursuant to this section shall comply with the regulations of this chapter.

1179.02 YARD AND HEIGHT REGULATIONS.

   (a)   Yard Regulations.
      (1)   A front yard setback of not less than 60 feet from the right-of-way line of the street or highway is required. An exception to the front yard setback shall be permitted above the ground floor for any bridge structure that is otherwise approved to overpass Mayfield Road, provided that the only setback encroachment at the ground level shall be to accommodate the minimum structural support necessary for such bridge.
      (2)   Side and rear yards. The side and rear yard setbacks of not less than 50 feet are required. Where residential property that is zoned single-family abuts the side and rear yard, the side and rear yard setback shall not be less than 75 feet.
      (3)   Notwithstanding the setback and height provisions (subsection (b) below) of the Zoning Code, any garage structure existing at the time this U-8 District zoning amendment is adopted shall be permitted to be expanded vertically upon their existing footprints, without requirement of a variance to the Zoning Code provided that the height of any parking structure existing at the time of the adoption of these regulations, and which is within the required setback, shall be limited to a maximum height of 57 feet.
      (4)   Use of yards for accessory surface off-street parking and loading spaces:
         A.   Accessory off-street parking in a front yard is permitted not closer than 20 feet from a street line, except that such parking may be permitted not closer than ten feet from a street line if streetscape amenities are provided with the approval of the Planning Commission with confirmation of City Council. Such street amenities may include, but are not limited to: decorative walls, transit stops, unique landscaping or architectural features, etc.
         B.   Accessory off-street parking in a side or rear yard is permitted not closer than 25 feet from a side or rear property line or 30 feet from a residential district line.
         C.   Accessory off-street loading docks shall not be permitted in a side or rear yard setback. Loading docks shall not face a public street.
         D.   In rear and side yards adjoining any district other than a U-8 District, the installation of a six-foot high vision-impairing masonry wall of face brick or split brick shall be required in order to create a buffer area where such other district adjoins or abuts a rear or side yard of this district.
   (b)   Height Regulations.
      (1)   South side of Mayfield Road: The height of a building shall not:
         A.   Exceed 80 feet at the front yard setback;
         B.   Exceed 55 feet at the side and rear yard setbacks that are adjacent to any non-single family zoning district, except that the building height may be increased above 55 feet by an increment of one foot for each one foot increase in setback to a maximum permitted building height of 80 feet;
         C.   Exceed 40 feet at the side or rear setbacks adjacent to a single family residential zoning district except that the building height may be increased above the 40 feet by an increment of one foot for each three feet increase in setback to a maximum permitted building height of 80 feet.
   Rooftop accessory structures (i.e., elevator shafts, enclosed stairs, air conditioning or heating units and screens or mechanical equipment, penthouses, flag poles, light standard and lamps, communication antennas, surveillance cameras and other accessory structures or similar features) may extend above the permitted building height an additional 20 feet, to a maximum height of 100 feet, as approved by the Planning Commission with confirmation of City Council.
      (2)   North side of Mayfield Road: The height of a building shall not exceed 100 feet. Rooftop accessory structures (i.e. elevator shafts, air conditioning or heating units and screens or mechanical equipment, flag poles, enclosed stairs, penthouses, light standard and lamps, communication antennas, surveillance cameras and other accessory structures or similar features) may extend above the permitted building height an additional 20 feet, as approved by the Planning Commission with confirmation of City Council.

1179.03 HELICOPTER LANDING STRUCTURES.

   (a)   One helicopter landing structure shall be permitted on the U-8 District parcel only on the south side of Mayfield Road, and may not extend above the permitted basic building height.
   (b)   A secondary helicopter structure, or pad, may be considered and designated provided it is for emergency use only as a backup to the primary helicopter landing structure when the primary pad (subsection (a) hereof) is not available for use and only with the approval of the City Planning Commission, with the confirmation of City Council.

1179.04 OFF-STREET PARKING FACILITIES.

   Off-street parking shall be provided in accordance with Chapter 1189.

1179.05 NONCOMBUSTIBLE EXTERIORS REQUIRED.

   (a)   In a U-8 District, all new buildings or additions, hereafter erected or permitted to be erected under this Zoning Code, shall have outer walls constructed of noncombustible material.
   (b)   The outer faces of outer walls of buildings in this district shall be constructed with a minimum four-inch face brick, stone, cast stone, pre-cast concrete panel or architectural cast- in-place concrete of finish, glass, metal or other architectural panel approved by the Architectural Board of Review. Exposed masonry block and through-wall block construction is prohibited.
   (c)   The use of solid concrete veneer unit (split face brick) for alterations of existing buildings with suitable masonry walls may be permitted upon the approval of the Architectural Board of Review.
   (d)   No brick, cast stone or concrete veneer unit (split face brick) shall be larger than four inches in height.

1179.06 DEVELOPMENT PLANS.

   (a)   Submission of Plans. A site plan shall be prepared for types of proposals for development in a U-8 District and submitted to the Planning Commission. A preliminary and final development plan shall be submitted. Unless exempted by the Commission, plans shall include:
      (1)   A survey of the property and topography, showing land owned and proposed for development;
      (2)   The location, size, height and use of all main and accessory buildings and the general design and color of such buildings;
      (3)   A proposed system of circulation of vehicular traffic, including delivery trucks, details for connections to present streets, the type of pavement and estimates of traffic volume;
      (4)   Plans for all utility installations and connections;
      (5)   The layout and estimated number of spaces, the design of features and the type of pavement of parking areas; and
      (6)   Other site development, including grading and drainage, and the design of landscaped yards and planting areas and strips adjoining residential areas.
   (b)   Approval of Plans. If the Planning Commission finds that the plans are in accordance with this Zoning Code and with other codes of the City, the final development plan shall be submitted to the Architectural Board of Review for study and approval. The plan may be modified by the same procedure. No building permit shall be issued by the Director of Buildings until such development plan has been approved as provided in this subsection. Failure to begin the construction of all or an independent component of the plan within one year after approval by the Planning Commission shall void the plan as approved, unless an extension of time is approved by Council.
   (c)   Occupancy. No use or occupancy shall be permitted until the development plan for which a building permit has been issued is substantially completed and until an occupancy permit is obtained from the Director of Buildings as provided in the Building Code.

1179.07 CONFLICTS.

   In the event of a conflict between any of the provisions of this chapter and any of the provisions of any other section in this Zoning Code, this chapter shall govern.
