CHAPTER 7

B-1 CENTRAL BUSINESS DISTRICT

10-7-1: PURPOSE:

The B-1 central business district is established solely for the village's downtown business area to allow for the grouping of businesses compatible to the downtown area as a means to serve these businesses, create convenience for the public, and to discourage unsightly or inefficient business development in the downtown area while encouraging continued use, vitality, and development of the downtown area. 10-7-2: PERMITTED USES:

No building or premises shall be used and no building shall be hereafter erected or altered within any B-1 central business district, unless otherwise provided in this zoning code except for the following uses:
Any use permitted in the R-3 residential district, subject to the restrictions therefor set forth in chapter 6 of this title; however, the first floor of any building having a store front, which includes any large window or open viewing area whether such area is clear, translucent, or covered in any manner, on a roadway or pedestrian walkway shall not be occupied as a residence.
Bakeries employing not more than eight (8) persons.
Banks and financial institutions.
Barbershops, beauty parlors.
Business and professional offices.
Catering establishments.
Comfort stations.
Dancing academies.
Dressmaking establishments, employing not more than eight (8) persons.
Employment agencies.
Food, beverage, and drug: grocery stores, supermarkets, meat markets, dairy stores, liquor stores, pharmacies, drugstores, taverns, restaurants, lunchrooms and cafeterias, and places for the sale and consumption of soft drinks, juices, ice cream and beverages of all kinds, including alcoholic beverages, but excluding drive-ins.
General merchandise stores; department and variety stores.
Hotels.
Laundries or dry cleaning plants employing not more than eight (8) persons.
Locksmith shops.
Lodge and meeting halls.
Messenger and communication services.
Millinery and hat shops.
Painting and decorating shops.
Photography studios.
Plumbing, electrical, and heating and air conditioning shops.
Printing shops.
Public services: government offices and buildings; post office; and libraries.
Repair shops and services for home appliances, employing not more than eight (8) persons.
Sharpening or grinding shops.
Shoe repair shops.
Specialty shops: apparel and accessory stores, shoe stores, jewelers, retail florists, gift shops, book and stationery stores, camera and photography shops, sporting good stores, tobacco shops, art supply stores, galleries, furniture and carpet stores, music stores, telecommunications, paint and wallpaper stores, hardware stores, appliance dealers, antiques stores, and toy stores.
Studios.
Tailor shops employing not more than five (5) persons.
Undertaking establishments and funeral parlors.
Upholstery shops. (Ord. 2005-04, 5-16-2005)

10-7-3: PERMITTED SPECIAL USES:

The following uses shall be permitted by special use permit only upon the review of an application at a public hearing and the subsequent approval of the detailed site plans by the Zoning Board and the Village Board as set forth in chapter 12 of this title:
Public parking garages; auto repair, auto body, or auto detailing shops; and auto parts and accessories retail. No banners, flags, pennants, whirligigs or other advertising devices shall be permitted. All products or parts for sale shall be stored and displayed only within the building or in permanent storage cabinets, the location of which shall be shown on the site plan. No such use shall be approved within three hundred feet (300') of any church or public park. The Zoning Board shall find that the entrances and exits thereto will not create any undue hazard to vehicles or pedestrians; that such establishments have adequate off-street car waiting space for the type of establishment involved; and that there will be adequate supervisory personnel on the premises at all times that the establishment is open to the public.
Self-service laundromats (a self-service laundry with user- paid or coin-operated washers and driers).
An application for a "permitted special use" set forth above in this section shall require the submission of the applicable initial special use permit fee as provided in section 10-13-5 of this title. However, the permit for a "permitted special use" shall be valid for the duration of the applicant's control of the premises as long as the permitted use continues, without the need to annually renew the special use permit or to annually pay the special use renewal fee. Any successor in interest in the use of the property will be required to submit a new application for the "permitted special use" with the applicable initial special use permit fee. However, in all other aspects, chapter 12 of this title will govern the review and issuance of a special use permit for a "permitted special use". (Ord. 2017-11, 11-6-2017)

10-7-4: HEIGHT:

No building, whether a one-family or multi-family residence, sheltered care home or nursing home or business building, shall hereafter be erected or altered to exceed fifty four feet (54') in height. (Ord. 2005-04, 5-16-2005)

10-7-5: YARDS, COURTS, COVERAGE:

   (A)   There shall be a rear yard of not less than ten percent (10%) of the depth of the lot; provided, however, it need not exceed ten feet (10') in depth.
   (B)   No side yards are required, but if provided, a side yard shall be not less than eight feet (8') in width.
   (C)   No front yard is required.
   (D)   If an outer court is provided, it shall be not less than five feet (5') wide, nor shall its area be less than one-sixth (1/6) the length of such court from the closed end.
   (E)   If an inner court is provided, it shall be not less than six feet (6') wide, nor shall its area be less than twice the square of its least required dimension.
   (F)   No building with its accessory buildings, to be used for commercial purposes, shall occupy in excess of ninety percent (90%) of the lot area, and accessory structures shall not be located closer than five feet (5') to any boundary lot line.
   (G)   Notwithstanding any of the requirements in this section, buildings used in whole or in part for residential purposes shall conform to the yard, floor area ratio and density restrictions for such buildings in chapter 4 of this title for one-family dwellings, in chapter 5 of this title for duplexes, and in chapter 6 of this title for multi-family dwellings, as appropriate. 10-7-6: OFF STREET PARKING AND LOADING:

Off street parking and loading in the B-1 Central Business District shall be provided in accordance with the regulations set forth in chapter 10 of this title. (Ord. 2005-04, 5-16-2005)
