5.10

OFFICIAL ZONING MAP

5.10.1. - Districts shown on map.

The boundaries of the various zoning districts are shown on the official zoning map. The official zoning map is hereby made a part of this ordinance and the maps, references and other information shown therein shall be as much a part of this Code as if all matter and information set forth in said maps was fully described herein.

The official zoning map was amended by Ordinance 2009-14 to have the following legend: PRE: preservation district; CON: conservation district; REC: recreation/open space district; E-1: estate residential district; E-2: estate residential district; R-1: residential single-family district; R-2: residential single-family district; R-3: residential two and three family district; R-6: residential mobile home, parks, and subdivision district; RM-15: residential-multifamily (townhouse or garden type) district; C-1: commercial neighborhood district; C-2: commercial general district; C-3: commercial wholesale and warehousing district; OF: office general district; RO: residential office district, L-1: industrial light district; M-1: limited manufacturing district; R/O/R: residential/office/retail district; CL-20,CL-30: congregate living facilities district; RPD: residential planned development district; CPD: commercial planned development district; IPD: industrial planned development district; MUPD: mixed use planned development district; PUB: public/semipublic district; TCR: town center residential district; TCB: town center boulevard district; TCCN: town center commercial neighborhood district; TCCR: town center commercial residential district. 5.10.2. - Official zoning map.

Each page of the official zoning map shall be identified by a signature of the zoning official under the following words: "This is to certify that this is page _____ of the Official Zoning Map referred to and adopted by the City of Oldsmar, Florida, ________ A.D. 20___."

The boundaries of each district shall be shown on the official zoning map.

Changes in district boundaries. If, in accordance with the provisions of these zoning regulations and applicable provisions of Florida law, changes are made in district boundaries or other matter portrayed on the official zoning map, such changes shall be entered promptly on the official zoning map after the amendment has been approved by the city council, with an entry on the appropriate page of the official zoning map as follows:

"On ________A.D., 20___ by Ordinance No. _____ of the City of Oldsmar, the Official Zoning Map was changed as shown on this page."

No amendment to these regulations which involves matter portrayed in the official zoning map shall become effective until such change and entry has been made on the official zoning map in the manner herein set out; such change shall be made within two working days after the date of adoption of the amendment.

Unauthorized changes prohibited. No changes of any nature shall be made in the official zoning map, or any matter shown thereon, except in conformity with the procedures set out in these zoning regulations. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of these zoning regulations.

Custody of maps. Regardless of the existence of purported copies of all or part of the official zoning map, which may from time to time be made or published, the official zoning map, which shall be maintained by the office of the city manager, shall be the final authority as to the current zoning status of all lands and waters in the incorporated area of the city.

Retention of earlier zoning map. All zoning maps, or remaining portions thereof, which have been officially adopted and recognized as the official zoning map for the City of Oldsmar prior to the effective date of adoption of these zoning regulations, shall be retained as a public record and as a guide to the zoning status of lands and waters prior to such date.

7.

Replacement of official zoning map. If the official zoning map, or any page or portion thereof, becomes damaged, lost, destroyed, or difficult to interpret by reason of the nature or number of changes, the city council may, by resolution, adopt a new official zoning map, or any page or pages thereof, which shall supersede the prior official zoning map, or page or pages thereof. The new official zoning map, or page or pages thereof, may correct drafting or other errors or omissions in the prior official zoning map, or page or pages thereof, but no such correction shall have the effect of amending the original official zoning map, or page or pages thereof.

If, in the process of adopting a replacement official zoning map, or any page or pages thereof, district boundaries are changed or altered, then action in regard to such change of district boundaries shall be taken only in the form of an amendment to these zoning regulations.

The new official zoning map, or page or portion thereof, shall be authenticated, as for the original, with wording to the following effect:

"This is to certify that this Official Zoning Map (or page or pages thereof) replaced the Official Zoning Map (or page or pages thereof) adopted ________ A.D., 20___ as part of Ordinance (or Resolution) No. _____ of the City of Oldsmar, Florida."

Unless the prior official zoning map has been lost or has been totally destroyed, the prior map, or any significant parts thereof remaining, shall be preserved as a public record together with all available records pertaining to its adoption or amendment.

5.10.3. - Interpretation of district boundaries.

Except as otherwise specifically provided, a district symbol or name shown within district boundaries on the official zoning map indicates that district regulations pertaining to the district extend throughout the whole area surrounded by the boundary line. Where uncertainty exists as to the boundaries of any district shown on said maps, the following rules shall apply:

Street and alley lines. Where boundaries are indicated as approximately following street and alley lines, land lot lines, military district lines or lot lines, such line shall be construed to be such boundaries.

2.

Unsubdivided property or tracts. In unsubdivided property or tracts, where a district boundary divides a lot, the location of such boundaries, unless same are indicated by dimensions, shall be determined by use of the scale appearing on such maps.

3.

Abandonment. Where a public road, street, or alley is officially vacated or abandoned, the regulations applicable to the property to which it is reverted shall apply to such vacated or abandoned road, street, or alley.

4.

Parallel boundaries. Where boundaries are so indicated that they are approximately parallel to the centerline or street lines of streets or to the central lines of alley lines of alleys or the centerlines or right-of-way lines of highways, such boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the official zoning maps. If no distance is given, such dimension shall be determined from the supplementary maps.

5.10.4. - Continuity of zoning.

In the event that any unincorporated territory immediately adjacent to the City of Oldsmar shall hereafter become incorporated, to ensure that there shall be no lapse of zoning, then, any and all zoning regulations which may be in effect in such territory and administered by the county shall remain in full force and effect and shall continue to be administered and enforced by the county until such time as these regulations within such territory shall be adopted and take effect.

5.10.5. - Relationship to the city's future land use map.

Where the zoning district applied to an area is inconsistent with the city's future land use map designation, the more restrictive of the two shall be applied.
