Standards to which duplexes shall comply:
(A) Lot Size: No duplex shall hereafter be erected, and no existing building shall be converted to any such use unless the lot shall have an area of at least ten thousand five hundred (10,500) square feet.
(B) Floor Area Ratio: Irrespective of the number of floors in a building or a series of buildings on the same lot, the sum of the total area of all floors shall not exceed fifty percent (50%) of the area of the lot.
(C) Density: No duplex shall hereafter be erected or altered to accommodate or make provision for more than two (2) families as a "family" is defined in section
10-1-4 of this title, with a minimum of seven hundred fifty (750) square feet of habitable floor area per dwelling unit not including any basement or cellar where more than fifty percent (50%) of the total area of that cellar or basement is below ground level.
(D) Building Height: No duplex shall hereafter be erected or altered to exceed thirty five feet (35') in height.
(E) Side Yard: On each side of the building, there shall be a side yard having a width of not less than ten percent (10%) of the width of the lot, or one-fifth (1/5) the building height, whichever is greater.
(F) Rear Yard: There shall be a rear yard having a depth of not less than fifteen percent (15%) of the lot depth but not less than twenty five feet (25') in depth, whichever is greater.
(G) Front Yard: There shall be a front yard along such abutting street having a depth of at least twenty five feet (25') measured from the right of way line.
(H) Site Plan Approval: Before any permit shall be issued for a duplex in this district, the site plans therefor shall be submitted to the zoning board for approval. Such site plans shall show: lot lines; building placement; width of bounding streets and type of pavement; location and size of water lines and sewer lines serving the property; location of off street parking with access drives; heights of buildings or parts thereof; landscaping; surrounding land uses, and such other details as the zoning board may require in its deliberation.
In its deliberation, the zoning board shall give due consideration to the probable effect the proposal would have on surrounding land uses; the adequacy of existing water and sewer utilities serving the site; the relation of the building height and mass to surrounding structures; and the effect the project will have as a traffic generator on streets giving access to the site.
The zoning board may approve the plans, as submitted, subject to modification, or may disapprove the plan. Its decision in each case shall be in writing and set forth in the minutes of the zoning board, with copies to the applicant, the zoning officer, and the village board. Once the site plan has been approved by the zoning board, the grading or elevation of said site may not be altered in any way unless specifically approved by the zoning board.
