The minimum yards, off-street parking and loading spaces, open spaces, including lot area for each dwelling unit required by this ordinance for all buildings in existence at the time of passage of these regulations or for all buildings hereafter erected, shall not be encroached upon or considered as required yard or open space for any other building, except as hereinafter provided, nor shall any lot area be reduced below the requirements of these regulations.
Minimum yards may include eaves, overhangs, or gable ends up to twenty-four (24) inches; objects thirty (30) inches below general ground level (such as decks and pavement); fences, walls, landscaping, and other customary yard accessories, ornaments and furniture; HVAC compressors; and USPS approved mailboxes, all subject to easements and applicable height and traffic visibility requirements. Septic tanks and drain fields may be located in any yard but must meet minimum health department standards.

The use provisions in the various zoning districts are exclusive and any use not included under the permitted or permissible uses shall be prohibited in such districts. However, there are some uses which may be permitted if developed according to certain conditions. These conditional uses must be approved by the planning and zoning board prior to development. The planning and zoning board will prescribe the conditions which must be adhered to by any conditional use.
(A)
Building height shall be measured from the lower of:
(1)
The average natural grade; or
(2)
The average grade of the crown of the adjacent roadway.
(B)
Properties located within a flood hazard area shall measure from:
(1)
The higher of the base flood elevation or approved finished grade for buildings and structures in a special flood hazard area of two-tenths (0.2) percent annual chance of flood hazard area.
(2)
The approved finished grade for building and structures in coastal high hazard areas (Zone V) and Coastal A zones.
(C)
Building height calculation from natural grade shall be measured in the same manner as it is from grade.
(D)
Building height shall be measured to the highest point on the structure in the case of flat roofs, or to a point at the average height of the highest roof having a pitch, unless the property is located within a flood hazard area as provided herein.
