R-1 AGRICULTURE/RESIDENTIAL

DISTRICT

§ 155.035 PURPOSE.

   This district is established to preserve the present agricultural lands and maintain other lands in a natural state, and permit low density residential development where the development is in accordance with the land use plan and where municipal utilities are economically available.

§ 155.036 PERMITTED PRINCIPAL USES.

   (A)   Within an R-1 District, unless otherwise provided by this chapter, no building or land shall be used except for the following.
      (1)   One-family detached dwellings and manufactured homes which are not less than 20 feet in width regardless of construction type.
      (2)   Agriculture, farming and truck gardening provided that no agricultural building or accessory feedlot shall be located within 100 feet of any lot line abutting residential property.
      (3)   Churches, libraries, museums, schools, public buildings, memorial structures, water supply facilities and cemeteries, provided that no building shall be located within 50 feet of any lot line of an abutting lot within any R-2 Residential District.
      (4)   Uses permitted in §§ 153.004 through 153.010.
      (5)   Townhouses, cluster housing and patio homes, and the like, as provided in §§ 155.165 through 155.170, Planned Unit Development.
      (6)   Railroad rights-of-way, but not including switching, storage, freight yards, shops or industrial sidings.
      (7)   Nurseries and greenhouses for growing plants.
   (B)   Height, area, yard regulations shall be as permitted and regulated in the Appendix: Height, Area, Yard Regulations.

§ 155.037 PERMITTED ACCESSORY USES.

   The following shall be permitted accessory uses in the R-1 District.
   (A)   Private garages and carports.
   (B)   Private recreation facilities such as tennis courts and swimming, pools provided that the pool is completely enclosed within a chain link or similar fence at least five feet in height, for the use and convenience of the residents.
   (C)   Tool houses and sheds or similar storage buildings for domestic supplies.
   (D)   Boarding or rental of rooms to not more than two persons.
   (E)   Signs as permitted and regulated in § 155.190 of this chapter.
   (F)   Home occupations as defined in § 155.006.

§ 155.038 PERMITTED CONDITIONAL USES.

   The following uses are permitted if granted a conditional use permit as provided in §§ 155.250 through 155.254.
   (A)   Municipal administration buildings, police and fire stations, libraries, museums, art galleries, post offices, and other municipal service buildings except those customarily considered industrial in use, providing that no building shall be located within 50 feet of any lot in a residential district.
   (B)   Water supply buildings, reservoirs, wells, elevated tanks and similar essential public utility and service structures.
   (C)   Golf clubhouse, country club, public swimming pool, private swimming pool serving more than one family, provided that no principal structure shall be located within 50 feet of any lot in a residential district.
   (D)   Offices of professional persons as a home occupation.
   (E)   Two-family residences.
   (F)   Mineral, stone or gravel extraction as permitted and regulated in § 155.191.
   (G)   Riding stables and academies.
   (H)   Temporary equipment placement and operations as regulated in §§ 155.180 through 155.217.
   (I)   Uses similar to those listed in § 155.036(A) which would be in accord with the purpose of the R-I District.
   (J)   Manufactured home parks.
   (K)   Bed and breakfast as defined in § 155.196.
   (L)   Home occupations as defined in § 155.197.
