Sec. 5-1.- R-1 Single-Family Dwelling District.

The regulations set forth in sections 5-1 through 5-6 of this article, or set forth elsewhere in this ordinance when referred to in this article, are the regulations applicable to an R-1 Single-Family Dwelling District.

Sec. 5-2. - Permitted uses.

The following are the permitted uses for an R-1 Single-Family Dwelling District:

A.

Single-family dwelling.

B.

Churches, but only when off-street parking space is provided upon the lot or within 200 feet thereof as required by article XIII of this ordinance.

C.

Farms, excluding the raising of livestock except on adequately fenced tracts containing not less than ten acres and having an average width of not less than 300 feet, and including the raising of poultry, but in no event shall such livestock or poultry be housed or confined within 200 feet of a tract, of one acre or less, containing a single-family residence. Livestock and poultry may be raised only in quantities reasonably sufficient for the immediate use of the consumption by the occupants of the premises.

D.

Public schools, elementary and high, and private schools having a curriculum the same as ordinarily given in public schools.

E.

Golf courses, except miniature golf courses and practice driving tees and similar commercial enterprises.

F.

Private clubs, except skeet and gun clubs and other clubs, the chief activity of which is a service customarily carried on as a business.

G.

Public parks and playgrounds owned by public agencies and forests and nurseries.

H.

Accessory buildings and accessory uses customarily incident to the above uses, not involving the conduct of a business, including home occupations where no name plate is used in connection with said use which exceeds two square feet in area, farm buildings and one class I garage and one private stable. Any accessory building that is not a part of the main structure shall be located not less than 60 feet from the front lot line. Accessory buildings shall also include church or similar bulletin boards, and signs, not exceeding 12 square feet in area, appertaining to the lease, hire or sale of a building or premises, which boards or signs shall be removed as soon as the premises are leased, hired, or sold, and provided further that not more than one sign of the above character shall be permitted upon any lot.

Sec. 5-3. - Parking regulations.

Any use that is constructed or reconstructed in an R-1 Single-Family Dwelling District shall provide and maintain an adequate parking space, as required by Article XIII of this ordinance.

Sec. 5-4. - Height regulations.

No building hereafter erected or altered shall exceed two and on-half stories or shall it exceed 40 feet in height, except as hereafter provided in this ordinance. This limitation shall not apply to colleges or universities.

Sec. 5-5. - Area regulations.

A.

Front yard.

1.

There shall be a front yard having a depth of not less than 40 feet, unless 30 percent or more of the frontage is improved with buildings that have observed a greater or less depth of front yard, in which instance no new building or portion thereof shall project beyond a straight line drawn between the point closest to the street line of the residence upon either side of the proposed structure, or if there be residences upon only one side, then beyond the straight line projected from the front of the two nearest residences, but this regulation shall not be interpreted to require a front yard of more than 100 feet, nor to permit a front yard of less depth than that of the nearest building. When the street is curved the line shall follow the curve of the street rather than be a straight line.

2.

Where lots have a double frontage, the required front yard shall be provided on only one street.

3.

On a corner lot there shall be a front yard on each street side of such lot, except that the buildable width of such lot need not be reduced to less than 40 feet. No accessory building shall project beyond the front yard line on either street.

B.

Side yard.

1.

Except as hereinafter provided in this ordinance there shall be a side yard on each side of a building having a width of not less than 15 feet except as to auxiliary buildings and detached garages which shall provide for a side yard of three feet.

2.

Wherever a lot of record existing at the time of the passage of this ordinance has a width of less than 100 feet, the side yard on each side of a building may be reduced to a width of not less than 15 percent of the width of the lot, but in no instance shall it be less than five feet.

C.

Rear yard.

1.

Except as hereinafter provided in this ordinance there shall be a rear yard having a depth of not less than 40 feet or 20 percent of the depth of the lot, whichever amount is smaller.

Sec. 5-6. - Intensity of use.

Every lot or tract of land upon which a building is erected shall have an area of not less than 20,000 square feet and an average width of not less than 100 feet, except that any of the uses permitted in this district may be erected or constructed on a smaller lot of record.

Sec. 5-7. - R-5 Single Family Dwelling District.

The regulations set forth in Sections 5-7 through 5-12 of this article, or set forth elsewhere in this ordinance when referred to in this article, are the regulations applicable to an R-5 Single-Family Dwelling District.

Sec. 5-8. - Permitted uses.

Any use permitted in an R-1 Single-Family Dwelling District.

Sec. 5-9. - Parking regulations.

Any use that is constructed or reconstructed in an R-5 Single-Family Dwelling District shall provide and maintain an adequate parking space, as required by article XIII of this ordinance.

Sec. 5-11. - Area regulations.

A.

Front yard.

1.

Front yard regulations shall be the same as required for R-1 Single-Family Dwelling District.

B.

Side yard.

1.

Except as hereinafter provided in this ordinance there shall be a side yard on each side of a building having a width of not less than 12 feet.

2.

Whenever a lot of record existing at the time of the passage of this ordinance has a width of loss than 100 feet, the side yard on each side of the building may be reduced to a width of not less than 15 percent of the width of the lot, but in no instance shall it be less than five feet.

C.

Rear yard.

1.

Except as hereinafter provided in this ordinance there shall be a rear yard having a depth of not less than 40 feet or 20 per cent of the lot, whichever amount is smaller.

Sec. 5-12. - Intensity of use.

Every lot or tract of land upon which a building is erected shall have an area of not less than 16,000 square feet and an average width of not less than 100 feet, except that any of the uses permitted in this district may be erected or constructed on a smaller lot of record.
