165.21 C-1

COMMERCIAL CENTRAL BUSINESS DISTRICT.

   1.   Statement of Intent. The C-1 Central Business District is intended to accommodate general retail and professional office uses and promote the efficient and compact development of the Central Business District, the area to which the use of this district is limited.
   2.   Permitted Uses and Required Parking.

   3.   Permitted Accessory Uses and Structures.
      A.   Uses and structures clearly incidental and necessary to the permitted principal uses or structures of this district.
      B.   Accessory uses and structures applicable to any existing residence providing compliance with all residential requirements.
      C.   Storage warehouses used in conjunction with the permitted principal uses or structures of this district.
      D.   Temporary structures and equipment used in conjunction with construction work, provided that such structures and equipment are removed promptly upon completion of the construction work.
      E.   Structures attached to the principal structure shall be considered part of the principal structure and shall conform to the same front, side, and rear setback yard regulations if required.
   4.   Special Exception Uses and Structures. Subject to Section 165.13(5) and other requirements contained herein, the Board of Adjustment may permit the following:
      A.   Anything permitted in an R-1 District provided that all requirements are in compliance for an R-1 District.
      B.   With the exception of churches, anything permitted in an R-2 District provided that all requirements are in compliance for an R-2 District.
      C.   Multi-family dwellings or apartments on the ground level floor of a commercial building provided that the building has remained vacant for a two-year period and that there is off-street parking available of two spaces per unit.
      D.   Wholesale business.
      E.   Bus terminals.
      F.   Entertainment facilities.
      G.   Height limitations greater than 35 feet. Any structure higher than 35 feet shall require their own fire protection system in accordance with State Fire Marshal recommendations.
      H.   Drive-through establishment.
   5.   Bulk Regulations.

   6.   Special Requirements.
      A.   The C-1 District shall observe the fencing and shrubbery requirements as prescribed in Section 165.26.
      B.   Overhead or area light fixtures shall be located and focused so as to avoid casting direct light upon any adjacent residential property, or interfere with a traveled portion of a public street.
      C.   Construction and alterations within the Fire Zone as established by Chapter 164 must comply with the code regulations.
      D.   For requirements pertaining to awnings, encroaching steps and other openings and enclosures see Sections 136.14, 136.15, and 136.16.
      E.   Galvanized metal is not a permissible building material.
