C-3/O FLEX COMMERCIAL OVERLAY DISTRICT

§ 155.1751 PURPOSE.

   The purpose of the C-3/O Flex Commercial Overlay District is to permit additional uses in the underlying Zoning Districts to meet the changing demands of this specific sub-area of the Village. The C-3/O District shall retain its original zoning district designation and shall gain the additional designation of the C-3/O District. The provisions of this Section shall serve as a supplement to the regulations of the underlying district and the entirety of the zoning ordinance. Where a conflict exists between the provisions of this Section and those of the underlying zoning district and/or the rest of the Zoning Ordinance, this Section shall control.

§ 155.1753 PERMITTED USES.

   (A)   Amusement establishments, arcades, archery or axe ranges, bowling alleys, gymnasiums, miniature golf course, pool halls, recreation or sports, swimming pools, skating rinks and other similar indoor amusement facilities;
   (B)   Bakeries;
   (C)   Banks and financial institutions;
   (D)   Banquet halls;
   (E)   Barbershops;
   (F)   Beauty parlors;
   (G)   Breweries, Distilleries, which may also include tap rooms featuring the service of alcoholic beverages;
   (H)   Candy and ice cream stores;
   (I)   Hotels and motels, which may include restaurants, taverns, meeting rooms, swimming pools and retail sales and personal service business when located within the principal hotel building and where no outdoor sign or advertising is displayed for such accessory use;
   (J)   Offices, business and professional;
   (K)   Restaurants, including the service of alcoholic beverages, entertainment and dancing—but excluding adult entertainment cabarets;
   (L)   Signs as authorized and regulated by Chapter 154 of the New Millennium Code of the Village of Schiller Park, as amended, and as may be further amended from time to time hereafter;
   (M)   Taverns, cocktail lounges;
   (N)   Theater, indoor, other than adult mini motion picture theaters and adult motion picture theaters;
   (O)   Yoga and/or dance studio; and
   (P)   Accessory uses incidental to and on the same zoning lot as a principal use allowable in this C-3/O Mixed Commercial Overlay District, including but not limited to off-street parking and loading facilities as permitted or required in accordance with the provisions of this Section.

§ 155.1754 CONDITIONAL USES.

   (A)   Amusement parks, including permanent carnivals, kiddie parks, golf driving ranges, pitch and putt, miniature golf course and other similar outdoor amusement facilities;
   (B)   Automobile service stations;
   (C)   Car wash, whether as a primary or accessory use to an automobile service station;
   (D)   Drive-in establishments;
   (E)   Drugstores/Pharmacies;
   (F)   Food stores, grocery stores;
   (G)   Medical and dental offices;
   (H)   Medical and health centers for profit; and
   (I)   Theaters, drive-in.
