This article provides for the time, place, and manner for regulating signs to assure that:
(1)
Signs do not dominate the landscape or buildings; and
(2)
Signs do not create a nuisance to persons using the public rights-of-way; and
(3)
Signs do not constitute a visual nuisance by their size, location, or height; and
(4)
Signs do not create a hazard due to collapse, fire, decay, or abandonment; and
(5)
Signs do not obstruct firefighting or police surveillance; and
(6)
Signs do not create traffic hazards by confusing or distracting motorists, or their ability to read traffic signs or impair the driver's ability to see pedestrians, vehicles, or obstacles.

The following definitions are applicable to the sign regulations only.
Billboard. Means a large sign, either static or digital, that has one (1) or more large freestanding pole(s) with one (1) or more faces that is regulated by the federal government or the State of Texas. Billboards are commonly used to advertise businesses or services that are located off-premises.
Electronic Reader Board. Means a sign that uses electronic illumination, whether constant or by scrolling, for messages and is used either singularly or in conjunction with another sign. Electronic reader boards are commonly used for information such as date, time, weather, temperature, and news.
Ground Sign. Means a sign suspended by, or supported by, one (1) or more uprights or braces with no more than thirty-six (36) inches clearance from the bottom of the sign to grade. Ground signs are commonly used to sell real estate, provide directions, promote activities, or identify the name of an establishment. Ground signs may be electronic or static. Ground signs do not resemble an ornamental sign.
Lot. Means a unit of land within a subdivision occupied or designed to be occupied by a main building and the accessory buildings or uses customarily incidental to such main building, including the open spaces required by the zoning ordinance.
Master Sign. Means a sign mounted on poles that are permanently attached to the ground and that consists of three (3) or more sign faces.
Ornamental Sign. Means a sign that is constructed of concrete, wood, or fiberglass and shaped to resemble an orange, which is approximately thirty (30) inches tall and thirty (30) inches wide and weighs approximately one thousand (1,000) pounds. Ornamental sign does not include signs constructed of concrete and shaped to resemble an orange that is less than six hundred (600) pounds.
Parcel. Means a tract or plot of land of any size that has not been subdivided and may or may not be improved.
Pole Sign. Means a sign that is mounted on a freestanding pole or poles permanently attached to the ground that has one (1) or two (2) sign faces and clearance from the bottom of the sign to grade is more than thirty-six (36) inches.
Portable Sign. Means a sign that is designed to be easily transportable, including, but not limited to, signs designed to be displayed while mounted or affixed to the trailer by which it is transported, or with wheels remaining otherwise attached during display; signs mounted on transportable frames with wheels removed; signs attached or affixed to a chassis or other moveable support constructed without wheels, signs designed as, or converted to, A-frame or T-Frame signs.
Promotional Sign. Means a sign used for a temporary period to advertise a business or promote an activity and is not permanently affixed to a structure or the ground. Promotional signs include, but are not limited to: blade signs, feather flags, inflatables, air dancers, and inflatable tubes.
Public Property. Means all publicly owned property, including streets, rights-of-way, easements, and everything affixed thereto.
Sight Triangle. Means the area bounded by the street lines at corner lots and a straight line joining said street lines at points, measured along said street lines, that are twenty (20) feet distance from the point of intersection.
Sign. Means a communication device, structure, or fixture that incorporated graphics, symbols, or written copy intended to promote the sale of a product, commodity, or service, or to provide direction or identification for a premises or facility. Sign does not mean a banner, flag, historical landmark, political advertisement or message, or any signage required and/or installed by a governmental entity including, but not limited to, message boards, monuments, and scoreboards. Sign does not mean symbols, letters, or numerals that are marked, sprayed, or painted upon a public roadway as approved by a governmental entity. Sign also does not mean governmental warning devices used to alert and/or warn of road conditions, school zones, workers in the public rights-of-way or other public health and safety matters.
Sign Height. Means the vertical distance at the highest part of the sign, including the sign structure, above grade.
Sign Size. Means the square footage (maximum height above grade and maximum width) of a sign including the sign face, supporting structures and any clear space underneath the sign face.
Wall Sign. Means any sign attached to, projecting from, or painted on a wall of a building or structure so that the wall forms the supporting structure or becomes the background of the sign.

The following regulations shall apply to signs in all districts unless otherwise provided for elsewhere in this chapter:
(1)
No sign shall be erected as to prevent free ingress or egress from any door, window, or fire escape; and no sign shall be attached to a standpipe or fire escape.
(2)
All signs shall be constructed and erected in accordance with the building and electrical codes of the City of Orange. An inspection shall be conducted by the building official or his designee on all sign installations to assure the foundation sign structure, and electrical service are placed as to code.
(3)
Sign Maintenance.
(A)
All signs and their support systems shall be maintained in good repair and shall be maintained in a safe, clean, sanitary, and not offensive condition, and shall be kept free and clear of all obnoxious substances and rubbish.
(B)
Whenever a sign becomes structurally unsafe or endangers the public safety, the building official shall give written notice to the owner of the sign or the owner of the premises on which the sign is located that such sign be made safe or removed within ten (10) days.
(C)
When a sign poses an immediate danger the building official shall contact the owner of the property or, in the case of a billboard, the owner of the sign and request the sign be removed or repaired to the satisfaction of the building official within twenty-four (24) hours or the building official shall have the sign removed or repaired at the city's expense. The owner of the property or, in the case of a billboard, the owner of the billboard will be billed for all expenses incurred and will submit payment within ten (10) working days. If the owner fails to remit the expenses, the building official shall have a lien filed upon the property equal to the amount of the costs incurred for removing or repairing the sign and any expenses incurred in the collection or filing processes.
(D)
No pole sign, master sign or billboard may be located closer than fourteen (14) feet from overhead electrical conductors which are energized more than seven hundred fifty (750) volts.
(E)
All signs must be installed and maintained in a neat and workmanlike manner.
(4)
Conformance with Sign Regulations.
(A)
It shall be unlawful for any person, business entity, or corporation to erect, construct, enlarge, alter, repair, move, improve, convert, equip, use, or maintain any sign or sign structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this article.
(B)
Where a legal nonconforming sign exists at the effective date of adoption or amendment of this article that could not be erected under the terms of this article for reasons specified herein, such sign may be continued so long as it remains otherwise lawful, subject to the following provisions:
(i)
No sign may be enlarged or altered in any way which increases it nonconformity.
(ii)
Should the sign be destroyed by any means to an extent of more than fifty percent (50%) of its replacement cost at the time of destruction, it shall not be reconstructed except in conformity with the provisions of this article.
(iii)
Should the sign be moved for any reason for any distance whatever, it shall thereafter conform to the regulations after it is moved. An illegal sign which exists at the effective date of adoption or amendment of this article shall be removed.

The director of planning and community development has the responsibility for administering the sign regulations for proposed signs not specifically identified herein. The director has the authority to utilize the regulations for the most closely associated sign identified in this location.

(1)
R-1 Low Density Residential Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, public or utility easement or on public property without the express written consent of the governmental entity and/or private entity owning the right-of-way, easement, or the property.
(ii)
No signs may be placed in a sight triangle.
(iii)
No signs may be placed on a utility pole or on any tree.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Ground signs may not be more than six (6) square feet in size. The maximum sign height for a ground sign is four (4) feet above grade.
(v)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vi)
Electronic reader boards, pole signs, promotional signs, master signs, portable signs, ornamental signs, and billboards are not allowed in the R-1 zoning district.
(2)
R-2 Medium Density Residential Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
No sign may be placed in a sight triangle.
(iii)
No signs may be placed on a utility pole or on any tree.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
All signs must be installed and maintained in a neat and workmanlike manner.
(v)
Ground signs may not be more than six (6) square feet in size. The maximum sign height for a ground sign is four (4) feet above grade.
(vi)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vii)
Electronic reader boards, pole signs, promotional signs, master signs, portable signs, ornamental signs, and billboards are not allowed in the R-2 zoning district.
(3)
R-3 High Density Residential Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Ground signs may not be placed inside the sight triangle.
(iii)
No signs may be placed on a utility pole or on any tree.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Ground signs.
1.
Single family homes, duplexes or triplexes. A ground sign may not be more than six (6) square feet. The maximum sign height for a ground sign is four (4) feet above grade.
2.
Apartment complex, townhome complex or condominium complex. A ground sign may not be more than one hundred (100) square feet in size.
(v)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vi)
Electronic reader signs, pole signs, promotional signs, master signs, portable signs and billboards are not allowed in the R-3 zoning district.
(vii)
Two (2) ornamental signs are allowed if located at an apartment complex, townhome complex or condominium complex.
(viii)
Wall signs are prohibited at single family homes, duplexes or triplexes. If located at an apartment complex, townhome complex or condominium complex, a wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
(4)
R-4 Manufactured Housing Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Ground signs may not be placed inside the sight triangle.
(iii)
No signs may be placed on a utility pole or on any tree.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Ground signs.
1.
For single family homes, duplexes or triplexes the ground sign may not be more than six (6) square feet in size. The maximum sign height is four (4) feet above grade.
2.
For manufactured home parks, townhome complexes and condominium complexes, the maximum size is one hundred (100) square feet in size.
(v)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vi)
Electronic reader signs, pole signs, promotional signs, master signs, portable signs and billboards are not allowed in the R-4 zoning district.
(vii)
Two (2) ornamental signs are allowed if located at a manufactured home park.
(5)
C-1 Light Commercial Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed, except for promotional signs as provided below:
(i)
A promotional sign may only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental entity and private entity owning the right-of-way, easement or the property.
(ii)
Pole signs are allowed in the sight triangle, but not in the public right-of-way or on an easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) linear feet to an adjoining residential property.
(v)
Master signs shall not be located in a sight triangle.
(vi)
Electronic reader boards shall not be located in a sight triangle.
(vii)
Promotional signs shall not be located in a sight triangle.
(viii)
A ground sign shall not be located in a sight triangle.
(ix)
Ornamental signs may be located in a sight triangle but not in the public right-of-way, sidewalk, or easement.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Maximum size:
1.
For ground signs is two hundred sixty (260) square feet; however, no ground sign may be more than twenty-six (26) feet in width.
2.
For electronic reader boards is one hundred fifty (150) square feet.
3.
For master signs is six hundred (600) square feet.
4.
For pole signs is three hundred thirty-six (336) square feet; however, no pole sign may be more than fourteen (14) feet wide.
5.
For promotional signs is fifty (50) square feet.
6.
For ornamental signs is eight (8) square feet.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which they are attached.
(v)
If the electronic reader board is used in conjunction with a master sign, the maximum size of the entire sign is six hundred (600) square feet.
(vi)
Ornamental signs are allowed in the C-1 zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after installation.
(vii)
Portable signs are not allowed in the C-1 zoning district.
(viii)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(ix)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.
2.
For a pole sign is twenty-four (24) feet above grade.
3.
For a master sign is fifty (50) feet above grade.
4.
No wall sign may be placed at a height exceeding the eaves of the building.
(x)
Number of signs allowed:
1.
A parcel or lot shall have only one (1) of the following signs located on a parcel or lot:
a.
Electronic reader board, either singularly or in conjunction with another sign.
b.
Ground sign.
c.
Master sign.
d.
Pole sign.
2.
Any number of wall signs are allowed for each wall that faces a public street so long as the total square footage of the wall signs does not exceed thirty percent (30%) of the square footage of the wall to which the signs are attached.
3.
One (1) promotional sign is allowed at any one (1) time.
4.
Two (2) ornamental signs are allowed for each business establishment on a parcel or lot.
(xi)
Billboards are not allowed in the C-1 zoning district.
(6)
C-2 Commercial Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed except for promotional signs as provided below:
(i)
A promotional sign may only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Pole signs are allowed in the sight triangle, but not in the right-of-way or on an easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) linear feet to an adjoining residential property.
(v)
Master signs shall not be located in a sight triangle.
(vi)
Electronic reader boards shall not be located in a sight triangle.
(vii)
A promotional sign shall not be placed in a sight triangle.
(viii)
A ground sign shall not be placed in a sight triangle.
(ix)
Ornamental signs may be placed in a sight triangle but not in the public right-of-way, sidewalk, or easement.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Maximum size:
1.
For ground signs is two hundred sixty (260) square feet; however, no sign may be more than twenty-six (26) feet in width.
2.
For electronic reader boards is one hundred fifty (150) square feet.
3.
For master signs is six hundred (600) square feet.
4.
For pole signs is three hundred thirty-six (336) square feet; however, no pole sign may be more than fourteen (14) feet in width.
5.
For promotional signs is fifty (50) square feet.
6.
For ornamental signs is eight (8) square feet.

(viii)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.
2.
For a pole sign is twenty-four (24) feet above grade.
3.
For a master sign is fifty (50) feet above grade.
4.
No wall sign may exceed the height of the eaves of the building.
(ix)
Number of signs allowed:
1.
A parcel or lot shall have only one (1) of the following types of signs on the parcel or lot:
a.
Electronic reader board, either singularly or in conjunction with another sign.
b.
Ground sign.
c.
Master sign.
d.
Pole sign.
2.
Any number of wall signs are allowed for each wall that faces a public street so long as the total square footage of the wall signs does not exceed thirty percent (30%) of the square footage of the wall to which they are attached.
3.
One (1) promotional sign is allowed at any one (1) time.
4.
Two (2) ornamental signs are allowed for each business on a parcel or lot.
(x)
Billboards are not allowed in the C-2 zoning district.
(7)
C-S Commercial-Special Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed, except for promotional signs as provided below:
(i)
A promotional sign may only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Pole signs may be placed in a sight triangle, but not in a right-of-way or on an easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be located closer than fifty (50) linear feet to an adjoining residential property.
(v)
Master signs shall not be located in a sight triangle.
(vi)
Electronic reader boards shall not be located in a sight triangle.
(vii)
Promotional signs shall not be placed in a sight triangle and shall not be displayed at any single family home, duplex or triplex.
(viii)
Ground signs shall not be placed in a sight triangle.
(ix)
Ornamental signs may be placed in the sight triangle but not in a right-of-way or on an easement.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Maximum size:
1.
For ground signs.
a.
For single-family homes, duplexes or triplexes the maximum size is six (6) square feet. The maximum sign height for a ground sign [is] four (4) feet above grade.
b.
For apartment complexes, townhome complexes, condominium complexes, businesses or non-profit organizations, the sign may not exceed the maximum size allowed; however, no sign may be more than twenty-six (26) feet in width.
2.
For electronic reader boards is one hundred fifty (150) square feet.
3.
For master signs is six hundred (600) square feet.
4.
For pole signs is three hundred thirty-six (336) square feet; however, in no case shall the sign exceed fourteen (14) feet in width.
5.
For promotional signs is fifty (50) square feet.
6.
For ornamental signs is eight (8) square feet.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
(v)
Ornamental signs are allowed in the C-S zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after being installed.
(vi)
Portable signs are not allowed in the C-S zoning district.
(vii)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(viii)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.
2.
For pole signs is twenty-four (24) feet above grade.
3.
For master signs is fifty (50) feet above grade.
4.
No wall sign may exceed the height of the eaves of the building.
(ix)
Number of signs allowed.
1.
For single family homes, and duplexes,
2.
A parcel or lot may only have one (1) of the following types of signs on the parcel or lot:
a.
Electronic reader board, either singularly or in conjunction with another sign.
b.
Ground sign.
c.

Two (2) ornamental signs are allowed for each business on a parcel or lot.
6.
Billboards are not allowed in the C-S zoning district.
(8)
C-S Cove-Commercial Special Cove Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed, except for promotional signs as provided below:
(i)
A promotional sign shall only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Pole signs may be placed in the sight triangle, but not in a public right-of-way or easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) feet to an adjoining residential property.
(v)
Master signs shall not be located in a sight triangle.
(vi)
Electronic reader boards shall not be located in a sight triangle.
(vii)
Promotional signs shall not be located in a sight triangle and shall not be displayed at any single family home, duplex or triplex.
(viii)
Ground signs may not be placed in a sight triangle.
(C)

Billboards are not allowed in the C-S Cove zoning district.
(9)
OTC-Old Town Center Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed except for promotional signs as provided below:
(i)
A promotional sign shall only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Pole signs may be located in a sight triangle, but not in a public right-of-way or easement, if the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) feet to an adjoining residential property.
(v)
No master sign shall be located in the sight triangle.
(vi)
No electronic reader shall be located in the sight triangle.
(vii)
No promotional sign shall be located in the sight triangle.
(viii)
No ground sign shall be located in a sight triangle.
(ix)
Ornamental signs may be placed in the sight triangle, on a public sidewalk and on an easement.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Maximum size:
1.
For a ground sign is two hundred sixty (260) square feet; however, no sign may be more than twenty-six (26) feet in width.
2.
For an electronic reader board is one hundred fifty (150) square feet.
3.
For a master sign is six hundred (600) square feet.
4.
For a pole sign is three hundred thirty-six (336) square feet; however, in no case shall the sign width exceed fourteen (14) feet in width.
5.
For a promotional sign is fifty (50) square feet.
6.
For an ornamental sign is eight (8) square feet.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
(v)
Ornamental signs are allowed in the OTC zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after being installed.
(vi)
Portable signs are not allowed in the OTC zoning district.
(vii)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(viii)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.

Billboards are not allowed in the OTC zoning district.
(10)
IDC-Interstate Development Corridor Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed, except for a promotional sign as provided below:
(i)
A promotional sign shall only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)

(iv)
Maximum size:

For ground signs is two hundred sixty (260) square feet; however, no sign shall be more than twenty-six (26) feet in width.
1.
For electronic signs is one hundred fifty (150) square feet.
2.
For master signs is six hundred (600) square feet.
3.
For pole signs is two thousand six hundred (2,600) square feet; however, no sign may be more than twenty-six (26) feet in width.
4.
For promotional signs is fifty (50) square feet.
5.
For ornamental signs is eight (8) square feet.
6.
For static or digital billboards located on a parcel or lot adjacent, adjoining, or contiguous to Interstate 10 is six hundred seventy-two (672) square feet singularly or for each face if the faces are placed back-to-back or in a V-shaped configuration as seen from above.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
8.
For billboards located on a parcel or lot not adjacent, adjoining, or contiguous to Interstate 10, the maximum size is four hundred fifty (450) square feet.
(vi)
Ornamental signs are allowed in the IDC zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after being installed.
(vii)
Portable signs are not allowed in the IDC zoning district.
(viii)
Billboards are allowed in the IDC zoning district if the property is adjacent, adjoining, or contiguous to a state or federal highway.
1.
A billboard may not be placed on top of a building or on the side of a building.
2.
Digital billboards:
a.
The image or message shall be static or fixed and lasting no less than ten (10) seconds. Each screen message shall contain a single advertisement.
b.
The image or message shall change to another image or message in a period of two (2) seconds or less.
c.
The image or message shall not be animated, flashing, scrolling or contain video imagery.
d.
The image or message shall adjust its brightness as ambient light levels change so as not to be visually distracting.
e.
The digital billboard shall contain a default design that will freeze the sign's image or message if a malfunction occurs.
3.
All billboard signs shall meet the requirements of the State of Texas as set out in the Texas Highway Beautification Act, Texas Transportation Code, Chapter 391 and implementing regulations published in Title 43 Texas Administrative Code, Chapter 21.
(ix)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(x)
Maximum height:
1.

(1)
A sign permit must be obtained from the department of planning and community development prior to the installation of a ground sign greater than six (6) square feet in size, electronic reader board, pole sign, master sign or billboard. A sign permit fee of fifty dollars ($50.00), except for promotional signs and billboards, shall be paid to the City of Orange for each sign before a sign permit may be issued. A promotional sign must obtain a permit but there is no fee. The fee for a billboard shall be as follows:
•
Total valuation of one thousand dollars ($1,000.00) or less—Twenty-five dollars ($25.00) for each inspection.
•
Total valuation of one thousand one dollars ($1,001.00) to fifty thousand dollars ($50,000.00)—Twenty-five dollars ($25.00) for the first one thousand dollars ($1,000.00) plus six dollars ($6.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including fifty thousand dollars ($50,000.00).
•
Total valuation of fifty thousand one dollars ($50,001.00) to one hundred thousand dollars ($100,000.00)—Two hundred seventy-five dollars ($275.00) for [the] first fifty thousand dollars ($50,000.00) plus five dollars ($5.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including one hundred thousand dollars ($100,000.00).
•
Total valuation of one hundred thousand one dollars ($100,001.00) to five hundred thousand dollars ($500,000.00)—Four hundred seventy-five dollars ($475.00) for the first one hundred thousand dollars ($100,000.00) plus four dollars ($4.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including five hundred thousand dollars ($500,000.00).
•
Total valuation of five hundred thousand one dollars ($500,001.00) or more—One thousand six hundred seventy-five dollars ($1,675.00) for the first five hundred thousand dollars ($500,000.00) plus three dollars ($3.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof.

An inspection shall be conducted by the building official or his/her designee on all ground signs greater than six (6) square feet in size, pole sign, master sign or billboard installations to assure the foundation, sign structure, and electrical service are placed in conformance with the city's codes and ordinances.

To provide reasonable flexibility in these regulations, the zoning board of adjustment may approve an application for a sign that may not conform with the provisions of the zoning district in which it is located, where the location, size, or addition would not be inconsistent with the character of the area or neighborhood in which such sign or structure is to be located.

1000 - SIGN REGULATIONS2

This article provides for the time, place, and manner for regulating signs to assure that:
(1)
Signs do not dominate the landscape or buildings; and
(2)
Signs do not create a nuisance to persons using the public rights-of-way; and
(3)
Signs do not constitute a visual nuisance by their size, location, or height; and
(4)
Signs do not create a hazard due to collapse, fire, decay, or abandonment; and
(5)
Signs do not obstruct firefighting or police surveillance; and
(6)
Signs do not create traffic hazards by confusing or distracting motorists, or their ability to read traffic signs or impair the driver's ability to see pedestrians, vehicles, or obstacles.

The following definitions are applicable to the sign regulations only.
Billboard. Means a large sign, either static or digital, that has one (1) or more large freestanding pole(s) with one (1) or more faces that is regulated by the federal government or the State of Texas. Billboards are commonly used to advertise businesses or services that are located off-premises.
Electronic Reader Board. Means a sign that uses electronic illumination, whether constant or by scrolling, for messages and is used either singularly or in conjunction with another sign. Electronic reader boards are commonly used for information such as date, time, weather, temperature, and news.
Ground Sign. Means a sign suspended by, or supported by, one (1) or more uprights or braces with no more than thirty-six (36) inches clearance from the bottom of the sign to grade. Ground signs are commonly used to sell real estate, provide directions, promote activities, or identify the name of an establishment. Ground signs may be electronic or static. Ground signs do not resemble an ornamental sign.
Lot. Means a unit of land within a subdivision occupied or designed to be occupied by a main building and the accessory buildings or uses customarily incidental to such main building, including the open spaces required by the zoning ordinance.
Master Sign. Means a sign mounted on poles that are permanently attached to the ground and that consists of three (3) or more sign faces.
Ornamental Sign. Means a sign that is constructed of concrete, wood, or fiberglass and shaped to resemble an orange, which is approximately thirty (30) inches tall and thirty (30) inches wide and weighs approximately one thousand (1,000) pounds. Ornamental sign does not include signs constructed of concrete and shaped to resemble an orange that is less than six hundred (600) pounds.
Parcel. Means a tract or plot of land of any size that has not been subdivided and may or may not be improved.
Pole Sign. Means a sign that is mounted on a freestanding pole or poles permanently attached to the ground that has one (1) or two (2) sign faces and clearance from the bottom of the sign to grade is more than thirty-six (36) inches.
Portable Sign. Means a sign that is designed to be easily transportable, including, but not limited to, signs designed to be displayed while mounted or affixed to the trailer by which it is transported, or with wheels remaining otherwise attached during display; signs mounted on transportable frames with wheels removed; signs attached or affixed to a chassis or other moveable support constructed without wheels, signs designed as, or converted to, A-frame or T-Frame signs.
Promotional Sign. Means a sign used for a temporary period to advertise a business or promote an activity and is not permanently affixed to a structure or the ground. Promotional signs include, but are not limited to: blade signs, feather flags, inflatables, air dancers, and inflatable tubes.
Public Property. Means all publicly owned property, including streets, rights-of-way, easements, and everything affixed thereto.
Sight Triangle. Means the area bounded by the street lines at corner lots and a straight line joining said street lines at points, measured along said street lines, that are twenty (20) feet distance from the point of intersection.
Sign. Means a communication device, structure, or fixture that incorporated graphics, symbols, or written copy intended to promote the sale of a product, commodity, or service, or to provide direction or identification for a premises or facility. Sign does not mean a banner, flag, historical landmark, political advertisement or message, or any signage required and/or installed by a governmental entity including, but not limited to, message boards, monuments, and scoreboards. Sign does not mean symbols, letters, or numerals that are marked, sprayed, or painted upon a public roadway as approved by a governmental entity. Sign also does not mean governmental warning devices used to alert and/or warn of road conditions, school zones, workers in the public rights-of-way or other public health and safety matters.
Sign Height. Means the vertical distance at the highest part of the sign, including the sign structure, above grade.
Sign Size. Means the square footage (maximum height above grade and maximum width) of a sign including the sign face, supporting structures and any clear space underneath the sign face.
Wall Sign. Means any sign attached to, projecting from, or painted on a wall of a building or structure so that the wall forms the supporting structure or becomes the background of the sign.

The following regulations shall apply to signs in all districts unless otherwise provided for elsewhere in this chapter:
(1)
No sign shall be erected as to prevent free ingress or egress from any door, window, or fire escape; and no sign shall be attached to a standpipe or fire escape.
(2)
All signs shall be constructed and erected in accordance with the building and electrical codes of the City of Orange. An inspection shall be conducted by the building official or his designee on all sign installations to assure the foundation sign structure, and electrical service are placed as to code.
(3)
Sign Maintenance.
(A)
All signs and their support systems shall be maintained in good repair and shall be maintained in a safe, clean, sanitary, and not offensive condition, and shall be kept free and clear of all obnoxious substances and rubbish.
(B)
Whenever a sign becomes structurally unsafe or endangers the public safety, the building official shall give written notice to the owner of the sign or the owner of the premises on which the sign is located that such sign be made safe or removed within ten (10) days.
(C)
When a sign poses an immediate danger the building official shall contact the owner of the property or, in the case of a billboard, the owner of the sign and request the sign be removed or repaired to the satisfaction of the building official within twenty-four (24) hours or the building official shall have the sign removed or repaired at the city's expense. The owner of the property or, in the case of a billboard, the owner of the billboard will be billed for all expenses incurred and will submit payment within ten (10) working days. If the owner fails to remit the expenses, the building official shall have a lien filed upon the property equal to the amount of the costs incurred for removing or repairing the sign and any expenses incurred in the collection or filing processes.
(D)
No pole sign, master sign or billboard may be located closer than fourteen (14) feet from overhead electrical conductors which are energized more than seven hundred fifty (750) volts.
(E)
All signs must be installed and maintained in a neat and workmanlike manner.
(4)
Conformance with Sign Regulations.
(A)
It shall be unlawful for any person, business entity, or corporation to erect, construct, enlarge, alter, repair, move, improve, convert, equip, use, or maintain any sign or sign structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this article.
(B)
Where a legal nonconforming sign exists at the effective date of adoption or amendment of this article that could not be erected under the terms of this article for reasons specified herein, such sign may be continued so long as it remains otherwise lawful, subject to the following provisions:
(i)
No sign may be enlarged or altered in any way which increases it nonconformity.
(ii)
Should the sign be destroyed by any means to an extent of more than fifty percent (50%) of its replacement cost at the time of destruction, it shall not be reconstructed except in conformity with the provisions of this article.
(iii)
Should the sign be moved for any reason for any distance whatever, it shall thereafter conform to the regulations after it is moved. An illegal sign which exists at the effective date of adoption or amendment of this article shall be removed.

The director of planning and community development has the responsibility for administering the sign regulations for proposed signs not specifically identified herein. The director has the authority to utilize the regulations for the most closely associated sign identified in this location.

(A)

No signs may be placed in a sight triangle.

(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Ground signs may not be more than six (6) square feet in size. The maximum sign height for a ground sign is four (4) feet above grade.
(v)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vi)
Electronic reader boards, pole signs, promotional signs, master signs, portable signs, ornamental signs, and billboards are not allowed in the R-1 zoning district.

R-3 High Density Residential Zoning District.
(A)

Single family homes, duplexes or triplexes. A ground sign may not be more than six (6) square feet. The maximum sign height for a ground sign is four (4) feet above grade.
2.
Apartment complex, townhome complex or condominium complex. A ground sign may not be more than one hundred (100) square feet in size.
(v)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(vi)
Electronic reader signs, pole signs, promotional signs, master signs, portable signs and billboards are not allowed in the R-3 zoning district.
(vii)
Two (2) ornamental signs are allowed if located at an apartment complex, townhome complex or condominium complex.
(viii)
Wall signs are prohibited at single family homes, duplexes or triplexes. If located at an apartment complex, townhome complex or condominium complex, a wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
(4)
R-4 Manufactured Housing Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way, easement, or the property.
(ii)
Ground signs may not be placed inside the sight triangle.

(B)

(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental entity and private entity owning the right-of-way, easement or the property.
(ii)
Pole signs are allowed in the sight triangle, but not in the public right-of-way or on an easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) linear feet to an adjoining residential property.
(v)
Master signs shall not be located in a sight triangle.
(vi)
Electronic reader boards shall not be located in a sight triangle.
(vii)
Promotional signs shall not be located in a sight triangle.
(viii)
A ground sign shall not be located in a sight triangle.
(ix)
Ornamental signs may be located in a sight triangle but not in the public right-of-way, sidewalk, or easement.
(C)
Manner.
(i)

For promotional signs is fifty (50) square feet.

For ornamental signs is eight (8) square feet.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which they are attached.
(v)
If the electronic reader board is used in conjunction with a master sign, the maximum size of the entire sign is six hundred (600) square feet.
(vi)
Ornamental signs are allowed in the C-1 zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after installation.
(vii)
Portable signs are not allowed in the C-1 zoning district.
(viii)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(ix)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.
2.
For a pole sign is twenty-four (24) feet above grade.
3.
For a master sign is fifty (50) feet above grade.
4.
No wall sign may be placed at a height exceeding the eaves of the building.
(x)
Number of signs allowed:
1.
A parcel or lot shall have only one (1) of the following signs located on a parcel or lot:
a.
Electronic reader board, either singularly or in conjunction with another sign.

Ground sign.
c.
Master sign.
d.
Pole sign.
2.

For static or digital billboards located on a parcel or lot adjacent, adjoining, or contiguous to Interstate 10 is six hundred seventy-two (672) square feet singularly or for each face if the faces are placed back-to-back or in a V-shaped configuration as seen from above.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
8.
For billboards located on a parcel or lot not adjacent, adjoining, or contiguous to Interstate 10, the maximum size is four hundred fifty (450) square feet.
(vi)
Ornamental signs are allowed in the IDC zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after being installed.
(vii)
Portable signs are not allowed in the IDC zoning district.
(viii)
Billboards are allowed in the IDC zoning district if the property is adjacent, adjoining, or contiguous to a state or federal highway.
1.
A billboard may not be placed on top of a building or on the side of a building.
2.
Digital billboards:
a.
The image or message shall be static or fixed and lasting no less than ten (10) seconds. Each screen message shall contain a single advertisement.
b.
The image or message shall change to another image or message in a period of two (2) seconds or less.
c.
The image or message shall not be animated, flashing, scrolling or contain video imagery.
d.
The image or message shall adjust its brightness as ambient light levels change so as not to be visually distracting.
e.
The digital billboard shall contain a default design that will freeze the sign's image or message if a malfunction occurs.
3.
All billboard signs shall meet the requirements of the State of Texas as set out in the Texas Highway Beautification Act, Texas Transportation Code, Chapter 391 and implementing regulations published in Title 43 Texas Administrative Code, Chapter 21.
(ix)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(x)

Only one (1) billboard is allowed for each business establishment located on a parcel or lot.
(11)
I-Industrial Zoning District.
(A)
Time. No limit on the amount of time a sign can be placed, except for promotional signs as provided below:
(i)
A promotional sign shall only be displayed for three (3) thirty-day periods in any twelve-month period.
(B)
Place.
(i)
No sign may be placed in a public right-of-way, public sidewalk, easement or on public property without the express written consent of the governmental and private entity owning the right-of-way or the property.
(ii)
Pole signs may be placed in a sight triangle, but not in a public right-of-way or easement, where the pole is less than twelve (12) inches in diameter and the lowest edge of the sign face is ten (10) feet or more above grade.
(iii)
No signs may be placed on a utility pole or on any tree.
(iv)
No master sign shall be closer than fifty (50) feet to an adjoining residential property.
(v)
No master sign shall be placed in the sight triangle.
(vi)
No electronic reader board shall be placed in the sight triangle.
(vii)
No promotional sign shall be placed in the sight triangle.
(viii)
No ground sign shall be placed in the sight triangle.
(ix)
Billboards are allowed in the I zoning district if located on a parcel or lot that is adjacent to, adjoining or contiguous with a state or federal highway.
(C)
Manner.
(i)
No sign may be lighted to shine on adjacent property or create a traffic hazard.
(ii)
No sign may flash on and off or have a strobe light.
(iii)
No revolving signs are allowed.
(iv)
Maximum size:
1.
For ground signs is two hundred sixty (260) square feet; however, no sign may be more than twenty-six (26) feet in width.
2.
For electronic reader boards is one hundred fifty (150) square feet.
3.
For master signs is six hundred (600) square feet.
4.
For pole signs is three hundred thirty-six (336) square feet; however, no sign may exceed fourteen (14) feet in width.
5.
For promotional signs is fifty (50) square feet.
6.
For ornamental signs is eight (8) square feet.
7.
A wall sign may not exceed more than thirty percent (30%) of the square footage of the wall to which it is attached nor may any combination of wall signs exceed thirty percent (30%) of the square footage of the wall to which it is attached.
8.
For static billboards is four hundred fifty (450) square feet.
9.
For digital billboards is two hundred sixty (260) square feet either singularly or for each face if the faces are placed back-to-back or in a V-shaped configuration as seen from above.
(v)
Ornamental signs are allowed in the I zoning district and must be completely painted with one (1) or more opaque colors within sixty (60) days after being installed.
(vi)
Portable signs are not allowed in the I zoning district.
(vii)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(viii)
Billboards.
1.
A billboard may not be placed on top of a building or on the side of a building.
2.
Digital billboards:
a.
The image or message shall be static or fixed and lasting no less than ten (10) seconds. Each screen message shall contain a single advertisement.
b.
The image or message shall change to another image or message in a period of two (2) seconds or less.
c.
The image or message shall not be animated, flashing, scrolling or contain video imagery.
d.
The image or message shall adjust its brightness as ambient light levels change so as not to be visually distracting.
e.
The digital billboard shall contain a default design that will freeze the sign's image or message if a malfunction occurs.
3.
All billboard signs shall meet the requirements of the State of Texas as set out in the Texas Highway Beautification Act, Texas Transportation Code, Chapter 391 and implementing regulations published in Title 43 Texas Administrative Code, Chapter 21.
(ix)
The minimum height for any sign hanging over a private sidewalk or walkway is seven and one-half (7.5) feet above grade.
(x)
Maximum height:
1.
A ground sign, electronic reader board, master sign, promotional sign or ornamental sign may not exceed the maximum size allowed.
2.
For a pole sign is twenty-four (24) feet above grade.
3.
For a master sign is fifty (50) feet above grade.
4.
A wall sign may not exceed the height of the eaves of the building.
(xi)
Maximum number of signs:
1.
A parcel or lot may only have one (1) of the following signs:
a.
One (1) electronic reader board, either singularly or in conjunction with another sign, is allowed for each parcel or lot.
b.
One (1) ground sign is allowed for each parcel or lot.
c.
One (1) pole sign is allowed for each parcel or lot.
d.
One (1) master sign is allowed per parcel or lot.
2.
Any number of wall signs are allowed for each wall that faces a public street so long as the total square footage of the wall signs do not exceed thirty percent (30%) of the square footage of the wall to which they are attached.
3.
Two (2) ornamental signs are allowed for each business on a parcel or lot.
4.
One (1) promotional sign is allowed for each parcel or lot.

(1)
A sign permit must be obtained from the department of planning and community development prior to the installation of a ground sign greater than six (6) square feet in size, electronic reader board, pole sign, master sign or billboard. A sign permit fee of fifty dollars ($50.00), except for promotional signs and billboards, shall be paid to the City of Orange for each sign before a sign permit may be issued. A promotional sign must obtain a permit but there is no fee. The fee for a billboard shall be as follows:
•
Total valuation of one thousand dollars ($1,000.00) or less—Twenty-five dollars ($25.00) for each inspection.
•
Total valuation of one thousand one dollars ($1,001.00) to fifty thousand dollars ($50,000.00)—Twenty-five dollars ($25.00) for the first one thousand dollars ($1,000.00) plus six dollars ($6.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including fifty thousand dollars ($50,000.00).
•
Total valuation of fifty thousand one dollars ($50,001.00) to one hundred thousand dollars ($100,000.00)—Two hundred seventy-five dollars ($275.00) for [the] first fifty thousand dollars ($50,000.00) plus five dollars ($5.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including one hundred thousand dollars ($100,000.00).
•
Total valuation of one hundred thousand one dollars ($100,001.00) to five hundred thousand dollars ($500,000.00)—Four hundred seventy-five dollars ($475.00) for the first one hundred thousand dollars ($100,000.00) plus four dollars ($4.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof, to and including five hundred thousand dollars ($500,000.00).
•
Total valuation of five hundred thousand one dollars ($500,001.00) or more—One thousand six hundred seventy-five dollars ($1,675.00) for the first five hundred thousand dollars ($500,000.00) plus three dollars ($3.00) for each additional thousand [dollars] ($1,000.00) or fraction thereof.
(2)
An inspection shall be conducted by the building official or his/her designee on all ground signs greater than six (6) square feet in size, pole sign, master sign or billboard installations to assure the foundation, sign structure, and electrical service are placed in conformance with the city's codes and ordinances.

To provide reasonable flexibility in these regulations, the zoning board of adjustment may approve an application for a sign that may not conform with the provisions of the zoning district in which it is located, where the location, size, or addition would not be inconsistent with the character of the area or neighborhood in which such sign or structure is to be located.

All signs located in a historic overlay zoning district must comply with the sign regulations provided in the historic overlay zoning district regulations.
