Use Regulations

§ 171-39 Applicability of regulations.

Except as provided in this chapter, no building, structure, or land shall be used except for the purposes permitted in the district as described in this article. Any use not listed shall be construed to be prohibited. Uses permitted by right, by special permit, or by the site plan approval provisions of this chapter shall be subject, in addition to the use regulations contained in this article, to all of the other provisions of this chapter.

§ 171-40 Use regulations; interpretation of tables.

This chapter divides the Town into various zoning districts. The purposes of each district and the uses permitted in each district are outlined in the following sections of this chapter. The Tables of Use Regulations below are hereby declared to be a part of this chapter. In the tables, the following designations shall apply:
A. 
"Y" shall designate uses allowed by right in the district indicated.
B. 
"TM" shall designate uses allowed in the district indicated, but only with a special permit granted by the Town Manager, subject to the provisions of Article V.
C. 
"SP" shall designate uses allowed in the district indicated, but only with a special permit from the Planning Board, subject to the provisions of Article V.
D. 
"SPA" shall designate uses allowed in the district indicated, but only with site plan approval from the Planning Board, subject to the provisions of Article V.
E. 
"SP/SPA" shall designate uses allowed in the district indicated, but only with special permit and site plan approval from the Planning Board, subject to the provisions of Article V.
F. 
"N" shall designate uses not allowed in the district indicated.

§ 171-41 Accessory uses.

A. 
Any use which is accessory to a principal use allowed by right shall be allowed only in connection with such allowed principal use. Any use which is accessory to a principal use allowed by special permit, and which is not specifically included in the original special permit, shall be allowed only after issuance of a new special permit. Cessation of a principal use shall require cessation of any accessory use which is not otherwise allowed as a principal use. The Building Inspector shall be responsible for determining what uses are principal and what uses are accessory.
B. 
A use, whether or not on the same parcel as activities permitted as a matter of right, accessory to activities permitted as a matter of right, which activities are necessary in connection with scientific research or scientific development or related production, may be permitted upon the issuance of a special permit, provided the Planning Board finds that the proposed accessory use does not substantially derogate from the public good.

§ 171-42 Temporary events.

A temporary event or use occurring on a parcel or parcels of land located in a zoning district in which such event or use is not permitted may be permitted by the Town Manager in accordance with the regulations as established by the Town Manager for such events.
