5000 - ITINERANT VENDORS LOCATED ON PROPERTIES OWNED BY A GOVERNMENTAL ENTITY OR POLITICAL SUBDIVISION OF THE STATE OF TEXAS

Sec. 12.5001 - Purpose

The purpose of this article is to establish the conditions, location and operation of itinerant vendors on government-owned propert(ies) to protect the public health, safety, and welfare.

Sec. 12.5002 - Itinerant Vendors Located on Propert(ies) Owned by a Governmental Entity or Political Subdivision of the State of Texas

Itinerant vendors, as defined in the City of Orange Code of Ordinances Chapter 4 "Business and Commerce" Article 4.600 "Peddlers and Solicitors" Section 4.601 "Definitions," are permitted to operate on any tract or parcel of land owned by any governmental entity or any political subdivision of the State of Texas, without regard to the zoning on such parcel or tract of land, provided that the governmental entity has given permission for the itinerant vendor(s) to operate on its propert(ies) through an appropriate official so authorized to provide such permission. All itinerant vendor(s) shall comply with the City of Orange Code of Ordinances Chapter 4 "Business and Commerce," Article 4.600 "Peddlers and Solicitors." Itinerant vendors selling ice cream, snow cones or similar items must also comply with the City of Orange Code of Ordinances Chapter 4.1400 "Sale of Ice Cream, Snow Cones or Similar Items from a Vehicle or Mobile Cart." The governmental entity or political subdivision of the State of Texas may also make other requirements for use of its propert(ies) for itinerant vendor(s) as it may so desire including, but not limited to, eligibility, desirability, application forms, fees and insurance.
