No unlawful building or structure, or unlawful use of a building or structure or lot existing at the effective date of this chapter or any amendments thereto, shall be deemed to be a nonconforming building, structure or use. Any applicant for any land use approval, including, without limitation, a building permit, subdivision, special exception use, site plan, zone change and/or variance, must indicate, in writing, at the time of application all uses which it believes would be entitled to nonconforming status together with all data in support of such claim. The failure of the applicant to so indicate, in writing, shall form a presumption that nonconforming uses do not exist on the property.
