CHAPTER 17

04 - GENERAL PROVISIONS

17.04.010 - Short title.

The provisions of this title shall be referred to as the "Sierra Madre zoning regulations."

17.04.020 - Purpose.

The purpose of the enactment of regulations contained in this title in classifying, designating, regulating and restricting the use of buildings, land and structures, is to permit the most compatible use of land within the city, consistent with the needs of residential, commercial and industrial developments within the city, and the promotion of the public health, safety, welfare and general prosperity of the city and its residents.

17.04.030 - Replacement of prior regulations.

Insofar as the regulations contained in this title are substantially similar to the former zoning regulations in effect as of the date of adoption of the provisions codified in this title, such similar provisions shall be construed as restatements and continuation of such regulations and not as new enactments.

17.04.040 - Minimum requirements.

In applying the provisions of these regulations to uses within the city, the same shall be deemed and construed to the minimum standards required for the promotion of the public health, safety, interest and welfare, unless the context of a specific regulation clearly otherwise provides.

17.04.050 - Reference to other laws.

Whenever reference is made in this title to other provisions hereof or other laws, said reference shall be deemed to apply to all amendments now or hereafter adopted, with reference thereto, unless clearly otherwise stated.

17.04.060 - Continuations of existing permits.

All zone variances and conditional use permits heretofore issued by the city shall be deemed to remain in full force and effect. Notwithstanding any other provisions hereof, no use authorized by such previously granted zone variance or conditional use permit, which is being lawfully exercised in compliance with all conditions of approval imposed, shall be deemed to be nonconforming, for any purpose, except as herein specifically set forth.

17.04.070 - Procedure regarding pending proceedings.

If, as of the effective date of these regulations, pursuant to the provisions of the former zoning regulations of the city, legislative or administrative action is pending, such action shall be deemed to have been taken pursuant to the provisions of this title, and shall be finally processed, insofar as possible, in accordance with the provisions of this title.

17.04.080 - Enforcement agency.

The city manager shall designate the officer or officers who shall enforce the provisions of this title.

17.04.090 - Application to the city.

The regulations contained in this title shall not apply to city-owned or leased property, when actually in use by the city.

17.04.100 - Failure to designate specific properties—Classification.

Any property which, for any reason, is not designated on the map as being classified in any zone shall be deemed, for all purposes, to be classified in Zone R-1.

17.04.110 - Area zoning symbols.

Where a number follows the zoning symbol on the zoning map it shall represent the number of thousands of square feet of area required in lieu of the minimum area established in each zone as herein defined. If no number follows the zoning symbol, the areas prescribed in the part governing such zone shall apply.

17.04.120 - Community redevelopment plans—Specific plans.

Notwithstanding any of the provisions of this title, whenever an area of the city has been included in an approved redevelopment plan, or a specific plan adopted pursuant to Section 65000 et seq. of the Government Code, if such plan contains any standards relating to land usage, such standards shall control to the exclusion of any contradictory provision of this title.

17.04.130 - Effective date.

The effective date of each of the regulations is the operative date of the ordinance which adopted such regulations, unless a later date is specified in a particular regulation.

17.04.140 - Severability.

If any portion of this title, or the application thereof to any person or property, is held invalid for any reason, the remaining provisions hereof shall not be affected by such invalidity.
