ARTICLE XXIII

- ANNEXED PROPERTY

Sec. 23-425. - Policy.

Land annexed by the city after the effective date of the ordinance from which this chapter is derived should be zoned to permit continuation of its existing use, unless the landowner requests that such property be zoned to permit a different use that is compatible with the zoning and/or use of adjacent or contiguous properties.

Sec. 23-426. - Legally nonconforming uses.

Any legally nonconforming use of land annexed after the effective date of the ordinance from which this chapter is derived shall be permitted to continue until such time said legally nonconforming use is discontinued for a period of 12 consecutive months. The city council may recognize and/or establish requirements for perpetuation of a specific legally nonconforming use in the ordinance annexing land into the city.

Sec. 23-427. - Streets, utilities and other infrastructure.

The city shall not require the construction, reconstruction, rehabilitation, upgrade, and/or removal of any privately owned street, utility, or other infrastructure as a condition for annexation.
