165.20 GENERAL

COMMERCIAL C-1 DISTRICT.

The intent of the C-1 District is to provide for a commercial area to serve the general shopping needs of the trade area and to permit uses which will strengthen the Central Business District as the center of trade, service, and governmental and cultural activities.
1.   Principal Permitted Uses. Only the following principal uses and structures shall be permitted in the C-1 District.
   A.   Residential Type Uses

Commercial Recreation - Indoor Entertainment, Sports and Recreation

Restaurant (Convenience and General)
Tavern
Visitor Habitation - Hotel/Motel or Bed and Breakfast Inn

2.   Special Exception Uses. The following uses and structures may be permitted in the C-1 District subject to review and approval of the Board of Adjustment.
   A.   Residential Type Uses
All Residential (provided that such uses be prohibited from occupying the first ground floor or basement of any structure)
Single-Unit Residential, (with no more than 50 percent of the main floor allowed for use as residential, and the property must abut a Residential Zoning District on at least one side, the front or back).
   B.   Commercial Type Uses
Agricultural Sales and Services
Commercial Recreation - Outdoor Sports and Recreation
Construction Sales and Services
Funeral Services
Research Services
Veterinary Clinic (defined as small animals)

3.   Site Development Regulations. Each development in the C-1 District shall be subject to the following minimum regulations.

Rear Yard Setback
No minimum rear yard is required unless there is no dedicated alley on the rear lot line, in which case a rear yard of 16 feet shall be provided
Side Yard Setback
No minimum side yard shall be required except when it abuts a lot zoned for residential purposes, in which case a side yard of eight feet shall be required.
Street Side Yard
No minimum

35 feet from street grade
 
4.   Off-Street Parking. Off-street parking shall be required in accordance with the provisions of Section 165.26 of this chapter.
5.   Zoning Permits Required. Zoning permits shall be required in accordance with the provisions of Section 165.30 of this chapter.
