34 - USE REGULATIONS—PO PROFESSIONAL OFFICE DISTRICT*

17.34.005 - Statement of Intent.

The intent of the PO (Professional Office) district is limited to office and institutional uses and certain service and retail uses compatible with office users.

17.34.010 - Uses Permitted by Right and by Special Use Permit of the Governing Body.

In the PO zoning district the uses permitted by right and allowed by special use permit of the Governing Body are listed in Chapter 17.51, Table of General Uses.

17.34.020 - Permitted Accessory Uses.

In the PO district, additional use regulations shall be as follows:

A.

Living quarters with or without kitchen facilities for the use of the hotel/motel manager or caretaker and their family located within the hotel/motel;

B.

Amusement and sports facilities for the exclusive use of hotel guests, including:

1.

Swimming pool,

2.

Children's playground,

3.

Tennis or other game courts,

4.

Game or recreation rooms;

C.

Restaurants, coffee shops and cafeterias located within the hotel or motel.

17.34.030 - Additional Use Regulations.

In the PO district, additional use regulations shall be as follows:

A.

Premises licensed for the sale or serving of alcoholic liquor pursuant to the Kansas Club and Drinking Establishment Act, or any amendments thereto, in conjunction with hotels and motels.

B.

Public utility rights-of-way, substations, pumping stations and municipal and civic buildings shall be housed in structures that harmonize with the character of the neighborhood and where adjoining residential zones shall have a buffer of fifty (50) feet except that the Planning Commission may reduce the width of buffer areas where the local conditions deem such reduction to be reasonable. Buffer areas shall be adequately screened in accordance with Chapter 17.74 and shall be subject to performance standards procedure and site plan approval by the Planning Commission.

C.

In addition to the particular requirements listed for any use by special permit, the Governing Body may require, where reasonable or appropriate, fences and other safety devices, landscaping, screening, access roads and buffer areas as required.

D.

Buffer areas of fifty (50) feet shall be required for special permit uses; however, the Governing Body may reduce the width of buffer areas where local conditions and substitute protection for neighboring properties is reasonably indicated. Buffer areas shall always be landscaped, screened, bermed if necessary, when adjacent to a residential neighborhood and will not create drainage problems and adequate yard area exists, and maintained in harmony with the landscaping and natural growth in the neighborhood.

E.

Any use permitted in this district within twenty-five (25) feet of a residential district boundary shall be screened along such plot line.

F.

A site development plan showing proper uses for the entire area being considered for rezoning under the ownership of the applicant requesting rezoning may be filed for informational purposes at the time of a request for change in zoning to the PO district. Such site plan may, at the applicants or staff's request be submitted to the Planning Commission for site plan approval concurrently with the rezoning request. Such site plan shall not be incorporated into the rezoning ordinance. The site plan shall be considered as and shall in all respects have the same effect as a site plan submitted pursuant to SMC Title 17, Chapter 56.

17.34.040 - Height and Area Regulations.

The height and area regulations are as follows:

A.

Maximum height requirement: Forty-five (45) feet.

B.

Minimum lot area: Ten thousand (10,000) square feet.

C.

Minimum lot width: Two hundred (200) feet for hotels or motels, and one hundred (100) feet for all other uses; along a public or platted private street.

D.

Minimum yard setback requirements:

1.

Front yard: Seventy-five (75) feet for hotels and motels, thirty (30) feet for all other uses.

2.

Rear yard: Seventy-five (75) feet for hotels and motels, and thirty-five (35) feet for all other uses.

3.

Side yards: Hotels and motels fifty (50) feet; for all other uses twenty (20) feet, however both side yards together must be at least fifty (50) feet.
