ARTICLE V

R-1 Residential District

§ 375-18 Purpose.

The purpose of the R-1 Residential District is to provide areas for single-family residential neighborhoods with other compatible uses.

§ 375-19 Permitted uses.

A. 
Permitted principal uses. Permitted principal uses shall be as follows:
(1) 
Agricultural operation.
(2) 
Churches and other places of worship, including parish houses.
(3) 
Essential services. (See § 375-79.)
(4) 
Forestry.
(5) 
Public recreation facilities.
(6) 
Single-family detached dwelling.
(7) 
The keeping of domestic animals in this district shall be limited to house pets, as defined, and shall not include any activity of a commercial nature such as a kennel, stable or coop.
B. 
Permitted accessory uses. Permitted accessory uses shall be as follows:
(1) 
Home occupations.
(2) 
Other accessory structures and uses customarily appurtenant to a permitted use.
(3) 
Private garages and parking areas.
(4) 
Private home gardening and the seasonal sale of produce grown on the property.
(5) 
Signs. (See Article XX.)
(6) 
Private swimming pools, permanent and portable, regulated as follows, except that these regulations shall not apply to portable swimming pools which shall not be more than three feet in height nor more than 15 feet in length:
(a) 
Shall be erected only on the same zoning lot as the principal structure.
(b) 
Shall be erected only in the rear yard of such structure and shall be distant not less than 20 feet from the rear lot line nor less than 10 feet from any side yard line, principal structure or accessory structure attached thereto.
(c) 
Fences, barriers and gates for swimming pools shall comply with the applicable requirements of the Uniform Construction Code.[1]

(d) 
All pumping, cleaning, filtering and screening devices and water supply and discharge shall be of a type and source approved by local and/or state health officials.
(7) 
Game courts, erected on the same lot as the principal structure, shall be set back 15 feet from all property lines and constructed only in the rear yard of the lot.

§ 375-20 Conditional uses.

There are no conditional uses in the R-1 District.

§ 375-21 Uses by special exception.

A. 
See Article XVII.
B. 
Uses by special exception shall be as follows:
(1) 
Hospitals, clinics and philanthropic institutions landscaped in accordance with § 375-85 and located on a public street. (See § 375-109.)
(2) 
Nursery school and day-care center for more than five persons situated on a lot of not less than 20,000 square feet, screened in accordance with § 375-85, and meeting all other state and local requirements. (See § 375-108.)
(3) 
Nursing homes, retirement homes and convalescent homes for more than five persons situated on a lot of not less than 20,000 square feet, screened in accordance with § 375-85, and meeting all other state and local requirements. (See § 375-107.)

§ 375-22 Lot, yard, bulk and height regulations.

For permitted and conditional uses:
A. 
Minimum lot area: 11,250 square feet.
B. 
Minimum lot width: 75 feet, measured at the building setback line.
C. 
Minimum width, each side yard: 10 feet.
D. 
Minimum front yard: 30 feet.
E. 
Minimum rear yard: 40 feet.
F. 
Maximum building coverage (percent of gross lot area): 35%.
G. 
Maximum building height: 2 1/2 stories or 35 feet.

§ 375-22.1 Rental of residential uses.

A. 
Rental of single-family detached residential buildings: Each single-family detached residence may include no more than one dwelling unit for rent. Where a single-family detached residence includes a dwelling unit for rent, the maximum occupancy of the dwelling unit by adult unrelated persons shall be no greater than one more than the number of bedrooms within the dwelling unit.
B. 
Rental of dwelling units. The number of adult unrelated persons occupying a dwelling unit for rent shall not exceed two, except as may be permitted for the rental of single-family detached dwellings.
