06 - ZONING DISTRICTS ESTABLISHED

17.06.010 - Districts Established.

A.

The City is divided into the following districts, the respective symbol for each type of district being set forth opposite its title:

B.

Each such district may be designated on the zoning map, in the use regulations and bulk tables and elsewhere in the text of this title by symbol only.

17.06.020 - Zoning Map.

The areas and boundaries of such districts are established:

A.

As shown on a map entitled "Zoning Map of Shawnee, Kansas" with the date of the latest update included on the Zoning Map.

B.

As specified in Section 17.06.030, such map, referred to herein as the zoning map, together with everything shown thereon, is made a part of this title and incorporated herein by reference.

17.06.030 - District Boundaries on Zoning Map.

A.

Where a district boundary is shown following a street, highway, road, right-of-way, interstate highway, any parkway, a public utility right-of-way, a railroad or a stream or watercourse, the boundary is respectively the centerline of such street, highway, road, right-of-way, interstate highway, parkway, public utility right-of-way, main channel of a stream or watercourse, or a line located midway between the main track of such railroad, and such boundary shall be deemed to be changed automatically whenever the centerline or the main railroad tracks are changed by natural or artificial means.

B.

If such boundary is shown as separated from but approximately parallel to any such landmarked or monumental line, such district boundary shall be deemed to be parallel to the aforesaid centerline, or line located midway between the main tracks of such railroad at such distance therefrom as shown on the zoning map.

C.

Where a district boundary is shown as following a township boundary line, a property line, a plot line or a projection of any one (1) of the same, such boundary shall be such landmarked or monumented line or projection thereof. If such boundary is shown as separated from but approximately parallel to any such landmarked or monumented line or projection thereof, such boundary shall be deemed to be parallel to any landmarked or monumented line or projection thereof, as the case may be, at such distance therefrom as shown on the zoning map.

D.

In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with dimensions shown on the maps measured at right angles from the centerline of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section or division lines, or centerlines of streets and highways, or railroad rights-of-way, unless otherwise indicated. In the absence of a specified distance being indicated on the zoning map, the distance shall be determined by using the map scale.

E.

Where a street, highway, railroad or other physical monument or marker on the ground, by which a boundary is determined, varies from that as shown on the zoning map, the on-the-ground physical monument or marker shall control.

17.06.040 - Street Classification.

A.

For the purpose of providing for the development of the streets, highways, roads and rights-of-way in the City and for their future improvement, reconstruction, realignment and necessary widening, including provision for curbs and sidewalks, each existing street, highway, road and right-of-way, and those located on approved and filed plats, have been designated on the official map of the City and classified therein. The classification of each street, highway, road and right-of-way is based upon its location in the respective zoning districts of the City and its present and estimated future traffic volume and its relative importance and function as specified in the comprehensive plan of the City. The required front yard and maximum building height for any plot shall be measured as set forth for each street classification on the official map pursuant to the rules and regulations for designated street lines in this title. The official map, including any future amendments or changes to the plan and the street, highway, road and right-of-way classification made a part thereof, are incorporated into and made part of this title.

B.

The provisions of the official map incorporated herein are binding for purposes of street classification and for the purposes of this title, whether or not the official map is independently adopted and established pursuant to Chapter 12 of the Kansas Statutes Annotated.

17.06.050 - Boundary Regulations—Plot Divided by District Boundary.

If any plot is divided by a district boundary, the part of such plot within each district shall be regulated by all of the bulk regulations of that district. The number of dwelling units for each part of the plot shall not exceed the number permitted by the district in which the respective part is located and averaging of dwelling units shall not be permitted, if a plot is divided by a zone district boundary and such plot is capable of providing only a single residential requirement of that district which encompasses the majority of the land area of the plot.

17.06.060 - Boundary Regulations—Plots Within Twenty-Five Feet of a District Boundary.

"Alterations," as applied to a building structure, means a change or rearrangement in the supporting members of a building or structure, or an enlargement, whether by extending on a side or by increasing in height, or the moving of one (1) location or position to another.
