ARTICLE XVII

C-3 HIGHWAY COMMERCIAL DISTRICT

§ 155.1701 PURPOSE.

   The C-3 Highway Commercial District is designed to accommodate those commercial activities which are oriented toward servicing major arterials.

§ 155.1702 CONDITIONS.

    Uses allowed in the C-3 Highway Commercial District are subject to the following conditions:
   (A)   Dwelling units, other than those located in a hotel or motel, are not permitted.
   (B)   All business, servicing or processing, shall be conducted within completely enclosed buildings, with the following exceptions: Establishments of the "drive-in" type offering goods and/or services directly to consumers waiting in parked motor vehicles, establishments displaying merchandise for sale to the public, outdoor patio seating at restaurants, and establishments providing off-street parking and loading of vehicles that is accessory to a zoning lot’s principal use.
   (C)   The unenclosed parking of trucks as an accessory use shall be limited to vehicles of not over one and one-half tons in capacity when located within 75 feet of a residence district boundary line. Any parking of trucks on land adjacent to residential property shall be screened therefrom by a wall, fence or densely planted compact hedge not less than five feet nor more than eight feet in height.
   (D)   Screening of objectionable views. 
      (1)   Reasonable visual privacy shall be provided for exposed storage areas, machinery installations, and trash or garbage containers as to prevent their being incongruous with the existing environment and neighboring public or private property. Complete concealment using methods including but not limited to, fencing, barriers and/or landscaping installed in accordance with the provisions of this chapter will be required for the protection and the privacy of the enclosure’s contents as well as the aesthetic enhancement of property.
      (2)   Lighting installed upon a building, structure, sign, or within any other fixture shall be shielded so as to prohibit light trespass upon a neighboring property or the public thoroughfare. It shall be unlawful to maintain light levels greater than one foot-candle at any time of day as measured at the curb line.

§ 155.1703 PERMITTED USES.

   (A)    Any use permitted in the C-2 Community Shopping District is permitted in the C-3 Highway Commercial District; and
   (B)   In addition, the following uses are permitted in the C-3 Highway Commercial District:
      (1)   Amusement establishments, including bowling alleys, pool halls, dance halls, gymnasiums, swimming pools and skating rinks;
      (2)   Automobile service stations;
      (3)   Bakeries;
      (4)   Drive-in establishments for uses permitted in this C-3 Highway Commercial District;
      (5)   Electrical showrooms and lighting shops;
      (6)   Greenhouses and nurseries;
      (7)   Hotels and motels;
      (8)   Laboratories and clinics, medical, dental, research and/or testing;
      (9)   Laundries;
      (10)   Physical culture and health services, gymnasiums, reducing salons;
      (11)   Plumbing, kitchen and bath showrooms and shops;
      (12)   Recording and/or sound studios;
      (13)   Signs as authorized and regulated by Chapter 154 of the New Millennium Code of the Village of Schiller Park, as amended, and as may be further amended from time to time hereafter;
      (14)   Taxidermists;
      (15)   Repair, rental or servicing of any article, the sale of which is a permitted use in this C-3 Highway Commercial District; and/or
      (16)   Accessory uses incidental to and on the same zoning lot as a principal use allowable in this C-3 Highway Commercial District, including but not limited to off-street parking and loading facilities as permitted or required in accordance with the provisions of Article XII of this chapter.

§ 155.1704 CONDITIONAL USES.

   (A)   Any use allowed as a conditional use in the C-2 Community Shopping District may be allowed in the C-3 Highway Commercial District (unless listed as a permitted use above).
   (B)   In addition, the following uses may be allowed as conditional uses in the C-3 Highway Commercial District:
      (1)   Amusement establishments, including archery ranges, shooting galleries and other similar amusement facilities;
      (2)   Amusement parks, including permanent carnivals, kiddie parks, golf driving ranges, pitch and putt, miniature golf course and other similar outdoor amusement facilities;
      (3)   Animal hospitals and kennels;
      (4)   Building materials and products sales and storage;
      (5)    Car wash, whether as a primary or accessory use to an automobile service station;
      (6)   Boat showrooms, sales and repairs; provided that a majority of such boats for sale shall be new;
      (7)   Machinery sales;
      (8)   Motor vehicle sales, provided that a majority of such vehicles for sale shall be new vehicles;
      (9)   Printing and publishing;
      (10)   Theaters, drive-in;
      (11)   Undertaking establishments and funeral parlors; and
      (12)   Wholesale establishments.

§ 155.1705 LOT SIZE REQUIREMENTS.

   In the C-3 Highway Commercial District, there shall be a minimum lot area of 3,000 square feet for each business establishment and a minimum lot width of 25 feet.

§ 155.1706 YARD REQUIREMENTS.

   (A)   Front Yards. Uses allowed in the C-3 District shall provide a front yard of not less than 45 feet in depth with a minimum landscape buffer of 5 feet.
   (B)   Corner Side Yard. Where applicable, uses allowed in the C-3 District shall provide a corner side yard of not less than 25 feet in depth with a minimum landscape buffer of 5 feet.
   (C)   Rear Yards. Uses allowed in the C-3 District shall provide a rear yard of not less than 20 feet in depth with a minimum landscape buffer of 5 feet.
   (D)   Side Yards. When uses allowed in the C-3 District are adjacent to a residential district, the use shall provide a side yard of not less than 20 feet in depth with a minimum landscape buffer of 10 feet.

§ 155.1707 FLOOR AREA RATIO.

   In the C-3 Highway Commercial District, the floor area ratio shall not exceed 3.5.
