15 RD 14000 SINGLE-FAMILY RESIDENTIAL DISTRICT
§ 18.15.010 Purpose and intent.
This district is established within the town to provide areas for single-family dwellings and necessary accessory building. The regulations enumerated for this district are designed to encourage and promote the construction of and the continued use of the land for single-family dwellings, to promote and encourage a suitable environment for family life, to prohibit uses of the land which would substantially interfere with development or continuation of single-family dwellings in the districts, and to prevent use of the land for purposes which would overburden the public facilities. Permitted as conditional uses within these districts will be certain structures and uses required to serve the residents such as public schools, churches and noncommercial recreational areas. Areas zoned for RD 14000 shall be those existing low-density residential areas plus certain underdeveloped areas which should develop in a similar manner according to the land use plan.

§ 18.15.020 Permitted uses.
The following uses are permitted in the RD 14000 zone subject to all provisions of this title:
A.
Detached single-family dwellings, but not including trailers or mobile homes on a permanent basis. The occupancy of trailers shall be prohibited at all times;
B.
Gardening;
C.
Churches and Sunday schools provided the minimum off-street parking requirements, as set forth in Section 18.45.010 are met;
D.
Public park, playground or athletic field;
E.
Public or parochial school;
F.
A mobile home for not more than ninety days during construction of a residence on the same premises, which period may be extended for an additional ninety days upon application to the zoning officer;
G.
Museum;
H.
Buried underground utility lines and overhead electrical lines of sixty-nine thousand volts or less;
I.
Library.

§ 18.15.030 Accessory uses.
The following buildings, structures and uses are permitted when clearly incidental and accessory to the primary permitted use:
A.
Private garage;
B.
Garden shed;
C.
Private playhouse;
D.
Recreation rooms;
E.
Swimming pools as defined in Section 18.60.010;
F.
Signs pursuant to Chapter 18.63;
G.
Home occupations pursuant to Section 18.06.190; and
H.
Requirements for accessory buildings:
1.
Accessory buildings shall be located on the rear half of the lot and at least twenty feet from any main building on an adjoining lot in a residential district. Accessory buildings shall not occupy more than twenty percent of the area of the rear yard and, in the case of a corner lot, shall be located to the back of any required setback building line.
2.
No accessory building shall be constructed within five feet of any rear lot line.
3.
Nothing contained in this section shall prevent the construction of a private garage as a structural part of a main dwelling; provided, that when so constructed, the exterior garage walls shall be regarded as the walls of the main dwelling in applying the front, rear and side yard regulations of this title.
4.
No private garage or other accessory building or parking area shall be within a required front yard, nor within a required side yard.
5.
Detached garages or accessory buildings in a residential district shall conform to a bulk plane. The bulk plane is defined as an imaginary tent-like boundary that starts at the property line and rises straight up from the ground ten feet and slopes inward toward the center of the lot at a forty-five degree angle to a maximum height of eighteen feet.
6.
Required accessory buildings and uses shall be on the same lot with the main building or buildings or on an immediately adjacent lot in the same ownership.
7.
No required accessory parking area or off-street truck loading space shall be encroached upon by buildings, open storage or any other use.

§ 18.15.040 Special permit uses.
The following uses may be permitted within this district only after review and approval by the planning commission in accordance with provisions of this title. (See Section 18.69.010.) The planning commission may place reasonable requirements upon the use prior to granting approval to insure that such a special use will not have a detrimental effect on the area in which it may be located:
A.
Day care centers;
B.
Public utility structure or facility and overhead electrical transmission line of over sixty-nine thousand volts;
C.
Radio and television stations and towers;
D.
Hospitals and clinics;
E.
Home professional offices;
F.
Community service agencies;
G.
Professional office building;
H.
Fire and police stations;
I.
Planned unit development (pursuant to Chapter 18.51);
J.
The renting of a portion of a single-family dwelling unit; and
K.
Membership clubs.

§ 18.15.050 Property development standards.
A.
Lot and Yard Requirements.

* If adjacent to a street other than a local street; or if adjacent to a retail, highway business or industrial district, the lot width when adjacent on the side shall be increased fifteen and the lot depth when the rear lot line is adjacent, shall be increased twenty feet. |
B.
Minimum Yards. Each residential lot shall have front, side and rear yards of not less than the depth and width indicated below:
1.
Main Building.
a.
Front yard setback, thirty feet;
b.
Side yard setback, ten feet;*
c.
Rear yard setback, twenty-five feet.**
* On a corner lot the side yard abutting the street shall be not less than twenty feet in width.
** Measurement of the rear yard setback shall be from the foundation to the centerline of the alley where such alley exists. If no alley exists the measurement will be taken from the foundation to the rear property line.
2.
Accessory Buildings.
a.
Front yard setback, fifty feet;
b.
Side yard setback, five feet;*
c.
Rear yard setback, five feet;
d.
Corner yard setback, twenty feet.
* On a corner lot the side yard abutting the street shall be no less than twenty feet in width.
C.
All structures in the RD 14000 district shall comply with the requirements of Section 18.42.050.

§ 18.15.060 Maximum building height.
The maximum building height is thirty-five feet. All new construction within the airport height restriction area depicted on the official zoning map of the town shall conform to the height requirements described in the "Saratoga Ordinance to Limit Height of Objects Around Shively Airport." A copy of the ordinance is available at the office of the zoning officer.

§ 18.15.070 General provisions.
Use of the land in this district shall conform to the general provisions of Chapter 18.42 and the off-street parking provisions of Chapter 18.45.

§ 18.15.080 Site plan approval.
A.
Site plan approval is required for all permitted uses pursuant to Section 18.09.070.
B.
Site plan approval is required for all special permit uses.
