CHAPTER 18

40 RA RANCHING AND AGRICULTURE DISTRICT

§ 18.40.010 Purpose.

The purpose of the RA district is to preserve open areas outside the municipal limit of the town not yet ready for development while at the same time permitting ranching, agriculture, and animal husbandry in a manner which attains this purpose. In order to carry out this intent, the town of Saratoga has determined that it is in the town's best interest to assume exclusive jurisdiction for the limited purposes of planning and zoning of that area from the municipal limits of the town of Saratoga to a point which lies one mile outside of the municipal limits of the town of Saratoga. It is the town's intent to enforce only those ordinances pertaining to planning and zoning in this one mile buffer zone. In keeping with the purpose behind RA districts, it is also the intent of the town not to allow primary residential uses not related to ranching and agriculture within this district. If such uses are desired a zone change should be sought.

§ 18.40.020 Permitted uses.

Permitted uses in the RA district shall be as follows:
A. 
General ranching, agriculture, farming, animal husbandry, and their related residences, uses and facilities;
B. 
Churches and Sunday schools;
C. 
Public parks and playgrounds;
D. 
Cemeteries;
E. 
Buried underground utility lines and facilities and overhead electrical transmission lines only serving the area;
F. 
Fishing and hunting lodge development, bed and breakfast establishments, ranch recreation and dude ranch enterprises.

§ 18.40.030 Special permit uses.

The following uses are permitted, subject to the planning commission's approval, pursuant to Chapter 18.69:
A. 
Airports and radio transmitting stations;
B. 
Institutions, rest homes, hospitals, clinics;
C. 
Public buildings, schools;
D. 
Public facilities and utilities limited to above-ground structures including sewage treatment and water supply facilities, substations, distribution and regulator stations and overhead electrical transmission lines serving areas other than Saratoga, all conforming to State Health Department requirements;
E. 
Membership clubs;
F. 
Public and commercial recreation areas and facilities including fishing ponds and campgrounds.

§ 18.40.040 Accessory uses.

Accessory uses in the RA district shall be as follows:
A. 
Customary accessory structures and uses;
B. 
Signs pursuant to Chapter 18.63;
C. 
Private swimming pools, pursuant to Chapter 18.60;
D. 
Boarding and lodging houses.

* Distance increases to a minimum of thirty feet if building houses livestock.
** Greater heights may be approved by the planning commission if the proposed height will not have a detrimental effect on adjacent properties.

§ 18.40.042 General provisions.

Use of land in this district shall also conform to the off-street parking and other provisions of Chapter 18.45.

§ 18.40.043 Site plan approval.

Site plan approval is:
A. 
Required for special permit uses pursuant to Chapter 18.69;
B. 
Required for all permitted uses pursuant to Chapter 18.72.
