ARTICLE VII

R-3 TWO-FAMILY DWELLING DISTRICT

Sec. 7-1.- R-3 Two-Family Dwelling District.

The regulations set forth in this article, or set forth elsewhere in this ordinance when referred to in this article, are the regulations applicable to an R-3 Two-Family Dwelling District.

Sec. 7-2. - Permitted use.

The following are the permitted uses for an R-3 Two-Family Dwelling District:

A.

Any use permitted in an R-2 Single-Family Dwelling District, except golf courses and farms.

B.

Two-family dwelling structures.

Sec. 7-3. - Parking regulations.

A.

Whenever a structure is erected, converted, or structurally altered for a two-family dwelling, one parking space shall be provided and maintained on the lot for each dwelling unit of the structure.

B.

Whenever a lot is used for any of the purposes permitted in an R-2 Single-Family Dwelling District, the parking regulations shall be those set out in article XIII of this ordinance.

Sec. 7-4. - Height regulation.

No building shall exceed 2½ stories nor shall it exceed 35 feet in height, except as hereinafter provided.

Sec. 7-5. - Area regulations.

A.

Front yard.

1.

There shall be a front yard having a depth of not less than 25 feet, unless 30 percent or more of the frontage is improved with buildings that have observed a greater or less depth of front yard, in which instance no new building or portion thereof shall project beyond a straight line drawn between the point closest to the street line of the residence upon either side of the proposed structure, or if there be residences upon only one side, then beyond the straight line projected from the front of the two nearest residences, but this regulation shall not be interpreted to require a front yard of more than 60 feet, nor to permit a front yard of less depth than that of the nearest building.

Where lots have a double frontage, the required front yard shall be provided on both streets.

On a corner lot there shall be a front yard on each street side of such lot, except that the buildable width of such lot need not be reduced to less than 32 feet. No accessory building shall project beyond the front yard on either street.

B.

Side yard.

1.

Except as hereinafter provided in this ordinance there shall be a side yard on each side of a building, having a width of not less than six feet except as to auxiliary buildings and detached garages which shall provide for a side yard of three feet.

2.

Whenever a lot of record has a width of less than 50 feet, the side yard on each side of a building may be reduced to a width of not less than 12 percent of the width of the lot, but in no instance shall it be less than five feet.

C.

Rear yard.

1.

Except as hereinafter provided, there shall be a rear yard having a depth of not less than 30 feet or 20 percent of the depth of the lot, whichever amount is smaller.

Sec. 7-6. - Intensity of use.

Except as provided otherwise in this ordinance, every dwelling hereafter erected, enlarged, relocated or reconstructed shall be located upon lots containing the following areas and widths:

A.

Such lot shall have an area of not less than 7,260 square feet and an average width of not less than 50 feet.

B.

Where a lot of record has an area or width less than herein required, that lot may be used only for single-family dwelling purposes or for any of the other non-dwelling purposes or for any of the other non-dwelling uses permitted by this article.
