ARTICLE VII

R-3 Residential District

§ 375-28 Purpose.

The purpose of the R-3 Residential District is to provide a transitional area between lower-density residential land use and commercial or higher-density use and to provide for a wide variety of residential options.

§ 375-29 Permitted uses.

A. 
Permitted principal uses. Permitted principal uses shall be as follows:
(1) 
Agricultural operations.
(2) 
Churches and other places of worship, including parish houses, and educational facilities.
(3) 
Essential services. (See § 375-79.)
(4) 
Forestry.
(5) 
Multiple-family dwellings.
(6) 
Public buildings.
(7) 
Public recreational facilities.
(8) 
Single-family detached dwelling.
(9) 
Townhouse or row house.
(10) 
Two-family dwelling, duplex.
(11) 
The keeping of domestic animals in this district shall be limited to house pets, as defined, and shall not include any activity of a commercial nature such as a kennel, stable or coop.
B. 
Permitted accessory uses. Permitted accessory uses shall be as follows:
(1) 
Home occupations.
(2) 
Other accessory structures and uses customarily appurtenant to a permitted use.
(3) 
Private garages and parking areas.
(4) 
Private home gardening and similar minor residentially related structures.
(5) 
Private swimming pools, permanent and portable, regulated as follows, except that these regulations shall not apply to portable swimming pools which shall not be more than three feet in height nor more than 15 feet in length.
(6) 
Signs. (See Article XX.)
(7) 
Game courts, erected on the same lot as the principal structure, shall be set back 15 feet from all property lines and constructed only in the rear yard of the lot.

§ 375-30 Conditional uses.

A.

B. 
Conditional uses shall be as follows:
(1) 
Schools, public, private and parochial, provided such schools are chartered or licensed by the commonwealth. (See § 375-102.)
(2) 
Boarding and breeding of domestic animals. (See § 375-101.)
(3) 
Mobile or manufactured home parks. (See Chapter 350, Subdivision and Land Development, and § 375-93.)
(4) 
Motels and hotels. (See § 375-95.) Such uses shall provide a minimum of 150 square feet of floor space for each unit of occupancy and shall include adequate sanitary facilities in accordance with commonwealth and Borough requirements.
(5) 
Planned residential developments. (See Article XV.)
(6) 
Rooming houses, boardinghouses and lodging houses. (See § 375-94.) Such uses shall provide a minimum of 150 square feet of gross floor space for each unit of occupancy and shall include adequate sanitary facilities in accordance with commonwealth and Borough requirements.
(7) 
Group residence facility. (See § 375-103.)
(8) 
Bed-and-breakfast. (See § 375-104.)
(9) 
Personal care home. (See § 375-105.)

§ 375-31 Uses by special exception.

A.

B. 
Uses by special exception shall be as follows:
(1) 
Clubs, lodges and fraternal organizations, social halls. (See § 375-110.)
(2) 
Hospitals, clinics and philanthropic institutions. (See § 375-109.)
(3) 
Nursery school and day-care center for more than five persons situated on a lot of not less than 21,780 square feet (0.5 acre), screened in accordance with § 375-85, and meeting all other state and local requirements. (See § 375-108.)
(4) 
Nursing homes, retirement homes and convalescent homes for more than five persons situated on a lot of not less than 21,780 square feet (0.5 acre). (See § 375-107.)

§ 375-32 Lot, yard, bulk and height regulations.

For permitted and conditional uses:
A. 
Minimum lot area:
(1) 
Residential uses:
(a) 
Single-family dwelling: 7,260 square feet.
(b) 
Two-family dwelling: 8,412 square feet.
(c) 
Townhouse or row house: 10,890 square feet.
(d) 
Multiple-family: 14,520 square feet.
(2) 
All other uses: 10,890 square feet.
B. 
Minimum lot width measured at the building setback line:
(1) 
Residential uses:
(a) 
Single-family dwelling: 50 feet.
(b) 
Two-family dwelling: 60 feet.
(c) 
Townhouse or row house: 70 feet.
(d) 
Multiple-family dwelling: 70 feet.
(2) 
All other uses: 60 feet.
C. 
Minimum width, each side yard:
(1) 
Residential uses:
(a) 
Single-family dwelling: 10 feet.
(b) 
Two-family dwelling: 10 feet.
(c) 
Townhouse or row house:

§ 375-32.1 Rental of residential uses.

A. 
Rental of single-family detached residential buildings: Each single-family detached residence may include no more than one dwelling unit for rent. Where a single-family detached residence includes a dwelling unit for rent, the maximum occupancy of the dwelling unit by adult unrelated persons shall be no greater than one more than the number of bedrooms within the dwelling unit.
B. 
Rental of dwelling units: The number of adult unrelated persons occupying a dwelling unit for rent shall not exceed four, except as may be permitted for the rental of single-family detached dwellings.
