CHAPTER 2

DISTRICTS; MAP

10-2-1: DISTRICTS ESTABLISHED:

In order to carry out the purposes and provisions of this zoning code, the village is hereby divided into the following districts:
   R-1   Residential district, low density
   R-2    Residential district, medium density
   R-3    Residential district, high density
   B-1    Central business district
   B-2    General retail business district
   I-1    Industrial district

10-2-2: MAP:

The locations and boundaries of the districts herein established are shown upon the map entitled official "village of Roanoke zoning map", which with all notations, references, and information thereon, is hereby made a part of this zoning code by reference. A copy of the zoning map shall be on file with and available for inspection from the village clerk or the zoning officer. (Ord. 2005-04, 5-16-2005)

10-2-3: ANNEXED LAND:

Land which may be annexed to the village shall be classified in accordance with the following schedule until such time as the village board changes the classification in accordance with the provisions of their ordinance.
   County Zoning Classification   Roanoke Classification
      Residential AS   R-1
      Residential CS   R-2 and R-3
      Commercial   B-2
      Industrial   I-1
      Agriculture   R-1
      Conservation A   R-1
      Conservation B   R-1
Should the county revise its zoning classifications, the classification equivalent or most similar to the previous zoning classification shall apply. If land is not classified under one of the county classifications listed above or if no equivalent or similar classification exists, the land shall be annexed as an R-1 district. 10-2-4: ZONING OF PUBLIC WAYS:

All streets, alleys, public ways, and rights of way, including railroad rights of way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting such street, alley, public way, or right of way. Where the centerline of a street, alley, public way, or right of way serves as a district boundary, the zoning of such areas, when not otherwise specifically designated, shall be deemed to be the same as that of the abutting property up to such centerline. Whenever any street, alley, public way, or right of way is vacated, the zoning district abutting each side of such street, alley, public way, or right of way shall be automatically extended to the centerline of such a vacation, and all area included in the vacated area shall thereafter be subject to all appropriate regulations of the extended districts. 10-2-5: INTERPRETATION OF DISTRICT BOUNDARIES:

Where uncertainty exists as to the boundaries of districts as shown on the zoning map, the following rules shall apply:
   (A)   Boundaries indicated as approximately following the centerlines of streets, alleys, public ways, or rights of way shall be construed to follow such centerlines.
   (B)   Boundaries indicated as approximately following recorded lot lines shall be construed as following such lot lines.
   (C)   Boundaries indicated as approximately following village limits shall be construed as following such village limits.
   (D)   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
   (E)   Boundaries indicated as approximately following the centerlines of streams, rivers, canals, drainageways, lakes, or other bodies of water shall be construed to follow such centerlines.
   (F)   Boundaries indicated as parallel to or extensions of features indicated in subsections (A) through (E) of this section shall be so construed. Distances not specifically indicated on the zoning map shall be determined by the scale of the map.
   (G)   Where physical or cultural features existing on the ground are different than those shown on the zoning map or in other circumstances not covered by subsections (A) through (F) of this section, the zoning board shall interpret the district boundaries. (Ord. 2005-04, 5-16-2005)
