CHAPTER 17

20 NEIGHBORHOOD RESIDENTIAL 1 NR1 DISTRICT

§ 17.20.005 Purpose.

The purpose of the NR1 zoning district is to provide a safe, attractive and stable environment for residential development, where the predominant development pattern will be one- and two-family dwellings and accessory dwelling units, in furtherance of the goals of the comprehensive plan. Other uses shall be allowed only to the extent that they support low-density residential development.

§ 17.20.010 Authorized uses.

Authorized uses in the NR1 district are set forth in Chapter 17.14 MMC, subject to the off-street parking requirements, and other general provisions and exceptions set forth in this code beginning with Chapter 17.44 MMC.

§ 17.20.020 Uses requiring conditional use permit.

Uses permitted subject to the granting of a conditional use permit in the NR1 district are set forth in Chapter 17.14 MMC.

§ 17.20.030 Accessory uses.

Accessory uses in the NR1 district are set forth in Chapter 17.14 MMC. The total area of all accessory structures may not exceed the area of the principal structure unless the applicant satisfies the criteria for a conditional use permit. In addition to complying with the conditional use criteria specified in Chapter 17.64 MMC, the hearing examiner shall also consider the following criteria in determining whether a conditional use permit should be issued:
A. 
All accessory structures or uses in the residential zone shall support and enhance the residential nature of the property.
B. 
The maximum size of any single accessory structure shall not exceed 2,500 square feet.
C. 
All accessory structures shall not exceed 24 feet in height.
D. 
All accessory structures shall be screened from surrounding properties by walls and landscaping, intended to break up the visual bulk of the structure, and reduce the visual impact of the structure.
E. 
No accessory structures subject to this code shall be devoted partially or totally to the pursuit of home occupations.
F. 
Accessory structures must be located to the rear of the principal structure.

§ 17.20.040 NR1 development and bulk regulations.

A. 
General dimensional, density and bulk regulations are set forth in Chapters 17.15A and 17.15B MMC.
B. 
Setback requirements for accessory uses shall be the same as for other uses except that the minimum rear yard setback for accessory uses shall be seven and one-half feet.
C. 
Setback requirements for an accessory dwelling unit shall be the same as the principal use.
