CHAPTER 6

R-3 HIGH DENSITY RESIDENTIAL DISTRICT

12-6-1: PURPOSE:

The purpose of the R-3 high density residential district, is to provide for medium to high density residential development; and permit mobile home park development. (Ord. 518, 6-10-2008)

12-6-2: RESTRICTIONS:

In the R-3 high density residential district no building or premises shall be used, nor shall any building or structure hereafter be erected or altered except for one or more of the following uses in conformance with this chapter. (Ord. 518, 6-10-2008)

12-6-3: AREA REQUIREMENTS:

The following site area requirements apply to the R-3 high density residential district:
   A.   All lots shall have a minimum lot size of eight thousand seven hundred twelve (8,712) square feet;
   B.   All lots shall have a minimum of seventy five feet (75') of frontage on a public street.
   C.   Minimum size for a single-family dwelling unit: one thousand (1,000) square feet. (Ord. 518, 6-10-2008; amd. Ord. 602, 10-16-2019)

12-6-4: USES PERMITTED:

Bed and breakfast that meets the following criteria:
   A.    Maximum of five (5) rooms for lodging of paying guests;
   B.    Must provide one off street parking space for each guestroom as well as all vehicles owned by permanent residents;
   C.    Signage shall be limited to four (4) square feet;
   D.   May not provide meals to paying guests, except for lodging guests.
Cemetery.
Home occupations.
Multiple-family dwellings:
   A.   Each unit shall add one thousand feet (1,000') to the minimum lot size requirement.
   B.    Multi-family (triplex or more should have a minimum of a 4 foot fence).
   C.    Site plans are required for multi-family.
Parks and playgrounds.
Public facilities.
Public or private academic schools.
Single-family dwelling, one. (Ord. 518, 6-10-2008)

12-6-5: CONDITIONALLY PERMITTED USES:

Churches.
Club or lodge of a service and fraternal character when not operated for profit.
Daycare center.
Hospitals.
Mobile home/manufactured home parks.
Nonprofit community clubhouse.
Retirement, convalescent home, nursing home.
Other uses determined by the commission to be in keeping with the purposes and intent of this district. (Ord. 518, 6-10-2008)

12-6-6: LOT COVERAGE:

No building or structure, or total combined square footage of all buildings and structures shall cover more than seventy percent (70%) of its building lot. (Ord. 518, 6-10-2008)

12-6-7: SETBACK REQUIREMENTS:

Setbacks are from the lot lines to the foundation wall of the structure.
   A.   Front Yard: No building shall be erected closer than twenty-five feet (25') from the property line.
   B.   Side Yard: No building shall be erected closer than seven feet (7') or half of the total wall height whichever is greater from any side property line; except corner lots shall maintain a ten foot (10') side yard adjacent to the street which intersects the street upon which the building fronts.
   C.   Rear Yard: No building shall be erected closer than fifteen feet (15') of the property line if there is an alley, if no alley, then seven feet (7'). (Ord. 518, 6-10-2008; amd. Ord. 609, 5-12-2020)

12-6-8: ACCESSORY USES:

Accessory uses are permitted if constructed either at the same time or subsequent to the primary allowed building. Such uses shall be limited to two (2) stories in height not to exceed thirty five feet (35'), shall not encroach upon the front or side yards, and shall be considered a structure when calculating lot coverage. 12-6-9: BUILDING HEIGHT:

No building within the R-3 district shall be constructed greater than a height of two (2) stories not to exceed thirty five feet (35'). (Ord. 518, 6-10-2008)
