ZONING DISTRICTS

AND MAP

§ 155.020 ESTABLISHMENT OF DISTRICTS.

   For the purpose of this chapter, the city is divided into the following districts.
   (A)   Floodplain District. Floodplain District (overlay District).
   (B)   Residential Districts.
      (1)   R-1 Agriculture/Residential District
      (2)   R-2 One and Two-Family Residential District
      (3)   R-3 Multiple Residential District
      (4)   R-4 Manufactured Home Park District
   (C)   Commercial Districts.
      (1)   C-1 Recreation Commercial District
      (2)   C-2 Highway Commercial District
      (3)   C-3 General Business District
   (D)   Industrial District. I-1 General Industrial District.
   (E)   Planned Unit Development.
      (1)   PUD Planned Unit District, General
      (2)   PUD-R Planned Unit District, Residential
      (3)   PUD-B Planned Unit District, Business
      (4)   PUD-I Planned Unit District, Industrial

§ 155.021 ZONING MAP.

   (A)   The boundaries of the districts established by this chapter are delineated on the Zoning Map; the map and all notions, references and data shown thereon are hereby adopted and made part of this    chapter and will be on permanent file and for public inspection in the office of the Zoning Administrator.
   (B)   If, in accordance with the provisions of this chapter, changes are made in district boundaries or other matter portrayed on the Official Zoning Map, the changes shall be made on the Map within 30 days after official publication of the amendment.
   (C)   No changes of any nature shall be made in the Official Zoning Map or matter shown thereon except in conformity with the procedures set forth in this chapter. Any unauthorized change of any kind by any person shall be considered a violation of this chapter and punishable as provided by the terms of § 10.99.
   (D)   The Official Zoning Map on record in the Office of the Zoning Administrator shall be the final authority as the current zoning status of land and water areas, buildings and other structures in the city.

§ 155.022 DISTRICT BOUNDARY LINES.

   Wherever any uncertainty exists as to the boundary of any use district as shown on the Zoning Map incorporated herein, the following rules shall apply.
   (A)   Where district boundary lines are indicated as following streets, highways, alleys, railroads, or similar rights-of-way, they shall be construed as following the centerlines thereof.
   (B)   Where district boundary lines are indicated as approximately following lot lines or section lines, the lines shall be construed to be the boundaries.
   (C)   Where district boundary lines are indicated as parallel to or extensions of features indicated above in this section, it shall be so construed.
   (D)   Distances not specifically indicated on the Official Zoning Map shall be determined by the scale of the map.
   (E)   Where physical or cultural features existing on the ground are at variance with those shown on the Official Zoning Map, or in other circumstances not covered by this section, the Board of Adjustment shall interpret the district boundaries.
   (F)   Where a platted lot held one ownership of record and at the effective date of this chapter is divided by a district boundary line, the entire lot shall be construed to be within the least restrictive district.

§ 155.023 ANNEXATIONS.

   All territory hereafter annexed to the city which is not shown on the Official Zoning Map as part of this chapter, shall automatically, upon annexation, be classified within the R-1 Agriculture/ Residential District, and shall be subject to all regulations, notations, references and conditions applicable to that zone until such time that a determination may be made as to the proper district classification and on amendment to this chapter made to that effect.

§ 155.024 SHORELAND DESIGNATION.

   (A)   Shoreland regulations shall apply to all lands located within 300 feet of all rivers and streams, except where the waters involved are bounded by natural topographic divides which extend landward from the waters for lesser distances. The following river and stream have been classified as Natural Environment Streams by the State Commissioner of Natural Resources, and the Fillmore County Board of Commissioners.
      (1)   Camp Creek: Section 5 - Township 102 W - Range 10 N.
      (2)   Root River, South Branch: Sections 5 - 6, Townships 102 W - Range 11 N Section 1 - Township 102 W - Range 11 Z
   (B)   Shoreland development standards are set forth in § 155.195 of this chapter.
