The City of Miamisburg hereby adopts and implements the procedures set forth in Chapter 5722 of the Ohio Revised Code, as amended, to facilitate the effective reutilization of nonproductive lands situated within the boundaries of the City of Miamisburg to foster the return of such nonproductive land to tax revenue generating status and/or the devotion to public uses.

1239.02 DEVELOPMENT DIRECTOR TO ADMINISTER.
The Development Director shall administer the Land Reutilization Program in accordance with this chapter and Chapter 5722 of the Ohio Revised Code.

1239.03 TERMS OF SALE.
The City of Miamisburg may sell any land acquired by it as part of this Land Reutilization Program at such times, to such persons, and upon such terms and conditions, subject to such restrictions and covenants as it deems necessary or appropriate to assure the land’s effective reutilization. Such land shall be sold at not less than its fair market value. “Fair market value” for purposes of this chapter is defined as the appraised value of the nonproductive land made with reference to such redevelopment and reutilization restrictions as may be imposed by the City as a condition of sale or as may be otherwise applicable to such land.

1239.04 SALE, RETENTION FOR PUBLIC USE, OR TRANSFER.
Upon approval of the legislative authorities of those taxing districts entitled to share in the proceeds from the sale of any land acquired by the City of Miamisburg as part of this Land Reutilization Program, the City of Miamisburg may either retain such land for devotion by it for public use, or sell, lease, or otherwise transfer any such land to another political subdivision for the devotion of public use by such political subdivision.

1239.05 SALE PROCEEDS.
The proceeds of the sales of any land acquired as part of this Land Reutilization Program shall be applied and distributed in accordance with Section 5722.08 of the Ohio Revised Code.

1239.06 COMMITTEE OF TAXING DISTRICTS ESTABLISHED.
The City of Miamisburg shall cause a committee of the taxing districts having an interest in the taxes, assessments, charges, interest, and penalties on the real property acquired as part of this Land Reutilization Program to be formed. Each member of the Committee shall be appointed by, and serve at the pleasure of, the taxing district he or she represents. The representative(s) appointed by the City of Miamisburg shall be appointed by and serve at the pleasure of the Miamisburg City Council.
The City of Miamisburg shall establish a separate Neighborhood Advisory Committee consisting of persons living or owning property within each neighborhood affected by this Land Reutilization Program. Such Neighborhood Advisory Committee shall be operated in accordance with and pursuant to Section 5722.09(B) of the Ohio Revised Code.

1239.08 EXEMPTION FROM TAXATION.
All lands acquired and held by the City of Miamisburg pursuant to this chapter and Chapter 5722 of the Ohio Revised Code shall be deemed real property used for a public purpose and shall be exempt from taxation until sold.
