100 - INTRODUCTION
The purpose of the Orange Zoning Ordinance is to establish regulations and districts in accordance with the comprehensive master plan in order to foster planned, quality growth, to protect the health, safety, welfare and property of the public, and to encourage economic opportunity within the city limits of Orange. These regulations have been designed to assist in the implementation of the goals and objectives of the comprehensive master plan and:
(1)
Lessen congestion in the streets;
(2)
Minimize flooding and secure safety from fire, panic and other dangers;
(3)
Promote health and general welfare;
(4)
Provide adequate light and air;
(5)
Prevent the overcrowding of land and undue concentration of population density;
(6)
Facilitate the adequate provision of transportation, water, sewers, schools, and parks; and
(7)
Provide for standards for development of all land in the city.
The zoning ordinance is a tool used to implement the goals of the Orange Master Plan by establishing zoning regulations and zoning district boundaries. The master plan identifies the goals and objectives of the city, and does not constitute land use regulations or zoning regulations or establish zoning district boundaries. All actions of the city in the enforcement of the zoning ordinance should be done only in furtherance of the goals of the comprehensive master plan.
The previous zoning ordinance (Chapter 13 of the prior Orange City Code) is amended and superseded by the adoption of this zoning ordinance on April 30, l 996. The regulations and conditions for city permits or approvals which were issued under the previous zoning ordinance shall remain in effect until expiration of such permit or approval or the completion of the project, at which time the regulations of this zoning ordinance shall apply.
If any portion of this zoning ordinance, is for any reason, held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate and independent provision, and shall not affect the validity of the remaining portions of this zoning ordinance.
