3000 - ELECTRIC VEHICLE CHARGING STATIONS

Sec. 12.3001 - Purpose

The purpose of this article is to establish the conditions, location and operation of electric vehicle charging stations within the City of Orange to protect the public health, safety, and welfare.

Sec. 12.3002 - Definitions

Accessory Use shall mean a use that is incidental and subordinate to that of the main building or use of land and that is located on the same lot or parcel.

Electric Vehicle shall mean any vehicle that is powered exclusively by electrical energy through a battery contained within the vehicle and without the use of gasoline or diesel.

Electric Vehicle Charging Station shall mean battery charging equipment that has as its primary purpose the transfer of electric energy by conductive or inductive means to a battery in an electric vehicle or a hybrid vehicle. Electric vehicle charging station does not include electrical outlets used at a residence for the charging of an electric or hybrid vehicle.

Hybrid Vehicle shall mean a vehicle that is powered by either gasoline or diesel fuels or by electric battery within the same vehicle.

Primary Use shall mean the main or predominant use for which a lot or parcel of land is designed, arranged, utilized, or occupied.

Sec. 12.3003 - Electric Vehicle Charging Stations as an Accessory Use

An electric vehicle charging station is permitted as an accessory use to any use allowed in the R-3 High Density Residential if the property is used as an apartment complex, townhome complex, or condominium complex; C-1 Commercial; C-2 Commercial; C-S Commercial Special; C-S Commercial Special-Cove; OTC-Old Town Center; I DC-Interstate Development Corridor; I-Industrial; and MUZD-Mixed Use zoning districts. A primary use must be present on the same parcel of property prior to the installation of an electric vehicle charging station. If an accessory use, then the electric vehicle charging station is not required to meet the site development regulations contained in Section 12.610 of this Code.

Sec. 12.3004 - Electric Vehicle Charging Stations as a Primary Use

An electric vehicle charging station is permitted as a primary use in the C-1 Commercial; C-2 Commercial; C-S Commercial Special; C-S Cove Commercial Special-Cove; OTC-Old Town Center, I DC-Interstate Development Corridor, I-Industrial; and MUZD-Mixed Use zoning districts. If the electric vehicle charging station is the primary use, then the electric vehicle charging station is required to meet the site development regulations contained in Section 12.610 of this Code.

Sec. 12.3005 - Requirement to Comply with the Electrical Code of the City of Orange

All electric vehicle charging stations, whether an accessory use or a primary use, must be compliant with the requirements of the most recent electrical code adopted by the City of Orange.

Sec. 12.3006 - Requirement to Comply with the Drainage Regulations of the City of Orange

All electric vehicle charging stations, whether an accessory use or a primary use, must be compliant with the requirements of the most recent drainage regulations adopted by the City of Orange.
