165.17 A-1

AGRICULTURAL DISTRICT.

   1.   Statement of Intent. The A-1 District is intended and designed to preserve and protect those agricultural and undeveloped lands within the City that are not expected to develop in urban uses in the immediate future.

   3.   Permitted Accessory Uses and Structures.
      A.   Uses and structures clearly incidental and necessary to the permitted principal uses or structures of this district, not involving the conduct of business on the premises, except home occupations located on the same lot or a contiguous lot under the same ownership.
      B.   Farm structures incidental to agricultural uses.
      C.   Private garages, carports, swimming pools, and tennis courts not operated for commercial purposes.
      D.   Temporary structures and equipment used in conjunction with construction work, provided that such structures and equipment are removed promptly upon completion of the construction work.
      E.   Roadside stands for the sale of produce raised on the premises.
   4.   Special Exception Uses and Structures. Subject to Section 165.12 and other requirements contained herein, the Board of Adjustment may permit the following:
      A.   Agricultural service businesses that produce no offensive noise, vibration, smoke, dust, odor, heat, glare, or electrical interference detectable within the limits of the nearest dwelling other than that of the owner or operators and that one parking space for each employee and one space for each vehicle used by the business and seven customer parking spaces be provided.
      B.   Concrete or asphalt mixing or batching plants for temporary use during construction, repair, or maintenance of public roads, highways, or other public facilities, provided that the area be restored to a suitable condition free of refuse or debris.
      C.   Mining, quarrying, lumbering, and extraction of minerals raw materials including facilities for storing and transporting such materials; provided that such use shall not adversely affect surrounding properties; that one parking space for each employee and each vehicle used by the operation be provided; that prior approval of the special exception plan be submitted to and approved by the Board of Adjustment for restoration of the area to a condition compatible with the surrounding area upon conclusion of the operation.
      D.   Tourist campground provided that water and sewage disposal systems are approved by the City or County Board of Health; drives shall have all-weather surface; that no campsite is closer than 50 feet to any property line; and that five parking spaces plus one for each campsite be provided.
      E.   Animal hospital or clinic with one parking space per employee plus four additional spaces.
      F.   Airports with one parking space per employee plus one space per hanger space.
      G.   Commercial roadside stands with three parking spaces.
      H.   Home occupations.
      I.   Height Limitations Greater than 35 Feet. Any structures higher than 35 feet shall require their own fire protection system in accordance with State Fire Marshal recommendations.

*When a lot is adjoining a residential use or residential zoned lot the side yard setback shall be a minimum of 25 feet.
   6.   Poultry, livestock, or fur bearing animals shall be kept a minimum distance of 1,000 feet from the nearest residential development. This does not apply to the usual keeping of household pets not for commercial use.
