The following listed land uses are permitted (P) or allowed by conditional use (C) in the various zones in accordance with the following matrix. Land uses listed as (M or X) are only allowed by the City Council - (M) as part of a Mixed Use Development Plan and (X) by special permit from the City Council. Home-based businesses (noted on the Matrix with a P/C) are generally allowed as permitted uses in those zones indicated, but where certain conditions exist, a specific home-based business would be allowed only by conditional use permit in accordance with Chapter 8-500 Home-Based Businesses. C/P* Indicates that the building type for an accessory Dwelling Unit is permitted but the use is a conditional use. Land uses listed with no notation (blank box) are not allowed in that zone. If more than one land-use is being considered, the more restrictive regulations apply. Land uses that are not specifically listed as either Permitted or Conditionally permitted in the table are to be considered Not Permitted. Any discrepancy between the uses listed in this table and the uses listed in the “Uses” table of Section 12C-1206 (Airport Limitation Overlay Zones), shall be governed by the more restrictive allowance provided between the two tables.

  1. The conditional use of a Health Care Facility in the HOSP zone north of 2200 North is only allowed if the facility conforms to the agreements set forth in the “guidelines for development” found in North Logan City Ordinance 96-02. The conditional use of a Health Care Facility in the HOSP zone between 1800 to 2000 North and 200 to 400 East is only allowed if the facility also conforms to the applicable regulations for the City Center – Title 12C-1060. 
  2. These conditional uses in the HOSP zone north of 2200 North are only allowed if associated with a hospital within the zone. These conditional uses in the HOSP zone between 1800 to 2000 North and 200 to 400 East are only allowed if the facility conforms to the applicable regulations for the City Center – Title 12C-1060. 
  3. The restriction applicable to the conditional use for Adult Oriented Business or Adult Business include, but are not necessarily limited to the restrictions contained in Title 8, Chapter 8-600 Adult Oriented Businesses. 
  4. Development of Senior Housing in the RB Zone shall comply with Section 12C-1103, Site Development and Restrictions for Senior Housing. 
  5. High Voltage Electrical Transmission lines and Electrical Substations in these zones are regulated in accordance with Modifying Regulations, (Section 12C-1004, Paragraph K). 
  6. Residential Facilities for Persons with a Disability, that are substance abuse facilities shall not be located within 500 feet of a school in accordance with rules established by the State of Utah Department of Human Services. 
  7. The Town Square” planned for the City Center area shall not be considered a “park” or “community location” as referred to in State Alcoholic Beverage Control Act which places limitations on the sale of alcoholic beverages within a certain distance of it. It is intended that the Town Square could be adjacent to, or within the proximity distance restriction for, businesses that could be licensed to sell alcoholic beverages.
  8. Veterinary offices and animal/pet clinics/hospitals in any of the City Center zones are not permitted to include outside facilities for boarding or holding animals.
  9. Vertically Combined Commercial w/ Residential Buildings (VCCRB) in any of the City Center zones are only permitted, or allowed through conditional use permit in accordance with this matrix, when both the residential and the commercial components being considered are also permitted/allowed through conditional use permit as if they were considered on their own merit as a separate use.
  10. A Private/Commercial Fitness facility is only permitted in either of the City Center MR Zones when approved as part of a development plan and when such is an integrated amenity for the residents in a multi-unit residential development.
  11. Any Accessory Storage building for Multiple Family Residences in the CCC zone is conditioned upon such accessory storage building(s) being associated with and adjacent to a multiple family residence and part of a development plan approved by the City Council.  Furthermore any storage buildings shall be available for persons to use only in accordance with the definition for Accessory Storage for Multiple Family Residences as found in Chapter 12A-200 (4) (namely – “Storage units associated with multiple family housing which are used only by the occupants of the housing units.”)
  12. Two Family Residences, (Duplexes) that are designated as Seniors Housing are allowed in lieu of Single Family Residences in providing for the required mix of housing types in the MR7 Zone.  For the purposes of computing densities, one two-family residence (i.e.. two units) shall equal two single-family residences.  Land uses for developments that include Senior Housing must comply with the definitions in 12A-200 for Senior Housing and Qualifying Senior Communities.
  13. All pet (pet daycare and boarding) facilities shall comply with the following standards:
    1. Boarding shall be conducted within a fully enclosed building. Exterior training and exercise facilities shall meet the following standards:
      1. Fencing shall be of adequate height and design to contain animals, prevent escape, and provide protection from outside contact.
      2. Animals shall not be tethered within the exterior training and exercise facilities.
    2. Adequate space for exercise exists for all pets on the premise;
    3. Each dog shall have an individual boarding enclosure which shall provide enough space for the dog to turn about freely, and stand, sit and lie in a comfortable, normal position. The interior height of the enclosure must be at least 6 inches higher than the head of the dog in the enclosure measured when the dog is standing in a comfortable position;
    4. The facility must have a minimum of sixty (60) square feet of dedicated boarding area per animal. Required dedicated boarding area shall consist only of space usable by animals in care, and shall not include kitchens, bathrooms, mechanical rooms, storage, storefront retail areas, or any exterior facilities;
    5. Each cat shall have an individual boarding enclosure, which shall provide enough space for the cat to turn about freely, and stand, sit and lie in a comfortable and normal position. In addition, an enclosure for a cat shall provide an elevated platform appropriate for the size of the cat;
    6. Food waste, soiled bedding, debris and other waste shall be removed from all areas of the facility at least twice a day;
    7. The operator of any pet boarding facility shall assign a staff member to check the public areas (alleys and sidewalks) adjacent to the facility at least twice per day. Any debris (including animal waste) related to the operation of the facility shall be cleaned up immediately;
    8. The boarding facility shall be follow North Logan City business licensing protocol;
    9. The pet boarding facility shall have an emergency evacuation plan and employees shall be trained regarding the plan. At a minimum this plan shall include:
      1. a list of required emergency items to have on site
      2. a complete plan to address various types of disasters including transportation plan, gathering points, and a census roll call system
      3. an established set of rules and regulations pertaining to disasters
      4. communications procedures during a disaster
      5. a schedule for drills
      6. identified temporary boarding sites for all animals
      7. Established policies for dealing with injured animals, including identification of pre-selected veterinary facilities at which emergency care can be provided 24 hours per day, seven days per week.
    10. Proof of current core vaccinations as defined by the American Veterinary Medical Association (AVMA) shall be required for all animals prior to accepting a pet for care or boarding services and copies of records shall be kept for each animal. This shall include rabies vaccination for dogs and cats;
    11. The pet boarding area shall be separate from the exercise, retail, grooming, or animal food storage areas;
    12. The facility shall submit for approval a waste removal plan to the City, waste shall not be discharged to the public sewer system;
    13. Animals in care shall not cause a nuisance to adjacent property owners as defined in 16-209 Nuisance Animals;
    14. Facility shall be adequately staffed to provide a minimum of 15 minutes of direct care to each individual animal per day. Human caretakers must be present during all clearly posted business hours. All animals must be secured within respective boarding enclosures outside of clearly posted business hours while staff is not present;
    15. Interior space that includes adequate air conditioning and ventilation as to not require the opening of windows to avoid potential noise impacts; No employee of the pet boarding facility shall walk more than three leashed dogs at any one time on a public right of way;
    16. Video Surveillance shall be required of dog areas at all times;
    17. Each Facility owner shall be responsible to ensure that their facility is inspected on an annual basis by the Animal Control Officer of the North Park Police Agency. Facility shall allow unscheduled inspections by the Animal Control Officer of the North Park Police Agency at any time.

Uses Not Listed: Should the applicable city official determine that a type or form of land use which an applicant is seeking to locate in the city does not appear as a listed permitted or conditional use in the above table, he/she shall refer the matter to the City Council. Any non-listed use determined by the City Council to be of the same general character as any other listed use may be allowed as if it were that other similar use. Any non-listed use which is determined to be not of the same general character as any other listed use may only be allowed following a public hearing and a change adding that land use to the appropriate category by ordinance.
