Fairway Avenue Construction Off-Site Impact Fees
The purpose of this Article is to set forth certain fees for the construction of Fairway Avenue as directly serving and benefiting the Palomino Park, Knollridge, Kings Crown Mobile Home Park and Shetland Acres Subdivisions. (Prior code 17.17.100)
The Fairway Avenue construction off-site impact fee shall apply in the following subdivisions to all building permits issued after the effective date of the initial ordinance codified herein:
(1)
Palomino Park Filing 1 as recorded with the County Clerk and Recorder's Office as Reception No. 267464, presently approved for thirty-nine (39) units.
(2)
Palomino Park Filing 2 as recorded with the County Clerk and Recorder's Office as Reception No. 285775, presently approved for forty-seven (47) units.
(3)
Palomino Park Filing 3 as recorded with the County Clerk and Recorder's Office as Reception No. 290972, presently approved for forty-six (46) units.
(4)
Palomino Park Filing 4 as recorded with the County Clerk and Recorder's Office as Reception No. 324153, presently approved for seventy (70) units.
(5)
Kings Crown Mobile Home Park as recorded with the County Clerk and Recorder's Office as Reception No. 263995, presently approved for one hundred three (103) units.
(6)
Kings Crown Mobile Home Park future phase contemplated for one hundred thirty-seven (137) units.

Knollridge PUD Filing No. 1 as recorded with the County Clerk and Recorder's Office as Reception No. 310689 and Knollridge PUD Filing No. 2 as recorded with the County Clerk and Recorder's Office at Reception No. 322725; the Knollridge PUD by Ordinance No. 44, Series 1997 (see Article XV above), has been divided into the following development areas:
a.
Development Area 1 with twenty-four (24) existing units and an additional seventy-three (73) proposed units.
b.
Development Area 2 with twelve (12) existing units and thirty-seven (37) additional proposed units.
c.
Development Area 3 with forty-four (44) proposed units.
d.
Development Area 4 with fifty (50) proposed units.

Shetland Acres Phase 1 as recorded with the County Clerk and Recorder's Office as Reception No. 481225, with nineteen (19) existing units and thirty-nine (39) proposed units. (Prior code 17.17.110)
The cost per single-family or multi-family dwelling unit in each of the subdivisions referenced in Section 16-16-20 above for Fairway Avenue construction off-site impact fees shall be as set forth in Appendix A to this Code. This fee is due and payable at the time of the application for any building permit within any of the developments referenced above; provided, however, that the Fairway Avenue construction off-site impact fees for the Knollridge Development Areas 1 through 4 shall be as set forth in Section 16-15-160 of this Chapter. The fees set forth in Appendix A to this Code shall automatically escalate at the rate of six percent (6%) per annum commencing January 1, 1999, unless otherwise increased or decreased by resolution adopted by the City Council. (Prior code 17.17.130; Ord. 4 §1, 2005)
The fees set forth in Appendix A to this Code are based upon the construction of the maximum number of units permissible or established under existing zoning regulations existing with the Palomino Park, Kings Crown Mobile Home Park and Shetland Acres developments on the effective date of the initial ordinance codified herein. In the event the density reflected in Section 16-16-20 above is modified or if any portion of the above-referenced subdivisions are replatted with either an increase or decrease in density, the fees per unit or on a per-lot basis within the affected subdivisions shall be decreased or increased accordingly. This process is designed to ensure that the necessary amount of fees collected by the City from each multi-family lot within each of the subdivisions or from the estimated number of single-family lots within each subdivision are sufficient to enable the City to construct and complete Fairway Avenue, and to ensure that all individuals and entities benefited by the construction of Fairway Avenue pay their proportionate fair share. The fees collected pursuant to this Article shall, for bookkeeping purposes, be separately accounted for and expended only for purposes intended by this Article. (Prior code 17.17.150)
