CHAPTER 6

R-3 RESIDENTIAL DISTRICT, HIGH DENSITY

10-6-1: PURPOSE:

The R-3 residential district, high density is established to accommodate a wide variety of family dwellings and similar residential uses while providing for the continued growth of the village. (Ord. 2005-04, 5-16-2005)

10-6-2: PERMITTED USES:

No building or premises shall be used and no building shall be hereafter erected or altered within any R-3 residential district, unless otherwise provided for in this zoning code, except for the following uses:
Any use permitted in the R-1 residential district and the R-2 residential district, subject to the restrictions of those districts.
Multi-family residences; sheltered care homes; nursing homes, subject to the restrictions herein set forth for such uses. (Ord. 2005-04, 5-16-2005)

10-6-3: PERMITTED SPECIAL USES:

The following uses shall be permitted by special use permit only upon the review of an application at a public hearing and the subsequent approval of the detailed site plans by the zoning board and the village board as set forth in chapter 12 of this title:
One or more of the following uses may be established clearly incidental to a multi-family residence, sheltered care home or nursing home: restaurant, office of doctor or dentist, or similar practitioner in the healing arts. Such incidental use shall be allowed only if it is primarily for the use and benefit of the occupants of the principal use.
An application for a "permitted special use" set forth in this section shall require the submission of the applicable initial special use permit fee as provided in section 10-13-5 of this title. However, the permit for a "permitted special use" shall be valid for the duration of the applicant's control of the premises as long as the permitted use continues, without the need to annually renew the special use permit or to annually pay the special use renewal fee. Any successor in interest in the use of the property will be required to submit a new application for the "permitted special use" with the applicable initial special use permit fee. However, in all other aspects, chapter 12 of this title will govern the review and issuance of a special use permit for a "permitted special use". (Ord. 2005-04, 5-16-2005)

10-6-4: STANDARDS:

Standards to which multi-family residences, sheltered care homes and nursing homes shall comply:
   (A)   Lot Size: No multi-family residence, sheltered care home or nursing home shall hereafter be erected, and no existing building shall be converted to any such use unless the lot shall have an area of at least ten thousand five hundred (10,500) square feet.
   (B)   Floor Area Ratio: Irrespective of the number of floors in a building or a series of buildings on the same lot, the sum of the total area of all floors shall not exceed fifty percent (50%) of the area of the lot.
   (C)   Density: No multi-family residence shall hereafter be erected or altered to accommodate or make provision for more than the following number of families: two (2) families for the first ten thousand five hundred (10,500) square feet of lot area, plus two thousand (2,000) square feet of lot area for each of the next two (2) families and three thousand (3,000) square feet of lot area for each additional family. Additionally, each dwelling unit shall have a minimum of seven hundred (700) square feet of habitable floor area not including any basement or cellar where more than fifty percent (50%) of the total area of that cellar or basement is below ground level.
   (D)   Building Height: No building shall hereafter be erected or altered to exceed fifty four feet (54') in height.
   (E)   Side Yard: On each side of the building, there shall be a side yard having a width of not less than ten percent (10%) of the width of the lot, or one-fifth (1/5) the building height, whichever is greater.
   (F)   Rear Yard: There shall be a rear yard having a depth of not less than fifteen percent (15%) of the lot depth but not less than twenty five feet (25') in depth, or one-third (1/3) the building height, whichever is greater.
   (G)   Front Yard: There shall be a front yard along each abutting street having a depth of at least twenty five feet (25') measured from the right of way line.
   (H)   Site Plan Approval: Before any permit shall be issued for a multi-family residence, sheltered care home or nursing home in this district, the site plans therefor shall be submitted to the zoning board for approval. Such site plans shall show: lot lines; building placement, width of bounding streets and type of pavement; location and size of water lines and sewer lines serving the property; location of off street parking with access drives; heights of buildings or parts thereof; landscaping; surrounding land uses; such other details as the zoning board may require in its deliberation.
In its deliberation, the zoning board shall give due consideration to the probable effect the proposal would have on surrounding land uses; the adequacy of existing water and sewer utilities serving the site; the relation of the building height and mass to surrounding structures; and the effect the project will have as a traffic generator on streets giving access to the site.
The zoning board may approve the plans, as submitted, subject to modification, or may disapprove the plan. Its decision in each case shall be in writing, and set forth in the minutes of the zoning board, with copies to the applicant, the zoning officer, and the zoning board. Once the site plan has been approved by the zoning board, the grading or elevation of said site may not be altered in any way unless specifically approved by the zoning board. 10-6-5: OFF STREET PARKING AND LOADING:

For a multi-family residence, off street parking for at least two (2) cars for each dwelling unit on the same or an adjacent lot shall be provided. For a sheltered care home or nursing home, one car space for each employee per shift plus one car space for each four (4) residents' accommodations shall be provided. In addition, if one or more permitted special uses are authorized by the village board, additional off street parking shall be provided for the permitted special use as deemed adequate by the zoning board and approved by the village board in conjunction with the issuance of the special use permit. Furthermore, all off street parking and loading shall be in compliance with the requirements and regulations set forth in chapter 10 of this title. (Ord. 2005-04, 5-16-2005)
