CHAPTER 4

R-1 RESIDENTIAL DISTRICT, LOW DENSITY

10-4-1: PURPOSE:

The R-1 residential district includes those portions of the village developed predominantly with one-family dwellings on individual lots where it is deemed desirable to maintain and encourage this pattern of development, or those undeveloped portions of the village in which it is deemed desirable to encourage this pattern of predominant land usage and density of population. 10-4-2: PERMITTED USES:

No building or premises shall be used and no building shall be hereafter erected or altered within any R-1 residential district, unless otherwise provided for in this zoning code, except for the following uses:
Churches; temples; other places of public worship, so long as they are of a permanent type of construction and affixed to a permanent site.
Customary accessory uses, including private garages.
Customary home occupations, but not including the conduct of a retail or wholesale business or manufacturing business.
Farming, gardening, horticultural nurseries, but not including the raising, housing, pasturing or keeping of bees, fowl or livestock.
Libraries; public museums.
One-family dwellings.
Parks, recreation areas, recreation buildings operated by a unit of government; government buildings but not including storage yards or buildings for the housing of trucks, contractors' equipment, poles, pipe, road building materials, or similar materials.
Public or private schools offering general instruction between kindergarten and twelfth grade levels; public or private colleges offering courses leading toward an associate, baccalaureate or advanced degree in arts or science or comparable recognized degree.
Temporary buildings, structures and uses incidental to construction on the site, for a period not to exceed one year. (Ord. 2005-04, 5-16-2005)

10-4-3: HEIGHT:

No building shall hereafter be erected or altered to exceed thirty five feet (35') in height. Furthermore, accessory buildings, utility sheds and television discs shall not exceed twenty feet (20') in height. (Ord. 2005-04, 5-16-2005)

10-4-4: LOT SIZE:

Every building hereafter erected shall be on a lot having an area not less than six thousand (6,000) square feet, a lot width measured along the front setback line of not less than sixty feet (60'), and a lot depth of not less than one hundred feet (100'), measured along a line midway between the side lot lines perpendicular to the front lot line; provided, however, that where a lot is smaller than herein required, and was of record at the time of the passage of this zoning code, said lot may be occupied by not more than one 1-family dwelling. 10-4-5: YARDS:

No principal building shall hereafter be erected or enlarged unless the following yards are provided and maintained in connection with such buildings:
   (A)   Front yard not less than twenty five feet (25') in depth, unless forty percent (40%) of the block frontage is improved with buildings that have observed a greater or lesser depth of front yard, in which instance no new buildings or portion thereof shall project beyond a straight line drawn between the points closest to the front property line of the two (2) nearest residences, but this regulation shall not be interpreted to require a front yard of more than fifty feet (50') nor to permit a front yard of lesser depth than that of the nearest building. Where the street is curved, the line shall follow the curve of the street rather than to be a straight line.
   (B)   A side yard on each side not less than ten percent (10%) of the width of the lot.
   (C)   A rear yard having a depth of not less than twenty five feet (25').
   (D)   Any addition to an R-1 structure as described herein, enclosed or open, of whatever nature, which is an attached part of the main structure, must conform to the setback requirements of rear, side and front yards set forth in this chapter. (Ord. 2005-04, 5-16-2005)

10-4-6: BUILDING, COVERAGE:

No building, with any accessory structure, shall occupy in excess of thirty seven percent (37%) of the area of an interior lot, nor more than forty percent (40%) of the area of a corner lot. Additionally, any accessory building, utility shed, or television disc, is subject to the same requirements. Furthermore, buildings, accessory structures, utility sheds and television discs must meet the following requirements:
   (A)   Shall not be permitted on the front or side yard area so defined in subsection 10-4-5(A) or (B) of this chapter.
   (B)   Must be at least ten feet (10') from the rear lot line.
   (C)   Any television disc erected within the village may be placed in the backyard of the residence only in accordance with the additional requirements and restrictions of this code and the various yard and lot use restrictions which are a part of said code.
   (D)   In order to erect a television disc on any property within the village, said person desiring to erect such television disc must obtain a zoning use permit to do so from the zoning officer and the cost of said erection permit will be five dollars ($5.00).
   (E)   No more than one residential dwelling shall be built on any individual "lot" as defined in both this zoning code and the subdivision code. (Ord. 2005-04, 5-16-2005)

10-4-7: HABITABLE FLOOR AREA:

No one-story dwelling shall hereafter be erected with a habitable floor area of less than seven hundred fifty (750) square feet.
No two-story dwelling shall hereafter be erected with a habitable floor area of less than one thousand three hundred (1,300) square feet. (Ord. 2005-04, 5-16-2005)

10-4-8: OFF STREET PARKING AND LOADING:

Off street parking and loading in the R-1 residential district shall be provided in accordance with the regulations set forth in chapter 10 of this title. Furthermore, not more than one of the following listed vehicles may be parked off the properly designated driveway or off street parking area for a lot in an R-1 residential district in the side yard or rear yard of a lot: a camper, camping trailer, camping bus, motor home, boat, boat trailer, house trailer, trailer coach, tourist home, or similar vehicle. A vehicle that is parked off the properly designated driveway or off street parking area under this provision must be unoccupied and shall not project beyond the front of either the structure or the garage on the lot. Furthermore, nothing in this section shall permit vehicles not specifically listed herein to park off the properly designated driveway or off street parking area for the lot. (Ord. 2005-04, 5-16-2005)
