CHAPTER 18

28 RU RURAL RESIDENTIAL DISTRICTS

§ 18.28.010 Purpose.

These districts are established outside the municipal limits of the Town of Saratoga, but within the one-mile buffer zone (lands previously zoned RA) to establish areas where large lot and estate development may occur, be promoted, and be preserved and to encourage the preservation of a semi-rural residential character without the maintenance of ranch size acreage.

§ 18.28.020 Permitted uses.

Permitted uses in the RU district shall be as follows:
A. 
Detached single-family dwellings, but not including recreational vehicles;
B. 
Mobile homes;
C. 
Buried underground utility lines and overhead electrical transmission lines of sixty-nine thousand volts or less;
D. 
Cemeteries;
E. 
Public parks and playgrounds;
F. 
A recreational vehicle for not more than ninety days during construction of a residence on the same premises, which period may be extended for an additional period of ninety days upon application to the zoning officer.

§ 18.28.030 Accessory uses.

The following buildings, structures and uses are permitted when clearly incidental and accessory to the primary permitted uses:
A. 
The keeping of livestock normally associated with a rural environment, such as, but not limited to, fowl, goats, cattle, horses, and ponies;
B. 
Uses and structures normally associated with residences such as: bird aviaries, dog houses, garages, greenhouses, guest cottage, storage sheds;
C. 
Private garage;
D. 
Garden shed;
E. 
Swimming pools pursuant to Section 18.60.010; and
F. 
Home occupations pursuant to Section 18.06.190.

§ 18.28.040 Special permit uses.

The following uses may be permitted within these districts only after review and approval by the planning commission in accordance with the provisions of this title (see Section 18.69.010). The planning commission may place reasonable requirements upon the use prior to granting approval to insure that such a special use will not have a detrimental effect on the area in which it may be located:
A. 
Day care center;
B. 
Public utility building, structure or facility and overhead electrical transmission lines of over sixty-nine thousand volts;
C. 
Radio and television stations and towers;
D. 
Home professional offices;
E. 
Planned unit developments;
F. 
The renting of a portion of a single-family dwelling;
G. 
A bed and breakfast inn;
H. 
Public and commercial recreation areas and facilities including fishing ponds and campgrounds; and
I. 
Membership clubs.

§ 18.28.050 Property development standards.

A. 
Lot and Yard Requirements. Each residential lot shall have front, side, and rear yards of not less than the depth and width indicated below:

§ 18.28.060 Maximum building heights.

Maximum building height is thirty-five feet. All new construction within the airport height restriction area depicted on the official zoning map of the town shall conform to the height requirements described in the "Saratoga Ordinance To Limit Height of Objects Around Shively Airport." A copy of the ordinance is available at the office of the zoning officer.

§ 18.28.070 Site plan approval.

A. 
Site plan approval is required for all permitted uses pursuant to Section 18.09.070.
B. 
Site plan approval is required for all special permit uses.
